OF REAL ESTATE IN CLARK COUNTY,INDIANA THIS INDENTURE WITNESSETH,That Civil City of Jeffersonville,of Clark County,Indiana,together hereinafter called the Grantor,hereby grant and convey to Indiana Gas Company,Inc.,an Indiana corporation doing business as Vectren Energy Delivery of Indiana,Inc.,and its successors and assigns,together hereinafter called the Grantee, for one dollar ($1.00) and other valuable consideration, receipt of which is hereby acknowledged, an easement, right and privilege to construct and permanently (except as hereinafter provided) maintain, operate, use, repair, replace and remove above ground structures, gas metering houses, compressor stations,and regulator stations,together with regulators,chemical injectors,valves,gauges,pipe, fencing,and all other auxiliary equipment and appurtenances installed therein or attached thereto,or useful in connection with the operation thereof,upon and within the following described real estate located in the Illinois Grant Survey Number 20,Township 2 South,Range 7 East,Clark County,Indiana,and being more particularly described as follows,to- wit: A tract of land described as follows: All that part of the Grantor's land described as Permanent Easement(P.E.R.W.)on the attached Exhibit"A" and identified on the attached Exhibit"B"that lies within the Permanent Easement lines depicted on said Exhibit "B",together with any adjacent deed gaps or overlaps that lie within said Permanent Easement lines. Said Grantee shall have the further right to clear said parcel and keep it cleared of any brush or other obstructions which in their judgment might interfere with the efficient operation of said gas metering houses and regulator stations. The Grantor also hereby grants a temporary easement to the Grantee and the right and privilege to use,for initial construction purposes only, an additional strip of land Variable feet in width,parallel with and adjoining the above described strip as described as Temporary Workspace(T.W.S) on the attached Exhibit "A"and shown on the attached Exhibit"B". If said Grantee or its successors or assigns shall ever abandon the use of said parcel of real estate as and for such gas metering houses, compressor stations, and/or regulator stations, their rights hereby granted, except the right to remove from said parcel,within ninety days after such abandonment,all buildings,equipment and facilities of said Grantee or its successors or assigns,shall terminate. Any damage to the crops of the undersigned or of their heirs,assigns and tenants,caused by said Grantee, or its successors or assigns, during and after the original construction, shall be promptly paid by the Grantee, provided notice thereof,in writing is given to the Grantee at its Evansville office located at One Vectren Square, P.O.Box 209,Evansville,Indiana 47702-0209,or such place as the Grantee may designate,within thirty(30)days after the occurrence of such damage. The Grantor hereby covenants that they are the owner in fee simple of said real estate, and are lawfully seized thereof, and have good right to grant and convey the foregoing easement therein; and they guarantee the quiet possession thereof,that the said real estate is free from all encumbrances,and that the Grantor will warrant and defend the Grantee's title to the said easement against all lawful claims. These presents to be binding on the heirs, executors, administrators, grantee and assigns of the Grantor, and upon the Grantee,its successors or assigns. In accordance with Indiana Code; Grantor(s) acquired said real property under Deed placed of record at Instrument Number 201412769,in the Office of the Recorder of Clark County,Indiana.
