ORDINANCE AUTHORIZING THE WITHHOLDING OF CITY
FUNDS FOR PAYMENT OF ASSESSMENTS
AND DEBTS TO THE CITY OF JEFFERSONVILLE
WHEREAS, from time to time, the Jeffersonville Sewer Department and other city
offices, forward bills and make assessments to residents of and businesses and other
entities in the City of Jeffersonville; and
WHEREAS, some city employees, businesses and other entities within the City do
not pay debts and assessments due to the City of Jeffersonville.
NOW, THEREFORE, LET IT BE ORDAINED by the Common Council of the
City of Jeffersonville that if a city employee, a contractor for the City of Jeffersonville or
any other persons, businesses or entities who are entitled to receive any payments,
property or income from the City of Jeffersonville become more than sixty (60) days past
due on any assessment, debt or obligation to the City of Jeffersonville, that the City of
Jeffersonville may withhold payment of any monies or other thing of value which the City
is obligated to pay to such employee, contractor, or any other persons or entities, who are
entitled to receive property from the city until such time as the obligation to the City is
paid in full. However, in the event that the obligor is an individual who is a regular
employee of the City of Jeffersonville, the City may only withhold up to a maximum of
10% of the net proceeds of each of the employees' regular paychecks, until such time as
the debt is paid.
Notwithstanding the provisions above, an obligor to the City of Jeffersonville may
obtain relief from the collection procedures outlined above by making arrangements for
the payment which are approved by to the Jeffersonville City Council, or, in the case of
a delinquent sewer bill, by the Board of Public Works and Safety.
