RESOLUTION REGARDING WAIVER OF NONCOMPLIANCE FOR
ARISTOCRAT COMMERCIAL DEVELOPERS, LLC
WHEREAS,the Common Council of the City of Jeffersonville, Indiana has heretofore approved
tax deductions through the Urban Enterprise Zone Investment Deduction Program to Aristocrat
Commercial Developers, LLC for the properties located at 246 Spring Street, Jeffersonville,
Indiana and 251-253 Spring Street, Jeffersonville, Indiana; and
WHEREAS, in order to claim the benefits of the granted tax deductions, Aristocrat Commercial
Developers, LLC is required to provide to the Clark County Auditor's Office a document
denominated as an Enterprise Zone Investment Deduction Application (EZ-2).on or before May
15 of each year; and
WHEREAS, Aristocrat Commercial Developers, LLC prepared EZ-2 forms for the properties
located at 246 Spring Street, Jeffersonville, Indiana and 251-253 Spring Street, Jeffersonville,
Indiana but failed to file a timely application with the Clark County Auditor's Office, as required
by Indiana Code 6-1.1-45-10 et seq.; and
WHEREAS,on October , 2022, after due publication of notice thereof, a public hearing was
held on the request of Aristocrat Commercial Developers, LLC to now waive noncompliance of
Aristocrat Commercial Developers, LLC's EZ-2 forms for 246 Spring Street, Jeffersonville,
Indiana and 251-253 Spring Street,Jeffersonville,Indiana for calendar year 2022 pertaining to tax
due in calendar year 2023; and
WHEREAS,after consideration of all information received at the aforementioned public hearing,
the Common Council of the City of Jeffersonville, Indiana finds that it is appropriate to grant a
waiver of noncompliance,pursuant to Indiana Code 6-1.1-12.1-11.3.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Jeffersonville, Indiana,that:
1) Pursuant to Indiana Code 6-1.1-12.1-11.3, the Common Council of the City of
Jeffersonville, Indiana hereby waives compliance of the EZ-2 forms for tax year 2022
payable 2023.
2) This Resolution shall be in full force and effect from and after its passage in accordance
with the law.

failed to timely file a Deduction Application for real property for the Jeffersonville Urban Enterprise Zone's
EZ-2 Investment Deduction and have requested a Wavier of Non-Compliance pursuant to Indiana Code 6-
