Council President Owen along with City Clerk Gill called the virtual meeting to order at 7:02 p.m. INVOCATION: Council President Owen requested Councilperson Ellis to lead the invocation. ROLL CALL: The roll call was conducted by City Clerk Lisa Gill and those present was Council President Matt Owen and Councilperson Steve Webb;those members teleconferencing(Covid-19)were Councilperson Dustin White, Councilperson Bill Burns, Councilperson Joe Paris, Council Vice President Scottie Maples, Councilperson Donnie Croft,Councilperson Scott Hawkins and Councilperson Ron Ellis-all members present. Heather Metcalf 2020-OR-47 Appropriations and Tax Rates(2021 Budget Adoption) Ms. Metcalf indicated no changes. Council President Owen indicted Councilperson White has been in contact with changes. Councilperson White—I sent out to four or less a draft budget that was revenue neutral and a summary with excess with respect to estimated revenue for each budget line. If it is necessary to spend we can discuss that after we know where our numbers are. Thanks to Ms. Metcalf for her assistance in helping to present to review and discuss. Councilperson Hawkins inquired what we are trying to rectify. Councilperson White indicated there are 8 budget lines dipping into reserves;this is a revenue neutral budget that does not affect City services. My understanding that in 2022 we will know the consequences of the pandemic to the budget. Councilperson Ellis—I have concerns because I am not in favor of request for additional appropriations next year; rather see us appropriate the funds in the budget. Councilperson White—the only appropriation I expect at this point is the Police body cameras. Council President Owen shared concerns with dipping into reserves if we can find a way to mitigate the hit in 2022;things at a glance that I am not sure I agree with. Maybe meet later this week. Councilperson Hawkins made the motion to pass on the second reading on the budget that passed on first reading,seconded by Councilperson White; roll call vote: Councilperson White-yes Councilperson Burns—yes Councilperson Paris-yes Council Vice President Maples-yes Councilperson Croft-yes Councilperson Webb-yes Council President Owen-yes Page 2 of 7 Councilperson Hawkins—yes Councilperson Ellis—abstain,stating he needed more time and information to digest Motion passes 8-0-1 2. Heather Metcalf. 2020-OR-48 Ordinance for Additional Appropriation Ms. Metcalf indicated no changes, and reminded the Council this is the reimbursement from Greater Clark County School Corporation to reimburse the Park's Department. ***Council President Owen opened the Public Hearing at 7:32 p.m. Ms.Gill reported no calls/letters received by the Clerk's office. Mr. Reischl Director of Planning and Zoning, indicated no one appeared for or against the Ordinance. Kim Calabro 2020-OR-49 for the 2021 Salary Ordinance Ms. Kim Calabro, Human Resources Director indicated that no changes. Attorney Abigail Fargen Riley 2020-OR-50 working with Harold Hart and Jeffersonville Commons LLC —Petition to partially vacate roadway Ms. Fargen Riley with Applegate, Fifer and Pulliam Law Firm indicated this is from 2018 vacate of Sellers Court triangle piece omitted;this is cleanup work to the corner piece and fixing another dedication section of Sellers Court for the layout of Jeffersonville Commons development. Approve by the Board of Public Works and by the Engineering Department. Councilperson Hawkins made the motion to approve the petition on the first and second reading. Council President Owen open Public Hearing at 7:27 p.m. Mr. Reischl indicated no one appeared for or against the petition. Ms. Gill indicated no calls/letters received in the Clerk's office. Les Merkley 2020-OR-51 Request Approval of Bond Ordinance Mr. Les Merkley Corporate Counsel, indicated this is for the proposed senior living facility development bond for the developer to close on the transaction and take advantage of tax benefits that State Statue allows that the Council gave a go ahead earlier this year. This is not an obligation or count toward debit limit for the City. Mr. Mathew Carr and Mr. Beau Zoeller from Frost, Brown and Todd were in attendance. Chad Reischl 2020-OR-52 Request for Rezone 906 Nachand Lane from R3 Old City Residential to M1 Multi-Family Residential Mr. Chad Reischl, Director of Planning and Zoning indicated this request is from Mr. Edward Ridgeway and come from Plan Commission with no recommendation. This was a single family home and recently had a fire. Mr. Ridgeway is wishing to rebuild with a new concept adding two or three units. Ultimately may get into a situation to grant a number of variances and waivers in order to make any development plan. There are commercial and multi-family uses in the area, although it is primarily adjacent to single-family residential zone districts. Councilperson Webb confirmed that there was no layout presented at Plan Commission meeting and this would affect the neighbors and that is why there was no recommendation. Mr. Reischl indicated that a set of plans and elevations is not required at Plan Commission meetings, but is highly recommended and believe they wanted rezone approval before investing in plans. Mr. Merkley indicated they would have to submit a development plan for any project on this parcel. Normally a development plan is ministerial, but in this situation in all likelihood it would not meet our subdivision control ordinance without significant waivers and variances; it would be at the discretion of Planning Commission as to whether or not the development plan would be approved. Council President Owen opened the Public Hearing at 7:37 p.m. Ms. Gill reported no calls/letters received in the Clerk's office. Ms. Penny Owings of 1503 Ellwanger, neighbor to this property appeared and stated that she is opposed the rezoning of this property. It backs up to my property which is about 15 feet out my backdoor to his line, privacy issues and because this is not good situation on that land. I feel that it would decrease my property value having multiple units. I don't know where there are going to park. I don't know a lot of information about this because he has not presented anything to see. They had a fire on that property in May and it required the Sheriffs Department getting involved to get the folks out. They were living in there with no heat, no electric, no water and that was a real concern because I was afraid that they were going to start another fire. They boarded up the door, put a sign on it and the lady comes there all the time takes the board down and goes in. I am concerned about the rezoning and ask that you not consider approving it at this point. Public Hearing closed at 7:40 p.m. Council President Owen asked for clarification of R3. Applicant, Mr. Ridgeway was not here but was at the Plan Commission meeting. Page 4 of 7 Councilperson Webb and Paris both indicated that not enough information was present to approve at the Plan Commission meeting. Chad Reischl 2020-OR-53 Request for Rezone 1970 Dutch Lane from R1 Low Density Residential to C2 Medium to Large Scale General Commercial Mr. Reischl indicated this request is from Mr. Billy Carver who owns a small auto sales lot on this property. He has been operating under a 2003 use variance which limits sales to about 15 cars at a time. Property is adjacent to other C2 zoned properties, and this will allow him to operate with more than the 15 that is currently allotted. This comes to you with a favorable recommendation from Plan Commission. Council President Owen opened the Public Hearing at 7:46 p.m. Ms.Gill reported no calls/letters received. Mr,. Reischl indicated no one appeared for or against the rezone. Public Hearing closed at 7:47 p.m. Councilperson Webb indicated he believed that the applicant is making this request to be in compliance with zoning code. Chad Reischl 2020-OR-54 Request for Rezone Lot 40,Aldridge Court from C1 Small to Medium Commercial to R2 Single Family Residential Mr. Reischl indicated this property has an interesting history; subdivision was plated in 1941 just before WWII but never happened. Later bought and zoned commercial, but most lots are still vacant. Mr. Ivan Izquierdo is looking to subdivide a small lot and build a single family home between two single family homes that are R2. Council President Owen opened the Public Hearing at 7:48 p.m. Ms.Gill indicate that no calls/letters were received in the Clerk's office. Mr. Reischl indicated no one appeared for or against the ordinance. Council President Owen closed the Public Hearing at 7:49 p.m: Councilperson Paris indicated this comes from Plan Commission with a favorable recommendation. Heather Metcalf 2020-OR-55 Ordinance of Additional Appropriation Ms. Metcalf indicated this is for unsafe building and demolition fund, cash that is already there.
