In the event that does not happen and an extension is not granted,the City will go in and demolish the property; For the 'record pursuant to State Law once this building is taken down it is still considered a non-legal conforming structure which means as long as they do not expand the footprint of this building they are able to rebuild without any of the other approvals normally needed. Mr.Gomar confirmed that was his understanding as well. Mr. Merkley asked if there was anyone else present to speak on the matter as it was.a public hearing. Kailey Coursey identified as an employee of the Building Commissioners office. Mr.Merkley asked if she agreed with Mr.Wallace's assessment of the property and she stated yes. Mr. Merkley asked Ms.Coursey to confirm that it was an unsafe structure and Ms.Coursey stated she agreed it is an unsafe structure and that it should be taken down. Mr. Merkley stated he recommended to the board that they make a motion and a second to determine the property at 1626 Kehoe Lane as an unsafe structure pursuant to 36-7-9-4 and that the property owner be given 10 days from the issuance of the demolition permit to have the. structure removed and if that does not happen then the City will go in and remove it.
