HomeMy WebLinkAboutMarch 15, 2021 Council Minutes COMMON COUNCIL OF THE CITY JEFFERSONVILLE, INDIANA March 15, 2021 Regular Meeting Minutes The Common Council of the City of Jeffersonville, Indiana met for the Regular Meeting via teleconferencing on March 15, 2021. Council President Owen along with City Clerk Gill called the virtual meeting to order at 7:02 p.m. ROLL CALL: The roll call was conducted by City Clerk Lisa Gill and those members present were Council President Owen those members teleconferencing (Covid-19)were Councilperson White, Councilperson Burns, Councilperson Paris, Council Vice President Maples, Councilperson Webb, Council President Owen, Councilperson Hawkins, and Councilperson Ellis. Councilperson Croft was not present at the meeting. INVOCATION: Council President Owen asked Councilperson Ellis to lead the Invocation. APPROVAL OF MINUTES: Council Vice President Maples made a motion to approve the Minutes of March 1, 2021 of the Regular Meeting, seconded by Councilperson Hawkins; roll call vote: Councilperson White -Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 8-0 APPROVAL OF THE AGENDA: Council President Owen stated they would need to table number 9 again. Councilperson Webb made the motion to approve the Agenda with tabling number 9, seconded by Councilperson Hawkins; roll call vote: Councilperson White -Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 8-0 CLAIMS TO APPROVE: Civil City$902,223.62—Ms. Heather Metcalf, City Controller presented the Civil City Claims and indicated no changes. Councilperson Webb made the motion to approve the Parks Claims, seconded by Councilperson Burns; roll call vote: Councilperson White-Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 8-0 REPORT OF THE CLERK: None tonight. UNFINISHED BUSINESS: 1. Les Merkley 2020-OR-67 An Ordinance Establishing Fees for Copy of Body Camera Video Taken by The Jeffersonville Police Department at Accident Scenes—Tabled during approval of agenda. 2. Len Ashack Reconsidering 2021-OR-7 Ordinance Repealing Ordinance 2011-OR-73 and Establishing Sewer Rates and Sewer Capacity Fees—Council President Owen stated he met with Councilperson Webb and Councilperson Burns and they discussed on how they could make some changes so that they could pass something that was meaningful. He put together some language in the Ordinance that he thought they could agree on and sent that out late last night. Councilperson Burns made a motion to amend the ordinance to reflect the changes that were proposed. Councilperson Ellis stated he would be abstaining because he had eye surgery and was unable to read what was presented. Councilperson Webb seconded the motion to amend the motion, roll call vote: Councilperson White -Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples- No Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Abstain Motion passes 6-1-1 Page 2 of 5 Mr. Baldessari stated there in Indiana statute there is a 15% max surcharge for residents outside city limits without going for additional approval. It is very expensive and time consuming to go through the process. Mr. Wilder advised that the Council could pass the Ordinance on the first reading and then discuss further or they could table to discuss further. Mr. Orem asked if they could meet to discuss to try to explain what they are trying to do and so that everyone is on the same page. Council President Owen agreed that there should be a joint Public Meeting so that there is no confusion moving forward. He proposed that they have the meeting on March 29th at 6:00 pm. Councilperson Burns made the motion to table the ordinance, seconded by Councilperson Webb; Councilperson Burn rescinded his motion and made a motion to approve the amended ordinance on the first reading. Councilperson White seconded the motion, roll call vote: Councilperson White -Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples- No Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 7-1 The joint Public Meeting will be on March 29th at 6:00 pm and Council President Owen asked that Mr. Wilder notice for that meeting. 3. Chad Reischl 2021-OR-9 Ordinance Establishing a Tree Ordinance—Mr. Reischl stated the only changes removed the words regulations and replaced that with responsibilities and standards. The other content has not changed. Councilperson White made the motion to amend the ordinance, seconded by Councilperson Burns; roll call vote: Councilperson White -Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Abstain Motion passes 7-0-1 Councilperson White made the motion to approve the ordinance as amended on the third and final reading, seconded by Councilperson Burns; roll call vote: Councilperson White -Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen-Yes Councilperson Hawkins—Yes Page 3 of 5 Councilperson Ellis—Abstain Motion passes 7-0-1 4. Heather Metcalf 2021-OR-11 Ordinance of Additional Appropriation (Public Hearing)—Mrs. Metcalf stated there are no changes. Council President Owen opened the Public Hearing at 7:37 PM. There was nobody present at City Hall to speak on the matter and City Clerk Gill stated her office did not receive any written comments for the record.The Public Hearing was closed Councilperson Hawkins made the motion to approve the ordinance on the third and final reading, seconded by Councilperson Paris; roll call vote: Councilperson White-Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft- Not present Councilperson Webb—Yes Council President Owen -Yes Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 8-0 NEW BUSINESS NONE ATTORNEY COMMENT: Corporate Counsel, Les Merkley—Not Present Council Attorney, Larry Wilder—Happy Ides of March to all of you DEPARTMENT HEAD COMMENT: Mrs. Metcalf—Nothing, thank you. We are getting ready to start our 2019 audit. The State has decided they want to contract that out this year. The Finance Department likes to do those audits 2 years at a time and 2020 is going to be a more extensive audit due to Covid related issues. Doing both would come at a reduced rate, but there is nothing budgeted for this because normally the State handles this. The total comes right at$43,000. We do not need any action on this right now and he just wanted everyone to be aware of it.
