OF JEFFERSONVILLE, INDIANA
MARCH 4, 2019
The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500
Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday, March 4, 2019.
Council President Ed Zastawny along with City Clerk Conlin called the meeting to order at 7:02 pm.
Councilperson Ellis gave the invocation. Council President Zastawny asked those in attendance to stand
and recite the Pledge of Allegiance.
ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson
Maples, Councilperson Hawkins, Councilperson Owen and Councilperson Ellis, Councilperson Samuel
and Council President Zastawny were present. Councilperson Jahn and Councilperson Gill were absent
from the proceedings.
MINUTES TO BE APPROVED:
February 19, 2019 Regular Proceedings—Councilperson Owen made a motion to APPROVE the minutes
with Councilperson Maples seconding, PASSING on a vote, 7-0.
APPROVAL OF THE AGENDA:
Councilperson Maples made a motion to APPROVE the agenda with Councilperson Owen seconding,
PASSING on a vote, 7-0.
CLAIMS TO BE APPROVED:
City Controller Heather Metcalf presented the General Claims. There is a hand carried claim for the
amount of$8906 and it is for AIM dues. We were short in this line item and had to transfer$372.39 out
of Special Projects. The new total is$1,212,222.84. Council President Zastawny asked if all claims were
in order. Controller Metcalf stated they are. Councilperson Samuel made a motion to APPROVE the
claims as changed with Councilperson Ellis seconding, PASSING on a vote, 8-0. (Councilperson Jahn
arrived at 7:06 PM during the presentation of the General Claims).
City Controller Heather Metcalf presented the Parks Claims list. Council President Zastawny asked if all
claims were in order. Controller Metcalf said they are. Councilperson Samuel made a motion to
APPROVE the claims as presented with Councilperson Ellis seconding, PASSING on a vote, 8-0.
REPORT OF THE CLERK:
Nothing at this time.
UNFINISHED BUSINESS:
1. Ed Zastawny/Sarah Green 2018-OR-67 An Ordinance Amending 2016-OR-11 Which Amends
2006-OR-14 Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous, and/or
Vicious Animals Within the City Limits—Tabled until May 2019 No Action Needed
2. Ed Zastawny-Les Merkley—2018-OR-77 An Ordinance Amending The Jeffersonville Zoning
Code (2000-OR-61) For Purposes of Establishing Regulations for Non-Commercial -Tabled until
May 2019 No Action Needed
3. Ed Zastawny-Heather Metcalf—2019-OR-5 An Ordinance Transferring Certain Funds within
the Same Department— City Controller Heather Metcalf presented 2019-OR-2. There have
been no changes since the last meeting. Councilperson Samuel asked if the last line transfer was
the fund for programs and activities. It is. Councilperson Samuel asked why they wouldn't
decrease the$68,000 by$30,000 as opposed to doing it this way. Councilperson Owen made a
motion to APPROVE 2019-OR-5 on the third and final reading with Councilperson Maples
seconding, PASSING on a vote, 7-1 with Councilperson Samuel voting against.
4. Ed Zastawny- Heather Metcalf—PUBLIC HEARING 2019-OR-6-City Controller Heather Metcalf
presented 2019-OR-6. There have been no changes since the last meeting. Council President
Zastawny opened the Public Hearing at 7:11 PM and as no members of the community came
forward to speak for or against the matter the Public Hearing was closed. Councilperson Owen
made a motion to APPROVE 2019-OR-6 on the third and final reading with Councilperson
Maples seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against.
5. Ed Zastawny- Heather Metcalf—PUBLIC HEARING 2019-OR-7 An Ordinance of Additional
Appropriations Public Hearing March 4, 2019 (Building Commissioner)—There have been no
changes since the last meeting. Council President Zastawny opened the Public Hearing at 7:12
PM and as no members of the community came forward to speak for or against the matter the
Public Hearing was closed. Councilperson Owen said he spoke with Controller Metcalf and the
Building Commissioners revenue brought in more than projected in 2018. Councilperson
Maples made a motion to APPROVE 2019-OR-7 on the third and final reading with
Councilperson Jahn seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against.
NEW BUSINESS:
1. Ed Zastawny/Les Merkley—PUBLIC HEARING 2019-OR-8 An Ordinance Changing the Zoning
Map Designation of a Certain Tract of Property Located at 1002 East 10th Street and Fully
Described in Attached Exhibit A from R3 to NC(ONE READING)-
This came with a favorable recommendation from Planning Commission. Council President
Zastawny opened the Public Hearing at 7:14 PM and as no members of the community came
forward to speak for or against the matter the Public Hearing was closed. Councilperson Samuel
made a motion to APPROVE 2019-OR-9 with Councilperson Jahn seconding, PASSING on a vote,
8-0.
2. Ed Zastawny—Heather Metcalf-2019-R-1 A Resolution Of The Common Council of the
Jeffersonville Authorizing The Investment of Public Funds—City Controller Heather Metcalf
presented 2019-R-1. This used to have to be renewed every two years but now it has be done
every year. Councilperson Owen made a motion to APPROVE 2019-R-1 with Councilperson
Maples seconding, PASSING on a vote, 7-0.
3. Ed Zastawny-Les Merkley—PUBLIC HEARING 2019-OR-9 An Ordinance Amending the City of
Jeffersonville Zoning Ordinance (2000-OR-61)Approving Updates to the NC(Neighborhood
Commercial) Development Standards and Permitted and Special Exception Uses as
Recommended by the Plan Commission (ONE READING) Revisions—Long Range Planner Chad
Reischl presented 2019-OR-9. Council President Zastawny asked the difference between
Downtown Commercial and Neighborhood Commercial and if anyone spoke against this matter
during the meeting. Nobody spoke against it and things such as pet care, contractor's offices,
small boutiques and apparel shops. It was discovered that the Attachment A that was provided
was incorrect and for a previous matter. Councilperson Owen discussed tabling the matter so
correct documentation could be provided. Council President Zastawny opened the Public
Hearing at 7:25 PM and as no members of the community came forward to speak for or against
the matter the Public Hearing was closed. Councilperson Samuel made a motion to TABLE 2019-
OR-9 with Councilperson Hawkins seconding, PASSING on a vote, 8-0.
4. Ed Zastawny-Heather Metcalf—Annual Report& Encumbrances—City Controller Heather
Metcalf presented the Annual Report and Encumbrances. These need to be accepted for the
record. Councilperson Owen made a motion to ACCEPT the Annual Report into the record with
Councilperson Jahn seconding, PASSING on a vote, 8-0.

Councilperson Jahn seconding, PASSING on a vote, 8-0.
5. Ed Zastawny-Heather Metcalf 2019-OR-10 An Ordinance Transferring Certain Funds within
the Same Department-This is to pay the stipend for the board members for the boards that
didn't receive a stipend last year. Councilperson Owen made a motion to APPROVE 2017-OR-10
on the first and second reading with Councilperson Jahn seconding, PASSING on a vote, 8-0.
6. Ed Zastawny- Heather Metcalf 2019-OR-11 An Ordinance of Additional Appropriations Public
Hearing March 4, 2019 (Public Hearing March 18, 2019)- City Controller Heather Metcalf
presented 2019-OR-11. Councilperson Owen made a motion to APPROVE 2019-OR-11 with
Councilperson Jahn seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against.
7. Ed Zastawny-Ed Zastawny—Appointment to Public Arts Commission—Council President
Zastawny said the new nomination for the appointment is Rosie Callahan. Ms. Callahan is a
retired school teacher and is involved in the performing arts. Councilperson Samuel made a
motion to APPOINT Rosie Callahan with Councilperson Jahn seconding, PASSING on a vote, 8-0.
DEPARTMENT HEAD REPORTS:
Nothing at this time.
REPORT OF THE COUNCIL ATTORNEY
Nothing at this time.
PUBLIC COMMENTS:
Nancy Eklund -1608 Flintlock Dr.—At the previous Council Meeting there was a discussion regarding the
Council's funding for JNLA and their National Night Out event. It was suggested that the Council should
pull their funding for JNLA because of insinuations that the organization was political in nature. She and
her husband, Richard have been active members ofJNLA since its inception 7 years ago in January of
2012 during Mayor Galligan last term in office. They attended the Jeffersonville Neighborhood Alliance
institute put forth by Clarence Hall. These classes gave the attendees insight into many of the City
departments, political parties, and volunteer opportunities. JNLI was promoted as a program that would
connect neighborhood leaders to local government and public entities to produce positive change in the
communities. JNLA strives to enhance the quality of life of all Jeffersonville residents by promoting
neighborhood improvements. Their largest event is National Night Out. The City Council funding is used
to secure items for this event. The aim of the National Night Out is to connect neighborhoods with their
leaders and safety personnel. Their meetings are always nonpartisan in nature.
COUNCIL COMMENTS:
Councilperson White—No comment.
Councilperson Jahn—Happy St. Patrick's Day.
Councilperson Maples—No comment.
Councilperson Hawkins—Congratulations to Jeffersonville High School for being sectional champs.
Councilperson Owen—He has been approached regarding his stipend for the Parks Authority. He is not
comfortable accepting compensation for serving on that board as he is an elected official and would like
to defer that compensation. It was discussed and they are able to defer compensation for board they
serve on. Additionally the numbers for health insurance are rising. He would like to revisit and discuss
HSA options for employees.
Councilperson Ellis—He agrees with Mr. Owen in that he does not want to accept compensation for
serving on boards. He received a phone call from Doug Drake PCS regarding a table being purchased for
their 60th anniversary event. Councilperson Owen made a motion to support the table with
Councilperson White seconding coming out of Special Projects, PASSING on a vote, 8-0.
Councilperson Samuel—There is an ordinance regarding specifications for a vehicle purchase. He would
like to make sure that is being enforced and if not if there is support talk about other options. He is not
comfortable having an ordinance in place if it is not being followed. Apologized for being absent last
meeting, his newest granddaughter was born
Council President Zastawny—They did buy a table for the Mainstreet Cookoff for tomorrow if they can
make it out to support that event.

Councilperson Owen made the motion to ADJOURN and the meeting adjourned at 7:57 P.M.
