OF JEFFERSONVILLE, INDIANA
February 4, 2019
The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500
Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday, February 4, 2019.
Council President Lisa Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Mr.
Bobby Campbell gave the invocation. Council President Zastawny asked those in attendance to stand
and recite the Pledge of Allegiance.
ROLL CALL:The roll call was conducted and those present were: Councilperson Maples, Councilperson
Hawkins, Councilperson Gill, Councilperson Owen and Councilperson Ellis, Councilperson Samuel and
Council President Zastawny were present. Councilperson White and Councilperson Jahn were absent
from the proceedings.
MINUTES TO BE APPROVED:
January 22, 2019 Regular Proceedings—Councilperson Hawkins made a motion to APPROVE the minutes
with Councilperson Maples seconding, PASSING on a vote, 7-0.
APPROVAL OF THE AGENDA:
Councilperson Owen made a motion to APPROVE the agenda with Councilperson Hawkins seconding,
PASSING on a vote, 7-0.
CLAIMS TO BE APPROVED:
City Controller Heather Metcalf presented the General Claims. Councilperson Gill noted that there is a
duplicate claim in the amount of$165. The new total is$1,371,058.57. There is a transfer out of EDIT
for$500,000 for Sidewalks. Also under the fuel line there are three months of claims from last year.
These invoices were still going to the previous Vehicle Maintenance Director. Councilperson Gill made a
motion to APPROVE the claims as changed with Councilperson Hawkins seconding, PASSING on a vote,
7-0.
City Controller Heather Metcalf presented the Parks Claims list. Councilperson Gill asked if all claims
were in order. Controller Metcalf said they are. Councilperson Gill made a motion to APPROVE the
claims as presented with Councilperson Owens seconding, PASSING on a vote, 7-0.
REPORT OF THE CLERK:
Nothing at this time.
UNFINISHED BUSINESS:
1. Ed Zastawny/Sarah Green 2018-OR-67 An Ordinance Amending 2016-OR-11 Which Amends
2006-OR-14 Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous,and/or
Vicious Animals Within the City Limits
Passed on 1st and 2nd 10/15/18;TABLED 11/5/18;Tabled 11/19/18. Removed from Agenda
12/5/18 No Action to be taken until 2nd meeting in January 1/22/19,tabled until 2/4/19—City
Attorney Les Merkley presented 2018-OR-67. This has been with the planning commission, it
was originally proposed 2-3 months ago. This has been changed and is being proposed to deal
with non-commercial livestock. However the Planning Commission did not take any action.
They tabled the matter until April. Legally they have to make a recommendation to the Council,
but the law doesn't say in what time frame. Once you have a recommendation you will have 90
days to act. Council President Zastawny asked what happens if the planning commission doesn't
ever take action? City Attorney Merkley said they would have to address that then.
Councilperson Owen asked if there was a reason it was pushed back until April. Councilperson
Gill said Councilperson White said he needed time to talk to his constituents about the matter.
Councilperson Samuel asked if they were talking about number 10 or number 9.City Attorney
Merkley said they are intertwined.
City Attorney Merkley said the Administration needs to know if they have a way to deal with
these issues or not. Zoning code does not currently deal with this.
Councilperson Samuel asked it the Administration would like for the Council to regulate this?
City Attorney Merkley said yes, in one way or another.
City Attorney Merkley recommended removing and tabling until the meeting in May when there
should be a recommendation from the Planning Commission.
Public Comment:
Denise Hammond—21 Grandview Drive—She lives next door to potbelly pigs, 3 big ones, 5
babies and two kennels that you can hear them squealing. You cannot enjoy her yard. She feels
as though nothing is going to be done that that Council can do or the Mayor can do. She used to
have chickens and she went by the ordinance. She wants something done. Council President
Zastawny advised her that even if they pass this ordinance, it probably won't address her issue
because they will be grandfathered in. Councilperson Ellis asked if the health department do
something about it.
Councilperson Gill advised Ms. Hammond to get back in touch with April and see where things
stand with the Health Department.
Councilperson Owen made a motion to TABLE 2018-OR-67 and 2018-OR-77 with Councilperson
Samuel seconding, PASSING on a vote, 7-0.
2. Ed Zastawny-Les Merkley—2018-OR-77 An Ordinance Amending The Jeffersonville Zoning
Code (2000-OR-61) For Purposes of Establishing Regulations for Non-Commercial
Passed on 1st and 2nd 10/15/18;TABLED 11/5/18;Tabled 11/19/18. Removed from Agenda
12/5/18 No Action to be taken until 2nd meeting in January 1/22/19,tabled until 2/4/19—
Discussed with 2018-OR-67
NEW BUSINESS:
1. Ed Zastawny/Les Merkley 2019-OR-1 An Ordinance Changing the Zoning Map Designation of a
Certain Tract of Property Located at 4721 New Chapel Road FROM C2 TO C2-PD—City Attorney
Les Merkley presented 2019-OR-1. This is for Bridgepoint Commons and comes with a favorable
recommendation. Council President Zastawny opened the Public Hearing and as no members of
the community came forward to speak for or against the matter the Public Hearing was closed.
Councilperson Gill made a motion to APPROVE 2019-OR-1 with Councilperson Owen seconding,
PASSING on a vote, 7-0.
2. Ed Zastawny—Heather Metcalf-2019-R-1 A Resolution Of The Common Council of the
Jeffersonville Authorizing The Investment of Public Funds—City Controller Heather Metcalf
presented 2019-R-1. This used to have to be renewed every two years but now it has be done
every year. Councilperson Owen made a motion to APPROVE 2019-R-1 with Councilperson
Maples seconding, PASSING on a vote, 7-0.
3. Ed Zastawny- Heather Metcalf—2019-OR-2 An Ordinance Transferring Certain Funds within the
Same Department—Controller Heather Metcalf presented 2019-OR-2. The first section is all for
the performance increase pools for the directors. The next section is for the Parks Department.
They went through to make sure everything was where it needed to be. Everything that was
spent last year was moved to where it needed to be. The next two sections are to deal with the
directives from the State Board of Accounts. The next section is for the Sanitation workers to be
brought up pay wise as was directed per the Council Workshop. Councilperson Samuel said it
seems that they are taking dollars out of capital type expenditures, are they going to go for
similar or are they going for operational costs. Councilperson Samuel said he was concerned
because it seems like they always need to buy equipment and now they are transferring that
money out to the 209 Fund. Will those dollars pay for entertainment? It was discussed and
agreed the transfers for Parks would be removed from this Ordinance and Parks Director Paul
Northam will come to next meeting to discuss this need. Councilperson Gill said Mr. Northam
would need to be there and then she will vote against it. Councilperson Owen made a motion
to AMEND 2019-OR-2 to remove any Parks Transfers with Councilperson Gill seconding,
PASSING on a vote, 7-0. Councilperson Owen made a motion to APPROVE 2019-OR-2 as
amended on the first and second reading with Councilperson Gill seconding, PASSING on a vote,
7-0.
4. Ed Zastawny- Heather Metcalf—2019-OR-3 An Ordinance of Additional Appropriation—The
three first ones deal with the transfers. The EDIT transfer out for Public Arts is truing up the
number for the 4%. The transfer out for the Chapel Lake Park was discussed late December.
And also the sidewalk construction fund. She can separate these also. Councilperson Samuel
made a motion to AMEND to remove the top three with Councilperson Owen seconding,
PASSING on a vote, 7-0. Councilperson Samuel made a motion to APPROVE 2019-OR-3 on the
first and second reading with Councilperson Owen seconding, PASSING on a vote, 3-0.
5. Ed Zastawny-Council Board Appointments—Councilperson Gill made a motion to APPOINT
Richard Eklund to the Building Authority with Councilperson Maples seconding, PASSING on a
vote, 7-0. He will be replacing Brandon Westerfield.
Arts—Councilperson Zastawny said he would like to see Alonzo Rechmond be appointed. He
has a strong background in theater and lives in Jeffersonville. Councilperson Gill made a motion
to APPOINT Alonzo Rechmond to Public Arts with Councilperson Owen seconding, PASSING on a
vote, 7-0.
Finance Committee—Councilperson Samuel, Councilperson Ellis, and Councilperson Gill will
make up the finance committee.
DEPARTMENT HEAD REPORTS:
Nothing at this time.
REPORT OF THE COUNCIL ATTORNEY
Mr. Wilder not present.
PUBLIC COMMENTS:
Nothing at this time.
COUNCIL COMMENTS:
Councilperson White—Thank you to Councilperson Maples for saving a nearly 40 years old Jeffersonville
Building.
Councilperson Jahn—In regards to Martin Luther King Jr. Day she would like to read a quote: "Our lives
begin to end the day we become silent about things that matter". Our discussion earlier was pertinent
and meaningful and she applauds Judge Adams for bringing the matter to the different stakeholders.
Councilperson Maples—Thanks to the City workers for being out working in the cold temperatures. The
services did not stop at all due to the weather.
Councilperson Gill—She echoes what Councilperson Maples said. Also thanks to Chief Hederick for
offering the fire houses for employees to go in and warm up while out working. It is a City wide effort.
Also on Saturday February 23, 2019 there will be a JNLA event from 8:45-12:30. There will be a health
and wellness seminar. There will be a Narcan Training. This will be at Park Memorial Church.
Councilperson Hawkins—Nothing at this time.
Councilperson Owen—Nothing at this time.
Councilperson Ellis—Nothing at this time.
Councilperson Samuel—He appreciates the conversation that was had for the EDIT and Parks. He
appreciates Richard getting on a board, he goes to almost every meeting and now we can go to him and
encourage him to speak up on things.
Council President Zastawny—Next meeting will be on a Tuesday, 2/19/2019 at 6:00 PM. There will be a
workshop beforehand at 6:00 PM.

Councilperson Owen made the motion to ADJOURN and the meeting adjourned at 7:44 P.M.
