HomeMy WebLinkAboutCC FEBRUARY 19, 2019 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA FEBRUARY 19, 2019 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Tuesday, February 19, 2019. Council President Ed Zastawny along with City Clerk Conlin called the meeting to order at 7:00 pm. Councilperson Ellis gave the invocation. Council President Zastawny asked those in attendance to stand and recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson Jahn, Councilperson Maples, Councilperson Hawkins, Councilperson Gill, Councilperson Owen and Councilperson Ellis, and Council President Zastawny were present. Councilperson Samuel was absent from the proceedings. MINUTES TO BE APPROVED: February 4, 2019 Regular Proceedings—Councilperson Ellis made a motion to APPROVE the minutes with Councilperson Hawkins seconding, PASSING on a vote, 8-0. APPROVAL OF THE AGENDA: Councilperson Owen made a motion to APPROVE the agenda with Councilperson Maples seconding, PASSING on a vote, 8-0. CLAIMS TO BE APPROVED: City Controller Heather Metcalf presented the General Claims. Councilperson Gill asked if all claims were in order. Controller Metcalf stated they are. Councilperson Owen made a motion to APPROVE the claims as changed with Councilperson Gill seconding, PASSING on a vote,8-0. City Controller Heather Metcalf presented the Parks Claims list. Councilperson Gill asked if all claims were in order. Controller Metcalf said they are. Councilperson Gill made a motion to APPROVE the claims as presented with Councilperson Hawkins seconding, PASSING on a vote,8-0. REPORT OF THE CLERK: Clerk Conlin reported today we received another bill for our Property and Casualty Ins for the Riverstage. The total for the year is$996,254. We are going to be about$36,000 short. We will have to do an appropriation in August. Workers Comp $540,000 is budgeted, but because of our Audit we may be short there as well. UNFINISHED BUSINESS: 1. Ed Zastawny/Sarah Green 2018-OR-67 An Ordinance Amending 2016-OR-11 Which Amends 2006-OR-14 Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous,and/or Vicious Animals Within the City Limits—Tabled until May 2019 No Action Needed 2. Ed Zastawny-Les Merkley—2018-OR-77 An Ordinance Amending The Jeffersonville Zoning Code (2000-OR-61) For Purposes of Establishing Regulations for Non-Commercial -Tabled until May 2019 No Action Needed 3. Ed Zastawny-Heather Metcalf—2019-OR-2 An Ordinance Transferring Certain Funds within the Same Department—City Controller Heather Metcalf presented 2019-OR-2. This was amended as requested to remove the Parks transfers. Councilperson Gill made a motion to APPROVE 2019-OR-2 on the third and final reading with Councilperson Owen seconding, PASSING on a vote, 8-0. 4. Ed Zastawny-Heather Metcalf—PUBLIC HEARING 2019-OR-3 An Ordinance of Additional Appropriation—City Controller Heather Metcalf presented 2019-OR-3. Again this was amended to remove the Parks matters. Council President Zastawny opened the Public Hearing at 7:07 PM and as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Gill made a motion to APPROVE 2019-OR-3 on the third and final reading with Councilperson Hawkins seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against. NEW BUSINESS: 1. Ed Zastawny/Les Merkley—PUBLIC HEARING 2019-OR-4 An Ordinance Amending the City of Jeffersonville Zoning Ordinance (2000-OR-61)To Amend The Permitted Uses In IS(Institutional Uses)and C2 (Medium to Large Scale General Commercial)To Allow Child Care Centers (Day Care)As Recommended By The Plan Commission—City Attorney Les Merkley presented 2019- OR-4. This comes with a favorable recommendation from the Planning Commission. This would allow Child Care Centers in with the Institutional Uses. Councilperson Jahn asked if this was randomly noticed of if an issue was discovered. City Attorney Merkley said he is unsure. Council President Zastawny opened the Public Hearing at 7:10 PM and as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Owen said he is unsure if Child Care Centers fit in with this use. Councilperson Gill made a motion to APPROVE 2109-OR-4 with Councilperson Jahn seconding, PASSING on a vote, 8-0. 2. Ed Zastawny—Heather Metcalf-2019-R-1 A Resolution Of The Common Council of the Jeffersonville Authorizing The Investment of Public Funds—City Controller Heather Metcalf presented 2019-R-1. This used to have to be renewed every two years but now it has be done every year. Councilperson Owen made a motion to APPROVE 2019-R-1 with Councilperson Maples seconding, PASSING on a vote, 7-0. 3. Ed Zastawny-Dawn Spyker—2019 Public Art Commission Plan (Unfurling)—Public Arts Administrator Dawn Spyker presented to the Council the different projects from 2018 and the upcoming projects. Ms. Spyker showed a video of the completed projects and noted that over half of the people in that video were volunteers. This year's theme is Unfurling. This year for Shakespeare in the Park the production will be Macbeth. Additionally it is a utility box year, meaning that 12-15 utility boxes will be painted. If a Councilperson has a box location they would like to be considered, please email her those recommendations. This year as opposed to having an artist go to the schools, the schools will be coming to the art center. It was recommended that the City have a long range plan, so Jack Becker will be coming to do that. He is retiring this year, but has made a commitment to come and do the City's long range plan. He is very excited about what is going on in Jeffersonville. Councilperson Maples asked about the Duke Energy Substation. That was initially approved for a project, however at the last minute they decided to revoke that approval. Redevelopment Director Rob Waiz has been working to gain approval for something there, but not sure how long that will take. Councilperson Jahn applauded Ms. Spyker for her work. Jeffersonville is blowing surrounding cities out of the water in this area and she appreciates all of her efforts. 4. Ed Zastawny-Heather Metcalf—2019-OR-OS An Ordinance Transferring Certain Funds within the Same Department—City Controller Heather Metcalf and Assistant Parks Director Amber Riddings were present to present and answer questions concerning 2019-OR-05. These are the transfers that were removed during the last Council Meeting to be discussed further with the Parks Department. Unfortunately Parks Director Paul Northam is at a conference and unable to attend the Council Meeting this evening. Councilperson Gill asked about the EDIT changes. There is a $68,000 decrease so that they could increase utilities. When the budget was completed last year,they did not have the true numbers for the remainder of the year. They underestimated what would be needed. Ms. Riddings said at this time they have put a hold on purchasing equipment so if this is not passed they will not be spending money that will be needed to transfer out the later part of the year. Councilperson White asked if the Green Team was operational with their current equipment. At this point they are but that changes day to day. Councilperson Ellis noted that at some point the Council is going to have to make a decision on how they are going to continue with transfers and additional appropriations and how funds will be spent. Councilperson White pointed out that if they are having these issues now, we are getting ready to add an additional park. We may want to look at energy saving options for that park such as solar panels so that we are not revisiting this issue when the park is completed. Councilperson Owen made a motion to APPROVE 2019-OR-05 on the first and second reading with Councilperson White seconding. A roll call was requested: Councilperson White: Yes Councilperson Jahn: Yes Councilperson Maples: Yes Councilperson Gill: No Councilperson Hawkins: Yes Council President Zastawny: Yes Councilperson Owen: Yes Councilperson Ellis: Yes Final vote, motion PASSED on vote, 7-1 with Councilperson Gill voting against. 5. Ed Zastawny-Heather Metcalf—2019-OR-6 An Ordinance of Additional Appropriation Public Hearing March 4,2019 (Parks)—Councilperson White asked how this effects Steamboat Days. Steamboat Days' budget was significantly higher than what was needed last year. Councilperson Owen made a motion to APPROVE 2019-OR-6 on the first and second reading with Councilperson Maples seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against. 6. Ed Zastawny- Heather Metcalf—2019-OR-7 An Ordinance of Additional Appropriations Public Hearing March 4, 2019(Building Commissioner)—City Controller Heather Metcalf along with Building Commissioner Larry Wallace were present to discuss 2019-OR-7 and answer any questions. Mr. Wallace stated this would be to purchase two new trucks for his department. Current trucks are constantly out getting worked on. One will be kept for a back-up. This price is to purchase and it was in his 5 year plan as well to get the new vehicles. These estimates are set up to include the lights needed. Councilperson Gill said recently when she was up in the office the employees were unable to go out as needed due to the unreliable vehicles. Councilperson Owen made a motion to APPROVE 2019-OR-7 on the first and second reading with Councilperson Gill seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against. DEPARTMENT HEAD REPORTS: Nothing at this time. REPORT OF THE COUNCIL ATTORNEY Mr. Wilder not present. PUBLIC COMMENTS: Nothing at this time. COUNCIL COMMENTS: Councilperson White—He missed the last meeting because his flight was delayed but he was informed there was some discussion about the tabling of the Animal Zone Amendment. There was concern by the commission about the amendment that was presented and so as a Commission they decided to table it until the April meeting. He wasn't here for the discussion but it was his understanding that his name was brought up. He was one of the many people who voted to table it to consider future amendments. Also he wanted to bring up that they give around $5000 to JNLA and it is his understanding that they use some of that for National Night Out and there seems to be an appearance of it being a political organization so he thinks they need to take a look at that and see if political activities are going on while they are receiving City funding or not so it is something he will be raising again after he asks some further questions. Councilperson Jahn—In regards to the transfers we are looking at they are having a 35% increase showing that our projections were pretty far skewed. Maybe the Council would like to explore more conservative estimates in the future. Additionally she met with Kim Calabro,to discuss professional training, continued to offer bimonthly. Councilperson Maples—Happy President's Day. Councilperson Gill—In regards to the National Night out donation, all of the receipts for National Night out is in the claims lists and it is provided to the Clerks Office and it shows that it is spent on tents, tables, etc. and is spent on National Night Out. The receipts show every bit of where that money is spent. Councilperson Hawkins—He attended a funeral for a former student this evening, Mr.Justin Coats. He always had a great nature and chose to see the best in things. The spirit he carried with him is something that everyone should carry with them. Also regarding the railroad crossings at Utica Sellersburg Rd. who do we contact about that? Mr. Merkley will contact the responsible individuals. Councilperson Owen—In the past the Engineering Department has worked with the Railroads to try and beef up those crossings so it would last longer. He received a letter from Julie Moorman at Community in Schools thanking them for their contribution and expressing a hope for continued commitments. Councilperson Owen entered the letter for the record. Councilperson Ellis—Thank you for the prayers and expressions of condolences on the loss of his brother. There is a car for sale that is blocking the view of the road at Spring Street and Smith Avenue. City Attorney Merkley will relay the information. Council President Zastawny—They thought they had a new appointment for the Public Arts however that is no longer going to work out. There will be a new name to consider next meeting.
