HomeMy WebLinkAbout04-21-2003April 21, 2003 1 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA April 21, 2003 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:30 P.M. on April 21, 2003. Mayor Tom Galligan, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Anne Marie Galligan and Deputy Clerk Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Grooms gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were: Councilpersons Les Merkley, Ron Ellis, Rob Waiz, Barbara Wilson, and Ron Grooms. Absent: Councilpersons Denny Frantz and Vicki Conlin. Council President Waiz made the motion to approve the agenda as presented, seconded by Councilperson Merkley, passing unanimously. Mayor Galligan presented the minutes of the special meeting of March 29, 2003 for consideration by the Council. Councilperson Wilson made the motion to approve the minutes as presented, seconded by Council President Wa[z, passing unanimously. Councilperson Frantz arrived at 7:40 P.M. Clerk Treasurer Wilder presented the claim list for consideration by the Council. The claim for the barge rental was discussed. Councilperson Grooms explained the claims in the Police Department having to do with the ID project. Councilperson Grooms explained the project complimenting the tremendous project. Council President Waiz made the motion to approve the claims as presented, seconded by Councilparson Grooms, passing unanimously. PUBLIC COMMENT: Ms. Judy Sapp requests all to speak into the microphones. Ms. Sapp said she has had no reply to her verbal requests, nor have her phone calls been returned. Ms. Sapp then read a prepared statemem (attached). Mayor Galligan explained a letter was mailed to her today. April 21, 2003 2 AGENDA ITEMS: Councilperson Ellis has concerns for the placement of the recently installed emergency sirens. He questions who authorized the placement. Mrs. Campbell explained she is distressed and distraught about the placement of a siren close to her home. She has talked with Emergency Director Plummet. Mayor Galligan understands the sirens were mapped for distance to be heard. Mrs. Campbell was not notified of the siren. It is unsightly and too close to residents. She is also concerned for ear injury. She feels it would have been nice to have been informed prior to the installation. Mayor Galligan explained the City had nothing to do with these sirens. He will talk to Emergency Director Plummer. Mrs. Campbell is not opposed to having the system, she does not want it in her hackyard. Mayor Galligan didn't know when they were going in, he will look into the situation. Mr. Russell Martin said it would have been a courtesy to have notified the residents, Clerk Treasurer Wilder presented and explained Ordinance No. 2003-OR-18, An Ordinance Establishing A Fixed Asset Capitalization Policy. Clerk Treasurer Wilder would like this passed on the first reading and discussed further. Following discussion Councilperson Grooms made the motion to pass Ordinance No. 2003-OR48 on the first reading changing the amount from $1,000 to $250, second by Councilperson Merkley. Counoilperson Grooms voiced concerns about the time frame, the cost estimate and the funding. Mayor Galligan is working on this now and is getting estimates. The motion passed unanimously. COUNCIL AND MAYOR COMMENTS: Councilperson Ellis questioned the meeting scheduled for April 27, 2003, stating there are many conflicts. It was agreed to cancel the April 27, 2003 meeting. Councilperson Grooms feels the concept of the Saturday meetings is not a problem, it is the timing. There was discussion to change the second Monday meeting to a Saturday morning meeting. Councilperson Grooms made the motion to raschedule the first meeting in May from May 5, 2003 to May 12, 2003, second by Councilperson Merkley, passing unanimously. Mayor Galligan thanked all for coming. April 21, 2003 3 As there was no further business to come before the Council, the meeting was adjourned at 8:15 P.M. ATTEST: ~YOR PEGGY W~IS~R, CLERK AND TREASURER April21,2003 To: City Council Please be advised that on April 7, 2003 under the following Title II ADA provision I requested an assisted listening device from the ADA Coordinator, Cissy Ellis. (CFR 35.160 To ensure that communications with applicants, participants, and members of the public with disabilities are as effective as communications with others, including furnishing auxiliary aids and services when requested) To date I have not received a phone call to inform me that a device xvas not available and a accommodation could not be made, nor when I could expect a device to be available. This resulted and continues to result in a direct Title II ADA violation. Ms. Weiner with the Department of Justice herself called Ms. Galligan and explained that she was not a go between for the City of Jeffersonville and myself as she had assumed. She is merely the complaint investigator for my complaint. Today when I called to follow up for the last last time with the ADA Coordinator she advised that she was not allowed to speak to me at all and was to refer me to Ms. Galligan. I called Ms. Galligan and as expected, she did not return the call. An attempt to disallow me access to the ADA coordinator is considered resistance and is in violation Ms. Weiner advised.
