HomeMy WebLinkAboutCC JULY 1, 2019 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JULY 1, 2019 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday,July 1, 2019. Council President Ed Zastawny along with City Clerk Conlin called the meeting to order at 7:03 pm. Mr. Bobby Campbell gave the invocation. Council President Zastawny asked those in attendance to stand and recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were Councilperson White, Councilperson Paris, Councilperson Gill, Councilperson Hawkins, Councilperson Maples, Councilperson Ellis, Councilperson Samuel and Council President Zastawny. Councilperson Owen was absent from the proceedings. MINUTES TO BE APPROVED: June 17, 2019 Regular Proceedings—Councilperson Gill made a motion to APPROVE the minutes with Councilperson Samuel seconding, PASSING on a vote, 8-0. APPROVAL OF THE AGENDA: Councilperson Maples made a motion to AMEND the agenda tabling items number 9 and 13 with Councilperson Hawkins seconding, PASSING on a vote, 8-0. Councilperson Gill made a motion to APPROVE the amended agenda with Councilperson Maples seconding, PASSING on a vote, 8-0. CLAIMS TO BE APPROVED: City Controller Heather Metcalf presented the Civil Claims. Travelers needs to be reduced by$14.06 on page 3. On page 10 there is a claim for Sims that should be $200 instead of$100. The new total is $1,317,211.03. Councilperson Gill asked if all claims were in order and they are. Councilperson Gill made a motion to APPROVE the claims with Councilperson Ellis seconding PASSING on a vote, 8-0. City Controller Heather Metcalf presented the Parks Claims. On page 1 the claim for Deering needs to be deleted. There were also some GL numbers that needed to change. The new total is$296,266.10. Councilperson Gill made a motion to APPROVE the Parks Claims with Councilperson Paris seconding, PASSING on a vote, 8-0. REPORT OF THE CLERK: Nothing at this time. UNFINISHED BUSINESS: 1. Ed Zastawny/Heather Metcalf—2019-OR-27 An Ordinance Transferring Certain Funds within the Same Department—Tabled during approval of agenda. 2. Ed Zastawny/Andy Crouch—2019-OR-28 An Ordinance Transferring Certain Funds within the Same Department—There have been no changes since the last meeting. Councilperson Gill made a motion to APPROVE 2019-OR-28 with Councilperson Samuel seconding, PASSING on a vote, 8-0. NEW BUSINESS: 1. Ed Zastawny—Lisa Gill—Rose Hill Neighborhood—Councilperson Gill stated she has been contacted multiple times in regarding noise issues in the Rose Hill Neighborhood. Mary Jo Carrico is present to speak on the matter. Mary Jo Carrico—217 W. Market St.—She has lived in her home for 15 years now and many of the neighbors are longtime residents. Up until 3 years ago they had a wonderful quality of life, but now the noise is ruining their peace and quiet. Mary Jo Carrico gave an overview of the different issues they are having regarding the noise downtown and the events. Ms. Carrico submitted her full statement for the record. Jerry Sue Griffith—220 Pearl Street—She was willing to give them their chance but they are not good neighbors. They make a joke of it, the people who work there have no investment. The police have tried but their hands are tied with no way to enforce it. We do have a noise problem downtown. Mahnaz Miller—209 W. Market Street—They love the progress of Jeffersonville and the growth. The community loves so much of what takes place there, but please look at the appropriateness of the events. The Council followed up with discussion with Council Attorney Larry Wilder regarding options for the Noise Ordinance. Council Attorney Larry Wilder noted that in order to remain Constitutional, the ordinance has to be content neutral. City Attorney Les Merkley stated the City has an ordinance that is outdated and it should be looked at and revamped. A committee comprised of Councilperson Paris, Councilperson White, and Councilperson Gill. 2. Ed Zastawny/Ron Ellis—John Ashton-Dolly Parton "Imagination Library"—Tabled during approval of agenda. 3. Ed Zastawny/ Les Merkley—2019-R-7 Resolution Approving Statement of Benefits for Proposed Real Property& Personal Property Tax Abatement—City Attorney Les Merkley presented 2019-R-7. This comes with a favorable recommendation from Redevelopment. Paul Wheatley was present to represent the applicant. This is a retention project and the company will retain 26 positions and add an additional 4. Councilperson Samuel made a motion to APPROVE 2019-R-7 with Councilperson Gill seconding, PASSING on a vote, 8-0. 4. Les Merkley— PUBLIC HEARING 2019-OR-29 An Ordinance Amending the Jeffersonville Zoning Ordinance (2000-OR-61)Approving Updates to R1 and R3 Development Standards As Recommend in the Staff Report—Planning and Zoning's Chad Reischl presented 2019-OR-29. This comes with a favorable recommendation from Planning and Zoning. Councilperson Gill stated that during the Planning and Zoning meeting it was addressed that people can find their Zoning when they apply for the permits if they need clarification. Council President Zastawny opened the Public Hearing at 7:50 PM and as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Hawkins noted that he would be voting no due to the fact that in his neighborhood you would be able to build a structure close enough to the property line that you would need to go on someone else's property to maintain it. Councilperson Gill made a motion to APPROVE 2019-OR-29 with Councilperson Ellis seconding, PASSING on a vote, 6-2 with Councilperson Hawkins and Councilperson Zastawny voting against. 5. Les Merkley—PUBLIC HEARING 2019-OR-30 An Ordinance Changing the Zoning Map Designation of a Certain Tract of Property Located at 200 Willinger Lane and Fully Described in Attached Exhibit A From C2 to 12—City Attorney Les Merkley presented 2019-OR-30. This comes with a favorable recommendation. Scott Hannah present representing the applicant (603 North Shore Dr.). Councilperson Gill stated there were concerns regarding the bridge. Mr. Hannah stated they had spoken with the County and even though it is a one lane bridge it is rated for 20 tons and is structurally sound. Council President Zastawny opened the Public Hearing at 7:59 PM and as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Gill made a motion to APPROVE 2019- OR-30 with Councilperson Hawkins seconding, PASSING on a vote, 8-0. 6. Heather Metcalf—2019-OR-31 An Ordinance Transferring Certain Funds within the Same Department—City Controller Heather Metcalf presented 2019-OR-31. Councilperson Samuel made a motion to APPROVE 2019-OR-31 on the first and second reading with Councilperson Gill seconding, PASSING on a vote, 8-0. 7. Heather Metcalf—2019-OR-32 An Ordinance of Additional Appropriation (Public Hearing July 15,2019)—City Controller Heather Metcalf presented 2019-OR-32. This is appropriating cash that is already there. Councilperson Hawkins made a motion to APPROVE 2019-OR-32 on the first and second reading with Councilperson Maples seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against. REPORT OF THE COUNCIL ATTORNEY Nothing at this time. PUBLIC COMMENTS: Nothing at this time. DEPARTMENT HEAD REPORTS: Shawn Grant requesting permission to proceed with the change order for the new apparatus. Councilperson Hawkins made a motion to approve proceeding with placing the change order with Councilperson Gill seconding, PASSING on a vote, 8-0. COUNCIL COMMENTS: Councilperson White—Nothing at this time. Councilperson Paris—He will be out of town during the next Council Meeting for work. He invites everyone down to the Riverstage where his band will be playing. Councilperson Maples—He hopes everyone has a safe July 4th Holiday. We do have a new ordinance for fireworks, ignorance of the law is no excuse. Councilperson Gill—Thank you to Joe for helping go through the claims. She extends the offer to any Council who would like to assist with this.There was a meeting with Wastewater, JTL, and the Sewer Board as they presented the project. Clarksville has submitted a letter of support for this project. Councilperson Hawkins—He will be following up with the Redevelopment report. Chapel Lake Park is going to look fantastic. Happy 4th of July to everyone. Councilperson Ellis—At the next meeting he will have an update from JUEZ. Councilperson Samuel—He sent an email regarding the funding for homeless services. He would appreciate feedback on that. Council President Zastawny—Asked about a timeline for the corner of Charlestown Pike and Woehrle Road. City Attorney Merkley will follow up on that.
