MINUTES
January 5,2022

CALL TO ORDER: Mayor.Moore called the meeting to order at 9:33 a.m. in the Mayor's Conference Room
in City Hall.
APPROVAL OF THE MINUTES: Mr.Waiz made the motion to approve the minutes from December 29,
2021. Mr.Crouch seconded the motion motion passed,3-0.
APPROVAL OF PAYROLL Mr.Crouch made the motion to approve payroll,seconded by Mr.Waiz; motion
passed, 3-0.

NEW BUSINESS:
1. Sarah Green/Les Merkley—Hearing on Determination of vicious/dangerous animal;animal
owner Jody Waynescott— Hearing began at 9:34 am. Mr. Merkley advised this matter is in
pursuant to the City's Vicious Animal Ordinance,2016-0R-11. The animal control has determined
the dog to be a vicious and dangerous animal and pursuant to that ordinance the owner of the dog
can request a hearing before the Board of Public Works. Mr. Merkley provided the Board with a
copy of the notice of the hearing along with the supporting documentation provided by animal
control. Mr. Merkley asked if Jody Waynescott was present and Mr.Waynescott stated he was.
Mr..Merkley asked Mr.Waynescott what his address is and Mr.Waynescott replied it is 3104
Holman's Lane Jeffersonville, IN 47130. Mr. Merkley asked Mr.Waynescott if he was the owner of
the dog and Mr.Waynescott stated he was not, his wife was the owner of the dog. Mr. Merkley
inquired what his wife's name was and she replied her name is Diana Redditt and she lives at the
same address. Mr. Merkley asked Sarah Green, Director of Animal Control,to outline the
allegations and history of the dog that is before the board. Mrs.Green stated the most recent
incident occurred on 12/10/2021. Koala,the dog in question had gotten out of the apartment and
attacked another dog. Animal Control was dispatched, asked to see the dog,and then was bitten
by the dog. This is the third bite they have on record,the two others occurring on Sellers Court
before the family moved to Holman's Lane. There is also a history of running at large which
precipitated a couple of the bites,these incidents are why they are moving forward to deem it
vicious. Mr. Merkley asked Mrs.Green if it was her opinion as the Director of Animal Control that
the animal is a vicious or dangerous animal under the City's Ordinance. Mrs.Green replied yes.

Mr.Waynescott stated he (Koala)was not. Mayor Moore asked Mr.Waynescott if he bit three
people and Mr.Waynescott stated he bit two people one who came up to their yard with a gun and
approached Ms.Redditt and Koala posted up to protect her and was provoked when the guy
reached out to grab him (Koala). Any time he is approached and someone attempts to grab his
collar he will attack. Mr.Merkley asked Mrs.Green if it was her opinion that the animal, based on
the history with animal control, has been known to have a vicious capability or tendency to attack
unprovoked,causing injury to other human beings and domestic animals.' Mrs.Green confirmed it
was. Mr. Merkley asked if it was based on the observation of her department that the animal
without provocation has bitten a human being or other domestic animal. Mrs: Green confirmed it •

respond to the allegations and speak to the Board. Mr.Waynescott stated the first incident he was

attacking him and Brian was going to shoot Koala but Ms. Redditt ran over and grabbed Koala and
told him to stopand he stopped.

was the person involved in the first bite incident, he lived across the street from them. Mr. Merkley
asked what kind of dog it was and they respondedthat Siberian Husky/;Malamute Mayor Moore_
confirmed that MS. Redditt couldn't,get the`dog under control so she called Mr.Waynescott and he
confirmed that was correct bec• ause he was running and she didn't know what else to do. Mr..
Waynescott stated the second time Koala pushed:Ms. Redditt down, pulled out of her hand
because he is bi er than her and stron erand he pulled'away and she dropped the'leash. Mr

Waynescott advised a man went over to try and grab him to help Ms: Redditt catch him and Ms.•
Redditt was scared and yelled no, no, no .and Koala sensed she was scared so Koala attacked. Ms.
Redditt stated the man got a little scratch on his arm (Mr.Waynescott stated he nipped his finger).
Ms. Redditt stated the man called his work because he didn't want to go to work and the work .'
advised him he had to call the dog pound if he didn't want to go to work. Ms. Redditt stated that's
whyher otherwise he never would have called
Animal Control.. Mayor Moore asked Ms Redditt to co

Waynescott advised the last incident they'were going somewhere and the door wasn't all the way
shut and he snuck out on them and they didn't even know he had gotten out of the apartment.-He
lady yelling and he ran.down thereand_ told the dog to . et in the.house heard:a `g 'and the dog
turned and went straight in the house and got in his cage; He stated everything was under control..
Mr.'Waynescott stated the Police showed up first and advised they had to call Animal Control.
Animal Control told Mr.Waynescott and Ms. Redditt that they had to quarantine Koala for 10 days
and they could keep him at the house. Mr.Waynescott stated he believes they would not be in this
situation, but Animal Control stated they had to see the dog and any time he was out he would
have be muzzled.' Mr.Waynescott said he agreed to that and was going to purchase a muzzle when
Animal Control said they had to see the dog first. Mr.Waynescott said he initially said he would not.
let him out of the cage because he had bit before and Animal Control said he had to be out of the
cage or they would have to take him. Mr.Waynescott got him out and Animal Control was feeding
him treats. Mr.Waynescott,stated they were in his home which is Koala's territory and Koala was
already tense due to just being in a fight, he was not sure which dog initiated the fight but the other
dog was on.a leash and Koala wasn't. When the Animal Control Officer reached around like he was
going to touch Koala, Koala went to jump at the Animal Control Officer and Mr.Waynescott
grabbed Koala and pulled him back and Koala bit him (Mr.Waynescott) a couple of times. When
Mr.Waynescott asked the dog why he was biting he statedKoala dropped down and went and got

back in his cage. Mr.Waynescott stated he told the Animal Control Officer he was going to go
ahead and let him take the dog since he was all wound up. Mr.Crouch asked if the dog bit him (Mr.
Waynescott) and the Animal Control'Officer.;'Mr.Waynescott confirmed`he did, he nipped the ,
Animal Control Officer because Mr Waynescott pulled him back and he took the bite. Mr. ,
Waynescott said it was their negligence that he got loose:;Mayor Moore said he is an animal lover
and his dog comes with him to work every day but they just described three different incidents
where a big dog did damage to someone else and under the ordinance that was writtenin 2016
outlines what needs to be done next. Mr. Merkley stated that Animal Control has determined that
based on the history of the animal that is a vicious and dangerous animal and the owners have
appealed that to the Board of Public.Works,which is the owners' right under'theordinance. The
Board must now make a decision to either,affirm the determination by"Animal Control that the
animal is vicious and'dan dangerous or theycan decide it is n g of vicious and dangerous. If they do say it
is vicious and dangerous, certain things have to,happen in order for the owners to keep the dog:. It
will be registered as a vicious or dangerous animal,they will have to confine the animal per the

touch him. Mayor Moore said wouldhe

Mr.Waynescott said he understands that.but he was'doing it to socialize him to humans and that
the'`dog was making progress:' Mayor Moore confirmed with Mr. Merkley that he and Mrs.Green
are,askin the Boardg` to confirm the decision . ,;gthat the animal is vicious and dan erous

Mr.Waynescott stated Koala is the biggest baby with them and he really is a good dog-with them
2. : Paul Northam-Request for approval of Conflict of Interest for Tim McCoy-Mr Northam stated
this is"the Uniformed Conflict of Interest statement for Tim'McCoy '
Mr.,Waiz made a motion to approve the Conflict of Interest Statement, Mr.Crouch seconded the
'motion, motion passed,3 0.. ;,
3 Scott McVoy=Request for approval of contract between City, Police Department and Police Service
Dog Consulting and Jericko Media—Assistant Chief McVoy advised this is the annual contract for.
Police Service Dog Consulting`which is the training and maintenance of JPD K9s Unit for 2022.
Assistant Chief McVoy stated they do not have the contracts in front of.them as he was not
expecting the meeting to be held virtually The second contract is for Jericko Media and this allows
them to do their Detective 3D scans throughout the course of the year. Both of these contracts are
in their budget and he is requesting approval pending legal review

Mr.Crouch made a motion to approve the contracts pending legal review and Mr.Waiz seconded
the motion; motion passed, 3-0.
