HomeMy WebLinkAboutNovember 16, 2020 City Council Minutes COMMON COUNCIL OF THE CITY JEFFERSONVILLE, INDIANA November 16,2020 Regular Meeting Minutes The Common Council of the City of Jeffersonville, Indiana met for the Regular Meeting via teleconferencing on November 16,2020. Council Vice President Maples along with City Clerk Gill called the virtual meeting to order at 7:01 p.m. ROLL CALL: The roll call was conducted by City Clerk Lisa Gill and those present were Council Vice President Maples and Councilperson Croft;those members teleconferencing(Covid-19)were Councilperson Burns,Councilperson Paris,Councilperson Webb,Councilperson Hawkins, and Councilperson Ellis.Council President Owen was not present due to being on his honeymoon and it was noted that Councilperson White was having " difficulty remoting in and would be there soon by Councilperson Burns. INVOCATION: Council Vice President Maples requested Councilperson Ellis to lead the invocation. APPROVAL OF MINUTES: Councilperson Burns made a motion to approve the Minutes of November 2,2020 of the.Regular Meeting, seconded by Councilperson Webb; roll call vote: Councilperson White-Not present Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft-Yes Councilperson Webb—Yes _ Council President Owen- Not present Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 7-0 APPROVAL OF THE AGENDA: Council Vice President Maples advised it had been requested that the Council remove number 11,the applicant had revoked their application to have the property rezoned. Additionally, he has been asked if there was the will of the Council to add the FOP contract to the agenda,if so it would have to be a unanimous vote. Councilperson Burns made the motion to remove the agenda item 11 and add the FOP contract under new business,seconded by Councilperson Croft; roll call vote: Councilperson White- Not present Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft-Yes Councilperson Webb—Yes Council President Owen-Not present Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 7-0 Page 1 of 5 CLAIMS TO APPROVE: Civil City$2,078,195.73—Ms. Heather Metcalf,City Controller stated she has a hand carried claim for the amount of$1,310.34. This is for Dell Marketing. Ms. Metcalf stated she wanted to add it to this claims list so that she could order other things,there has been a hold put on the account until a payment was received. The new claims total presented was$2,079,506.07. Councilperson Hawkins made the motion to approve the Civil City Claims,seconded by Councilperson Paris; roll call vote: Councilperson White-Not present Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft-Yes Councilperson Webb—Yes Council President Owen-Not present Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 7-0 Parks$92,105.11-Ms. Metcalf indicated there was no changes. UNFINISHED BUSINESS: 1. Chad Reischl 2020-OR-57 Amending 2014-OR-26 An Ordinance Regulating Door-to Door Solicitation and Transient Merchants in Order to Change the Rules of Food Trucks Within the City Mr. Reischl stated based on the conversation a few weeks ago they have amended the language to include the background check of the owner of the food truck. Councilperson Croft stated his concern was that the owner of the truck would not always be the person serving the food and he would like to know that the Council had done everything possible to assure safety. Mr. Reischl stated the language in the ordinance read as the owner or the primary operator of the food truck. Heather Metcalf 2020-OR-63 Ordinance Transferring Certain Funds Within the Same Department Heather Metcalf presented and stated there are no changes. Councilperson Paris made the motion to approve the ordinance on the third and final reading,seconded by Councilperson Croft; roll call vote: Councilperson White-Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft-Yes Councilperson Webb—Yes Council President Owen-Not present Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 8-0 3. Chad Reischl 2020-OR-_Rezone Request for Property Located at 715 Allison Lane(R1-Low Density Residential to M1 Low Density Multi-Family Residential) Removed during approval of agenda. NEW BUSINESS 1. Heather Metcalf 2020-OR-64 Ordinance of Additional Appropriation (Public Hearing on December 7th) Heather Metcalf presented the additional appropriation and what it entailed. The first one was for the Police Department and would appropriate insurance reimbursements they had received.The next five were all for the CARES act and then the last appropriated the General Fund for the Council. Council Vice President Maples confirmed that the Public Hearing would take place on December 7, 2020. Councilperson Ellis stated he would like to see these departments being individualized for additional appropriations so that the Council could vote on them independent of one another. Heather Metcalf 2020-OR-65 Ordinance of Transfer of Funds Within the Same Department Heather Metcalf stated this would be the last transfers for the year. Councilperson Hawkins made the motion to approve the ordinance on the first and second reading, seconded by Councilperson White; roll call vote: Councilperson White-Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Page 3 of 5 Councilperson Croft-Yes Councilperson Webb—Yes Council President Owen-Not present Councilperson Hawkins—No Councilperson Ellis—Yes Motion passes 8-0 3. Local contract with the FOP Council Vice President Maples stated that Councilperson Burns was the lead on the negotiations for this contract and asked if there was anything that needed to be discussed. The contract was sent out previously. Councilperson Burns stated there were minimal changes. Council Vice President Maples stated he spoke to FOP President Stewart to discuss the details and appreciated that all of his questions were answered. Councilperson Croft made the motion to approve the contract,seconded by Councilperson White; roll call vote: Councilperson White-Yes Councilperson Burns—Yes Councilperson Paris-Yes Council Vice President Maples-Yes Councilperson Croft-Yes Councilperson Webb—Yes Council President Owen- Not present Councilperson Hawkins—Yes Councilperson Ellis—Yes Motion passes 8-0 ATTORNEY COMMENT: Corporate Counsel, Les Merkley—No comment Council Attorney, Larry Wilder—Stated in regards to the contract that was just approved,you (the Council) have approved this contract and now it will go to the Mayor but he is not obliged to execute the contract because the contract is between him and the department, however that has never happened but he always feels compelled to point that out. DEPARTMENT HEAD COMMENT: None DEPARTMENT HEAD COMMENT: Council Vice President Maples inquired if there were any comments submitted to the Clerk's Office. City Clerk Gill advised that no public comments were received. Council Vice President Maples stated there was an individual signed up to speak on number 11 however it was removed from the agenda. COUNCIL COMMENTS: • Councilperson White—No comment • Councilperson Burns—No comment • Councilperson Paris—No comment • Council Vice President Maples—Stated he was happy the contract with the FOP was approved and how efficient the meeting was.
