BOARD OF ZONING APPEALS
November 27,2018
Call to Order
Chairperson, Mike McCutcheon called the meeting of the Jeffersonville Board of Zoning Appeals to order
at 7:12 pm in Council Chambers, City Hall, 500 Quartermaster Court,Jeffersonville, Indiana.
Roll Call
The roll call was requested by Mr. McCutcheon,those members present were: Mike McCutcheon, David
Stinson, and Rodger Clarke. Members absent: Rita Fleming and Christopher Fox. Also present - Nathan Pruitt,
Planning & Zoning Director, Les Merkley, Planning & Zoning Attorney, Ashley Woolsey, Planning & Zoning
Coordinator and Peggy Hardaway, Secretary.
Approval of Minutes
Mr. Clarke made the motion to approve the October 30, 2018 Minutes, seconded by Mr. Stinson and
motion passes 3-0.
Approval of Findings of Fact
None
Oath
Les Merkley, City Attorney for the City of Jeffersonville administered the oath to all those intending to
provide testimony before the Board of Zoning Appeals.
Secretary's note: all plat maps, photos, etc. presented before the board of zoning appeals on this date can be
found in the office of planning and development.
Approval of the Docket
Mr. Stinson made the motion to approve the docket, seconded by Mr. Clarke and motion passes 3-0.

BZA-18-51
Tina Ellis filed an application requesting a variance from the development standards for property located
at 512 East Charlestown Avenue. The property is zoned R2 which is single family residential. The applicant is
requesting to allow a sunroom encroach into the 25 foot front setback. The sunroom will be located on the side
of house, but the subject property is a corner lot, and thus has two front yards.

• requested an 8' extension to her sunroom on Howell Avenue (dead end)
• No opposition from neighbors
Public comments: support—none; against- none
Letters/calls: letters included in staff report
Mr. Pruitt—correction to staff report-should read 17 feet from property line.

The Board of Zoning Appeals in the City of Jeffersonville having heard the application for variance
described above and all opposition from parties claim to be adversely affected there by does now enter the
findings:
1. The approval will not be injurious to the public health, safety, morals, and general welfare of
the community.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner.
3. The strict application of the terms of the Ordinance will result in a Practical Difficulty. This situation
shall not be self-imposed, nor be based on a perceived reduction of or restriction of economic gain.
Based on the finding described above the Board approves this application.
BZA-18-52
Chris Nolan on behalf of Pinnacle Properties Development Group filed an application requesting
variances from the development standards for property located at 3017 Middle Road.The property is zoned M2
which is multifamily residential. The proposed development is a 4,322 square-foot multifamily development for
a total of 8 new units.
Alan Applegate with Applegate Fifer and Pulliam on behalf of the applicant
• Approved waivers earlier this evening at the Plan Commission for setbacks and parking; and a
continuation of this rezoning of the property two years ago to allow this building.
• Allow 8 units in new building will remain similar to all the other building representing Amanda
Place; not only architecturally but internally
Public Comments: against—none; support—none.
