BEFORE THE COMMON COUNCIL FOR THE CITY OF JEFFERSONVILLE
STATE OF INDIANA
A RESOLUTION ESTABLISHING LONGEVITY PAY FOR
THE MAYOR OF THE CITY OF JEFFERSONVILLE
WHEREAS, I.C. 36-1-2-6(3) designates the Common Council of the City of Jeffersonville as
the Fiscal Body of said city; and
WHEREAS, I.C. 36-1-2-9(3) designates the Common Council of the City of Jeffersonville as
the Legislative Body of said city; and
WHEREAS, I.C. 36-4-7-2(b) states the Common Council of the City of Jeffersonville shall
fix the annual compensation of all elected city officers; and
WHEREAS, I.C. 36-4-7-2 sets forth that:

Sec. 2. (a)As used in this section, "compensation" means the total of all
money paid to an elected city officer for performing duties as a city officer,
regardless of the source of funds from which the money is paid.The term
includes all employee benefits paid to an elected city officer, including life
insurance, health insurance, disability insurance, retirement benefits, and
pension benefits. For purposes of determining an increase or decrease in
compensation of an elected city officer,the term does not include any of the
following:
(1) Payment of an insurance premium.
(2) Payments in recognition of:
(A)longevity;
(B)professional certifications; or
(C) educational advancements;
that are separately identified on a salary ordinance or resolution.
(3) Payment of a stipend or per diem allowed by statute.

(4)A payment authorized under section 4 of this chapter.
(b)The city legislative body shall,by ordinance, fix the annual compensation
of all elected city officers.An ordinance adopted under this subsection that
fixes the annual compensation of an elected city officer shall provide for an
annual, monthly, or biweekly salary schedule.An elected city officer is not
required to report hours worked and may not be compensated based on the
number of hours worked.
(c)The compensation of an elected city officer may not be changed in the
year for which it is fixed nor may it be reduced below the amount fixed for
the previous year.

WHEREAS, I.C. 36-4-7-2(a)(A) allows the Council to elect to pay money to an elected
official based upon "longevity" of the elected official;
WHEREAS, when the citizens of the City of Jeffersonville re-elect their Mayor to serve
another four (4) year term in office, it is an endorsement of their acumen;
WHEREAS, the president Mayor has served in his capacity for eight (8) years therefore, it
would seem prudent and reasonable to pay a sum of money to serve as a payment reflecting his
longevity as Mayor of Jeffersonville;
WHEREAS, the reason for making this payment in the form of "longevity" rather than
"salary" is to allow subsequent City Councils the opportunity to determine what is a fair and
reasonable "salary" and/or "compensation" for the Mayor's successor, whenever that time may
be at the time that a "new" is no longer serving in that capacity;
NOW, THEREFORE, LET IT BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JEFFERSONVILLE, INDIANA THAT:
Section 1. The City Council is desirous of rewarding longevity to a Mayor that has been
endorsed by the citizens by electing them for multiple terms by assessing a monetary sum to
reflect their years of service to this community and to reflect the citizens' expressions of
satisfaction for the job well done.
Section 2. The City Council shall direct the City Fiscal Officer to pay the Mayor a lump of
five (5%) percent for each successive term that the Mayor is re-elected. This shall mean that a
Mayor shall receive five percent (5%) upon being re-elected for a second term and an additional
five percent (5%) of elected to a third term and five percent (5%) if elected for a third term. In

sum, the longevity would be five percent 5% of the gross salary upon re-election; 10% of the
gross salary upon being elected for a second term and 15% of the gross salary upon being re-
elected for a third term and so on.
Section 3. Effectiveness. This Resolution shall be adopted after the passage by the
Common Council of the City of Jeffersonville and approved by the Mayor of the City of
Jeffersonville, or timely override his veto. This Ordinance shall be in full force and effect as of
January 1, 2020.
