COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
March 17, 2003
The Common Council of the City of Jeffersonville, Indiana met in regular session in the.
Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:30 P.M.
on March 17, 2003.
Mayor Tom Galligan, with Clerk Treasurer Peggy Wilder at the desk, called the meeting
to order. Also present were City Attorney Anne Made Galligan and Deputy Clerk Barbara
Hollis. Mayor Galligan welcomed all in attendance, asking all those present to stand as
Reverend'Larry Martin gave the invocation. Mayor Galligan then asked all those present to join
him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Les Merkley, Ron Ellis, Rob
Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin.
Absent: Councilperson Denny Frantz.
Mayor Galligan announced a rally to support our troops on Friday, March 21, 2003 at
noon.
Clerk Treasurer Wilder requested Ordinances 2003-OR-6, 2003-OR-7, 2003-OR-8, 2003-
OR-9, and 2003-OR-t0 be tabled. Councllperson Ellis requested Agenda Item No. 21 be
removed. Councilperson Merkley made the motion to approve the agenda as amended, second
by Councilperson Conlin, passing unanimously.
Mayor Galligan presented the minutes of the meeting of March 3, 2003 for consideration
by the Council. Councilperson Wilson made the motion to approve the March 3, 2003 minutes
as presented, seconded by Councilperson Merkley passing unanimously
Clerk Treasurer Wilder presented the claim list for consideration by the Council.
Councilperson Conlin asked that a claim for SIEDC dues be added to the claim list. Clerk
Treasurer Wilder asked that a claim tO Mike Love be added. Following a discussion regarding
the availability of funds, Council President Wait made the motion to table the claims until the
meeting scheduled for March 29, 2003, second by Councilperson Merkley passing unanimously.
Council President Waiz asked that Clerk Treasurer Wilder contact him if this will cause a
hardship on individual claims.

PUBLIC COMMENT:
Ms. Judy Saap announced she will be meeting with Mayor Galligan on March 25, 2003
regarding a 1992 complaint. She invites each Councilperson to attend.
AGENDA ITEMS:
Mayor Galligan said the Jeffersonvitle High School Lady Red Devils Baskett~all Team
had an excellent season wining sectionals. They have done a superior job representing our City
and been good ambassadors and represent good teamwork, Mayor Galligan presented each team
member with a certificate proclaiming each a Commodore of the Port as Councilperson Conlin
presented each with a flower. Mayor Galligan congratulated Coach Gilbert for being chosen
"Coach of the County". Councilperson Conlin then presented a plaque to Coach Gilbert and
Assistant Coach Maddox, saying what a joy they, and the team, have brought to the City and
how proud she was of them Councilperson Conlin thanked the Council for their role in the
presentation.
Ms. Lisa Thompson of New Directions Housing appeared before the council announcing
the upcoming l0th Repak Affair. She requests the continued support from the Council. The
program was reviewed. This year it will take place on June 14. Councilperson Ellis said one of
the biggest compliments, as a Councilperson, was to see the smile on the face of the lady whose
house he helped repair.
Mr. Greg Fitzlof[ Chamber President, appeared before the Council saying the County
Council will he considering the implementation of County income taxes and the impact they will
have on Cities and Towns. The County Council will make the decision that will impact all
entities. This will shift the financial burden away from those that most need relief. This will
mean several million dollars to Jeff City under some scenarios. This wilt allow the opportunity
to deal with growtl~ Mr. Fitzloff is here to encourage the Council to take this opportunity to set
the stage for all to work together for needs, specifically the jail. The biggest frustration with
budgets is when the best you can do is the minimum. It is in the best interest of all entities to
work together on this first project in a way of cooperation and in the best interest of all
taxpayers.
Mr. David Nachand, Attorney representing Mr. And Mrs. Gary French eppeared before
the Council to request passage of Ordinance No. 2003-OR-15, An Ordinance Granting Petition
To Vacate A Public Easement In The City Of Jeffersonville. Attorney Nachand explained the

need. Couneilperson Merldey made the motion to pass Ordinance No. 2003-OR-15 on the first
reading, second by Councilperson Grooms, passing unanimously.
Ordinance No. 2003-OR-11, An Ordinance Authorizing A Tax Anticipation Warrant For
The General Fund Of The City Of Jeffersonvilte, was presented for consideration. Clerk
Treasurer Wilder asked the Ordinance be amended to $9,200,000, along with the addition of one
sentence and the date of April 15 be filled in at the blank. Couneilperson Merkley made the
motion to amend Ordinance No. 2003-OR-11 as requested, second by Couneilperson Conlin,
passing on a vote of 5-1. Councilperson Ellis voted against passage. Couneilperson Merkley
then made the motion to pass Ordinance No. 2003-OR-11 on the second and third readings,
second by Councilperson Conlin passing on a vote of 5-1. Couneilperson Ellis voted against
passage.
Ordinance No. 2003-OR-12, An Ordinance Authorizing A Tax Antieipatiun Warrant For
The Park Fund Of The City Of Jeffersonville, was presented for consideration. Clerk Treasurer
Wilder asked the Ordinance be amended to $800,000, along with the addition of one sentence
and the date of April 15 be filled in at the blank. Councilperson Merkley made the motion to
amend Ordinance No. 2003-OR-12 be amended as requested, second by Council President Walz,
passing on a vote of 5-I. Couneilpersun Ellis voted against passage. Councilpersun Merkley
then made the motion to pass Ordinance No. 2003-OR-12 on the second and third readings,
second by Council President Waiz, passing on a vote of 5-1. Councilpersun Ellis voted against
passage.
City Attorney Galligan explained the area and the need for passage of Ordinance No.
2003-OR-16, An Ordinance Granting Petition to Vacate A Public Way In The City Of
Jeffersonville. As this was advertised as a public hearing, public comment was requested. As
there was no public comment, Couneilperson Merkley made the motion to pass Ordinance No.
2003~OR-16 on the first reading, second by Couneilperson Wilson. Counoilperson Grooms
expressed concern for this as it relates to the 10~ Street project. Attorney Galligan said this will
not be a problem. The motion to pass Grdinance 2003-OR-26 on the first reading passed
unanimously.
City Attorney Galligan next explained the area and the need for passage of Ordinance
No. 2003-OR-17, An Ordinance Granting Petition To Vacate A Public Way In The City Of
March 17, 2003 4
Jeffersonville. Councilperson Merldey made the motion to pass Ordinance No. 2003-OR-17 on
the first reading, second by Counciiperson Wilson, passing unanimously.
COUNCIL AND MAYOR COMMENTS:
Mayor Galligan reminded all of the rally to support our troops on Friday, March 21, 2003
at noom He would appreciate all that can he there.
As there was no further business to come before the Council, the meeting was adjourned
at 8:30 P.M.
