Comes now the City of Jeffersonville, Indiana, by the Corporation Counsel and Director of Affairs,
Leslie D. Merkley (hereinafter called "City") and comes now Zachary Stewart (hereinafter called "Attorney"),
and agree as follows:
1. Pursuant to I.C. 36-4-9-12 Attorney shall be retained as legal counsel for the Jeffersonville Fire
Merit Commission, effective January 1, 2019.
2. Attorney shall be an independent contractor and paid $125 per hour as total compensation.
Attorney shall submit monthly itemized invoices for services rendered. Attorney shall be responsible for all
costs and expenses associated with providing representation. This compensation shall include the costs of legal
staff, taxes and any other and all "over-head" that is commonly associated with the practice of law. The City
shall pay postage and court costs accrued by Attorney in the course of representation. Attorney shall be
responsible for maintaining his own legal malpractice insurance.
3. Attorney shall perform all work as assigned to him by the President of the Fire Merit
Commission and/or the City.
4. Attorney's duties and responsibilities shall be to represent the Jeffersonville Fire Merit
Commission including attendance at any Merit Commission meetings, advise and represent the commission and
city on any fire department hiring, promotional and disciplinary matters, research legal opinions, and draft legal
documents including policies, ordinances and resolutions as necessary or any other tasks as assigned by the
President of the Fire Merit Commission and/or the City.
5. This contract shall terminate at the i f either party upon written notice.
