HomeMy WebLinkAboutCC DECEMBER 3, 2018 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA DECEMBER 3, 2018 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday, December 5, 2018. Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Mr. Bobby Campbell gave the invocation and asked for a moment of silence for those 3 individuals who lost their lives in the recent plane crash. Council President Gill asked those in attendance to stand and recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson Zastawny, Council Vice President Hawkins, Council President Gill, Councilperson Owen, Councilperson Ellis, and Councilperson Samuel. Councilperson Jahn and Councilperson Maples were absent from the proceedings. MINUTES TO BE APPROVED: November 19, 2018 Regular Proceedings—Councilperson Samuel made a motion to APPROVE the minutes with Councilperson Ellis seconding, PASSING on a vote, 7-0. APPROVAL OF THE AGENDA: Council President Gill advised that#9 under Unfinished Business would need to be removed. This matter will be addressed under New Business. Councilperson Hawkins made a motion to APPROVE the agenda with the noted changes, with Councilperson Samuel seconding, PASSING on a vote, 8-0. CLAIMS TO BE APPROVED: City Controller Heather Metcalf presented the General Claims list in the amount of$6,177,645.93. Council President Gill asked Controller Metcalf to review the large amount claims. 2.2 million is going towards the New Chapel Lake Fund. 1.5 million is going to the Health Insurance Fund. 750,000 will be going to the 8th Street Storm Separation Fund. 69,000 to the fuel fund. And another 750,000 going towards the 8th Street Storm Separation Fund. Councilperson Samuel asked if all claims were in order and Controller Metcalf stated they were. Councilperson Samuel made a motion to APPROVE the claims as presented with Councilperson Owen seconding, PASSING on a vote, 7-0. City Controller Heather Metcalf presented the Parks Claims list in the amount of$732,770.79. Council President Gill asked if all claims were in order. Controller Metcalf said they are. Councilperson Owen made a motion to APPROVE the claims as presented with Councilperson Ellis seconding, PASSING on a vote, 7-0. REPORT OF THE CLERK: Nothing at this time. UNFINISHED BUSINESS: 1. Lisa Gill/Sarah Green 2018-OR-67 an Ordinance Amending 2016-OR-11 Which Amends 2006- OR-14 Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous, and/or Vicious Animals Within the City Limits—REMOVED during approval of agenda. 2. Lisa Gill/ Les Merkley—2018-OR-73 An Ordinance Establishing a Non-Reverting Fund Called "Chapel Lake Park Non-Reverting Fund"—City Attorney Les Merkley presented 2018-OR-73. There have been no changes since the last reading. Councilperson Owen made a motion to APPROVE 2018-OR-73 on the third and final reading with Councilperson Samuel seconding, PASSING on a vote, 7-0. NEW BUSINESS: 1. Lisa Gill/Shaun Grant JFD—Shaun Grant from JFD was present to request an approval for an Equipment Purchase Order to come from the LOIT Fund in 2020. This will be for a new apparatus. The process needs to start now in order to be complete by the time it is needed to be purchased. The payment will begin in 2020 and in order to save the 3% increase that will happen we need to go ahead and start the process. Councilperson Owen commented that this apparatus will be turnkey ready. Councilperson Samuel confirmed that by doing this way there will not be any additional increase to what is being requested and Mr. Grant said that was correct. Councilperson Owen made a motion to APPROVE to start the process with Councilperson Hawkins seconding, PASSING on a vote, 7-0. 2. Lisa Gill/ Les Merkley—PUBLIC HEARING 2018-OR-74 An Ordinance Changing the Zoning Map Designation of a certain Tract of Property Located 4600 Charlestown Pike— City Attorney Les Merkley presented 2018-OR-74. This comes to the Council with a favorable recommendation with the written contingency that there will be no more than 4 houses per acre. The developer agreed it was not their intent or desire to develop more than 4 houses per acre. The developer is Greg Landerer and David Miller. Clerk Conlin requested a copy of the recommendation from the Planning Commission. Council President Gill opened the Public Hearing at 7:12 and as no members of the community came forward to speak for or against the matter the Public Hearing was closed at 7:13 PM. Councilperson Hawkins made a motion to APPROVE 2018-OR-74 with the contingency that there is no more houses than 4 per acre with Councilperson Owen seconding. Councilperson White said he is not in favor of the contingency but seeing as the developers intent was consistent with that he would be voting for this matter. Final vote, motion PASSED, 7-0. 3. Lisa Gill/Sarah Green—Interlocal Cooperation Agreement for the Joint Use and Operation of the Jeffersonville-Clark County Animal Shelter—City Attorney Les Merkley presented the Interlocal Cooperation Agreement for the Animal Shelter. Our current agreement has expired, this has no changes from the last agreement it simply reinstates it. Councilperson Samuel asked if we should look at updating the costs. That decision would be something that Animal Shelter Director Sarah Green would need to look at. At this time, it is being proposed that the rates remain the same. Councilperson Ellis said with the talk of a new Animal Shelter being needed, should we look at these entities assisting in that matter? At this time Redevelopment is going to be paying for that. Councilperson Samuel made a motion to APPROVE 2018-R-12 with Councilperson Zastawny seconding, PASSING on a vote, 7-0. 4. Lisa Gill/Sarah Green—2018-R-12 A Resolution Approving And Ratifying Interlocal Cooperation Agreement For the Joint Use And Operation of the Jeffersonville-Clark County Animal Shelter—Combined with matter 4 under New Business. 5. Lisa Gill/ Heather Metcalf-Public Hearing 2018-OR-75 An Ordinance of Additional Appropriation—City Attorney Les Merkley presented 2018-OR-75. This is for land acquisition and they would like for it to be considered for the rules to be suspended and approved on all three readings tonight. Council President Gill opened the Public Hearing at 7:18 and as no members of the community came forward to speak for or against the matter the Public Hearing was closed at 7:19 PM. Councilperson Zastawny made a motion to suspend the rules in anticipation that this will pass on all three readings with Councilperson Hawkins seconding, PASSING on a vote, 7-0. Councilperson Zastawny made a motion to APPROVE 2018-OR-75 on all three readings with Councilperson Ellis seconding, PASSING on a vote 7-0. Councilperson Zastawny made a motion for the claim to be processed with Councilperson Hawkins seconding, PASSING on a vote, 7-0. 6. Lisa Gill/ Heather Metcalf—2108-OR-76-An Ordinance of Additional Appropriation PUBLIC HEARING DECEMBER 17, 2018—City Controller Heather Metcalf presented 2018-OR-76. This will have a Public Hearing at the next meeting. Councilperson Owen made a motion to APPROVE 2018-OR-76 with Councilperson Hawkins seconding, PASSING on a vote, 6-1 with Councilperson White voting against. 7. Lisa Gill/Les Merkley—2018-OR-77 An Ordinance Amending The Jeffersonville Zoning Code (2000-OR-61) For Purposes of Establishing Regulations for Non-Commercial Livestock-City Attorney Les Merkley presented 2018-OR-77. The earlier ordinance was removed from the table due to after researching the matter it seems that other municipalities address this issue in the Zoning Code. This used to be addressed in the Zoning Code before it was moved to Animal Control. This will need to be referred to the Planning Commission for approval and then it will come back to the Council for final approval. Councilperson Samuel made a motion to REFER to the Planning Commission with Councilperson Hawkins seconding, PASSING on a vote, 6-1 with Councilperson White voting against. 8. Lisa Gill/Les Merkley—2018-OR-78 An Ordinance Transferring Dormant Funds—City Attorney Les Merkley presented 2018-OR-78. These will be transferred to the rainy day fund or the General Fund and is just cleaning up miscellaneous funds. The departments do know about this. Councilperson Owen made a motion to APPROVE with Councilperson Hawkins seconding, PASSING on vote, 7-0. DEPARTMENT HEAD REPORTS: Heather Metcalf—During the Audit it was discovered that a mistake was made in 2006 for the Fire Department Pensions. This builds year to year. Per SBOA the City had to work to recollect the funds that were paid out in error, however 4 individuals had unfortunately passed away and the amount of$2266 cannot be paid back.This will be a onetime transfer. Councilperson Owen asked if there was no way that those funds could have been covered since it was not the mistake of the pensioner. According to SBOA this was what was needed to be done. Councilperson Owen made a motion to APPROVE with Councilperson Hawkins seconding, PASSING on a vote, 7-0. REPORT OF THE COUNCIL ATTORNEY Nothing at this time. PUBLIC COMMENTS: Nothing at this time. COUNCIL COMMENTS: Councilperson White—Happy Hanukah. Councilperson Zastawny—Nothing at this time. Councilperson Hawkins—He was very pleased with the announcement of Jeffersonville Promise and the feedback has been quite positive. This is not a charity. It is looked at as an investment for the community. This is one of the best things he has been a part of. Of course it isn't perfect but it is a fantastic step in the right direction. Councilperson Owen—In regards to Jeffersonville Promise, something similar was done in Kalamazoo Michigan and they had a 4.5 times return on investment. There is no ongoing commitment for this. Councilperson Ellis—Nothing at this time. Councilperson Samuel—He would like to reiterate the tragic loss to our community with the recent plane crash. The impact for our City will continue to be felt. Council President Gill—Council President Gill thanked Bobby Campbell from providing invocation for the meetings.
