HomeMy WebLinkAbout2019-OR-9 STATE OF INDIANA BEFORE THE JEFFERSONVILLE COMMON COUNCIL ORDINANCE 2019-OR- q AN ORDINANCE AMENDING THE CITY OF JEFFERSONVILLE ZONING ORDINANCE (2000-OR-61) APPROVING UPDATES TO THE NC (NEIGHBORHOOD COMMERCIAL) DEVELOPMENT STANDARDS AND PERMITTED AND SPECIAL EXCEPTION USES AS RECOMMENDED BY THE PLAN COMMISSION Whereas, the City of Jeffersonville, Planning and Zoning Department filed a petition before the Jeffersonville Plan Commission to amend the City of Jeffersonville Zoning Ordinance (2000-OR-61) as recommended in the staff report(a copy of which is attached as Exhibit "A"); and, Whereas, on February 26, 2019 the Jeffersonville Plan Commission certified its favorable recommendation of the enactment of this proposed amendment to the Zoning Ordinance (2000-OR-61) by ordinance of this Common Council; and, Whereas, this matter is now before the Common Council at its regular meeting after certification of the proposed changes to the Zoning Ordinance pursuant to the provisions of I.C. 36-7-4-608(f)(1); and, Whereas, this Common Council has timely posted notice of its intent to consider the proposed change of comprehensive plan at the regular meeting scheduled for March 4,2019; and, Whereas, all interested persons having been given an opportunity to appear before this Common Council and be heard regarding this matter as required by law. Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that the City of Jeffersonville Zoning Ordinance(2000-OR-61) is hereby amended to update the Permitted Uses as follows: 1. To make updates to the NC (Neighborhood Commercial) Development Standards and Permitted and Special Exception Uses As recommended in the staff report (a copy of which is attached as Exhibit"A"). IT IS FURTHER ORDAINED that the City of Jeffersonville Zoning Ordinance (2000- OR-61) shall be amended to include such changes. ao/9-oR- 4 This ordinance shall be in full force and effect upon its adoption. '° STAFF REPORT D� m y, Department of Planning & Zoning -- Plan Commission Case Number: ZO-19-03 (Neighborhood Commercial "NC" Update) Petitioner: City of Jeffersonville, Planning &Zoning Department Requests: Zoning Ordinance Amendment Hearing Date: February 26, 2019 Proposed Changes to the Jeffersonville Zoning Ordinance 1 The Planning & Zoning Department has recommended the following amendment to the City of Jeffersonville Zoning Ordinance. The update includes: 1. To amend the District intent as highlighted in exhibit A 2. To amend the Permitted Uses to add uses as highlighted in exhibit A 3. To amend the NC District Development Standards as follows a. Change Minimum Side Yard Setback to 5 feet (originally 12 feet) b. Change Maximum Lot Coverage to 75% (originally 70%) Neighborhood Commerical (NC) Update The update will amend Article 4.5 and Article 4.6. The NC zoning district provides an opportunity for small-scale businesses in older parts of the city that are a size/scale that is somewhere between the high-densities of Downtown Commercial and the lower densities and/or larger-scales) of Cl & C2. While there are, currently, only about 20 properties in the City that are zoned NC, there are a number of great candidates for this zoning classification along Tenth Street from Meigs Ave to Main Street and along Spring Street in the Claysburg Neighborhood. These properties generally contain older homes on small lots that have been converted to businesses and do not conform to their existing zoning (either Cl or C2). The changes proposed here are intended to enhance the possibilities for existing properties that are currently zoned NC, but also provide an opportunity for property/business owners along Tenth and Spring (as noted above) to opt into a zoning category that more acurately conforms to the size and scale of their existing properties/businesses. Following passage of this amendment, it is our intention to ask business owners in these areas if they would like to rezone their properties without charge.
