Administrator, Brian Smith Safety Manager, Larry Wallace Building Commissioner, Lisa Gill City Clerk and Patsy Kiser Deputy Clerk CALL TO ORDER: Mayor Moore called the meeting to order at 9:30 a.m. in the Mayor's Conference Room in City Hall. APPROVAL OF THE MINUTES: Mr. Crouch made the motion to approve the minutes from April 13,2022. Mr.Waiz seconded the motion; motion passed,3-0. APPROVAL OF PAYROLL: Mr.Waiz made the motion to approve payroll,seconded by Mr.Crouch; motion passed,3-0. OLD BUSINESS: None NEW BUSINESS: Mayor Moore stated that for the past couple of years the boat docks down at the marina have been auctioned off to use for Thunder Over Louisville. The proceeds from the auction are divided between two nonprofit organizations, Center for Lay Ministries and the Clark County Youth Shelter. Mayor Moore presented a check to Kara Brown from Center for Lay Ministries and Ashley Braswell and Laura Felming-Balmer from Clark County Youth Shelter with a check for$1901.50 for each organization. 1. . Larry Wallace-Hearing regarding 220 Walnut Street-home owner,Theresa A. Miller(deceased)on review of compliance with Building Commissioner enforcement- The hearing began at 9:35 am. Mr.Wallace advised there is a house at 220 Walnut Street that is in bad shape that needs to be taken down. There is a representative from Wells Fargo, Richard Hendrickson.-Mr. Merkley asked Mr.Wallace the address that the hearing is regarding. Mr.Wallace stated the address is 220 Walnut St. Mr. Merkley asked Mr.Wallace if his position with the City was the Building Commissioner and Mr.Wallace confirmed it was. Mr. Merkley asked Mr.Wallace if he had inspected the property and Mr.Wallace stated he has, it was last inspected last week and they obtained pictures yesterday. Mr. Merkley advised for the record that the owner of the property, Theresa A. Miller is deceased and as of this morning no estate has been opened on her behalf. Legal did publish notice of today's hearing in the newspaper on April 5,2022. Mr. Merkley showed photos to Mr.Wallace and asked him if they were the photos his office took of the property the previous day, Mr.Wallace confirmed they were and they accurately depicted the current condition of the structure. Mr. Merkley asked Mr. Wallace in his opinion as the Building Commission if the • structure was safe,Mr.Wallace stated it was not, it is a fire hazard, it is a hazard to public health Page 1 of 3 and he considers it to be a public nuisance. Mr. Merkley asked if in.the current condition if it would be dangerous to individuals and Mr.Wallace confirmed it would be. Mr. Merkley asked if the property is vacant and Mr.Wallace confirmed it is vacant. Mr. Merkley asked if there were any reports of anyone getting inside the structure and Mr.Wallace stated that he had a call from the Police Department one evening to have the structure boarded up about two weeks ago. This was the second time it was boarded up. Mr. Merkley asked Mr.Wallace if it was his recommendation that the property be demolished and Mr.Wallace stated that is his recommendation. Mr. Merkley asked if anyone else was present that would like to speak on behalf of the property. Mr. Richard Hendrickson came forward and identified himself as an attorney representing the mortgage servicer,Wells Fargo Bank. He has spoken with Mr.Wallace regarding this property. His client has had their property preservation people go out and inspect the property. They are in the process of contacting a contractor to see what can be done in regards to either repairing or demolishing the property if need be. Wells Fargo Bank only has a mortgage on the property and what they would like to do is have their contractor get in contact with Mr.Wallace to make an appointment to go out there and have access to the property so they can inspect it. They are asking for additional time to do that,they would typically ask for 30 days but given the condition of the structure he is not sure that is feasible. Mr. Merkley asked'Mr. Hendrickson if foreclosure had been filed and Mr. Hendrickson stated it has not. Mr. Merkley stated he has discussed with Larry that they are still waiting for utilities to be cut off before the structure could be torn down. Pursuant to the statute the City has to wait at least 10 days before the structure can be torn down and it may be more due to needing to get the utilities turned off. Mr. Merkley's recommendation is based on the evidence presented the board accept the recommendation of the Building Commissioner that the structure, 220 Walnut Street is unsafe and should be demolished and demolition should occur after 10 days. Mr.Crouch made a motion to accept the recommendation of the Building Commissioner that the structure,220 Walnut Street is unsafe and should be demolished and demolition should occur after 10 days. Mr.Waiz seconded the motion; motion passed, 3-0. 2. Emily Dippie-Request for approval of two (2) public art artisan agreements between the following: • City, Public Arts Commission and Lacey Torrealba—Mrs. Dippie advised that Lacey will be installing a mural down in the NoCo Arts District,on the pipes in front of the water tank. • City,Public Arts Commission and Joe Autry—Joe Autry will be installing two sculptures on pedestals in Shirley's Arbor. Mrs. Dippie advised the Public Arts Budget will support both agreements. Mr. Crouch made a motion to approve the agreements, seconded by Mr.Waiz; motion passed,3-0. 3. JFD Chief Grant-Request for approval of Uniform Conflict of Interest Statement for Marcus Renn —Chief Grant advised this is a request for a Uniform Conflict of Interest Statement for March Renn. Mr. Crouch made a motion to approve the agreements, seconded by Mr.Waiz; motion passed,3-0. 4. Len Ashack-Request for approval of road closure on Cedarview Drive,from 1132-1133 Cedarview to 1200-1201 Cedarview,starting on April 25,2022 through May 12,2022(open to local traffic/closed to through traffic)—Mr.Ashack advised they are in the process of replacing the sewer on Cedarview between 1132-1133 to 1200-1201 Cedarview. He is requesting the closure starts on April 25 and ends on May 12, 2022. Mr.Waiz made a motion to approve the road closure,seconded by Mr. Crouch; motion passed,3-0. Mayor Moore noted that it is political season and there are yard signs popping up in the public right of ways and easements. Department Heads if you see these, please get them. Mr.Wallace stated Page 2 of 3 Code Enforcement has been really busy picking up signs. Mayor Moore said when signs are gathered they are taken to the Street Department and the owner of the signs has seven days to pick them up. MILLER (PROPERTY OWNER) FINDINGS OF FACT AND ORDER WHEREAS, on March 23, 2022 the Building Commissioner ("the Enforcement Authority") citied above property owner for violation of I.C. 36-7-9-2 and Ordinance No. 2010-OR-30; and WHEREAS, the property owner was ordered to repair, rehabilitate or remove the portion of the unsafe building to bring it into compliance with standards for building conditions or maintenance required for human habitation or occupancy; and WHEREAS, a Notice of the Order was sent by certified mail to the following persons with a substantial property interest in the subject premises: 220 WALNUT STREET, JEFFERSONVILLE, INDIANA WHEREAS, service on property owner was unsuccessful; and WHEREAS, the Enforcement Authority ascertained that the property owner was now deceased; and WHEREAS, there was no estate on behalf of the deceased pending in the Clark County clerks nor any other legal action concerning the property; and WHEREAS, notice was published in the The News and Tribune publication advising that a hearing would take place in reference to the property to review the order to determine building code compliance; and WHEREAS, said notice also invited the property owner or any interested party to appear at the hearing to present evidence and/or testimony in reference to the violation; and WHEREAS, a hearing was scheduled upon the Order on April 20, 2022; and WHEREAS, the only person appearing at the hearing before the Board of Public Works and Safety ("the hearing authority") to present evidence or arguments was legal counsel on behalf of Wells Fargo which had a mortgage on the property; and WHEREAS, the Enforcement Authority testified at the hearing that the structure is unsafe because it has not been maintained for many years, is dilapidated and has deteriorated to the point that demolition of the structure is required; and WHEREAS, the Building Commissioner testified that the structure is unsafe and a fire hazard to the neighboring structure; and WHEREAS, the hearing authority adopts the testimony given at the hearing as its Findings and further incorporates the minutes of the meeting. NOW THEREFORE, it is hereby ORDERED that the structure, specifically the structure located at 220 Walnut Street, Jeffersonville, Indiana is an unsafe building and shall be demolished at the direction of the Enforcement Authority in not less than ten (10) days from the date of this Order.
