HomeMy WebLinkAboutCC NOVEMBER 5, 2018 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA November 5, 2018 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday, November 5, 2018. Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Mr. Bobby Campbell gave the Invocation and advised that former Councilperson Andrew Williams had passed away and asked for a moment of silence. Council President Gill asked those in attendance to stand and recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson Zastawny, Councilperson Jahn, Councilperson Maples, Council Vice President Hawkins, Council President Gill, Councilperson Owen,Councilperson Ellis, and Councilperson Samuel. MINUTES TO BE APPROVED: October 15, 2018 Regular Proceedings—Councilperson Zastawny made a motion to APPROVE the minutes with Councilperson Maples seconding, PASSING on a vote, 9-0. APPROVAL OF THE AGENDA: Council President Gill advised that#9 under Unfinished Business would need to be tabled. Councilperson Zastawny made a motion to APPROVE the agenda with the noted changes, with Councilperson Samuel seconding, PASSING on a vote, 9-0. CLAIMS TO BE APPROVED: City Controller Heather Metcalf presented the General Claims list in the amount of$953,223.53. Council President Gill asked if everything will be signed. Controller Metcalf said yes. Council President Gill asked if all claims were in order. Controller Metcalf said they are. Councilperson Zastawny made a motion to APPROVE the claims as presented with Councilperson Ellis seconding, PASSING on a vote, 9-0. City Controller Heather Metcalf presented the Parks Claims list in the amount of$107,188.82. Council President Gill asked if all claims were in order. Controller Metcalf said they are. Councilperson Zastawny made a motion to APPROVE the claims as presented with Councilperson Hawkins seconding, PASSING on a vote, 9-0. REPORT OF THE CLERK: Clerk Conlin thanked Mr. Campbell for informing them of the passing of Andrew Williams. She and Councilperson Ellis served with Andrew. He was a gentleman and it saddens her that the community has lost him. UNFINISHED BUSINESS: 1. Lisa Gill/Sarah Green 2018-OR-67 An Ordinance Amending 2016-OR-11 Which Amends 2006- OR-14 Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous, and/or Vicious Animals Within the City Limits—TABLED during approval of agenda. 2. Lisa Gill/ Heather Metcalf—2018-OR-68 An Ordinance Transferring Certain Items within the Same Budget—City Controller Heather Metcalf presented 2018-OR-68. There have been no changes. Councilperson Zastawny made a motion to APPROVE on the third and final with Councilperson Hawkins seconding, PASSING on a vote, 9-0. 3. Lisa Gill/Heather Metcalf-PUBLIC HEARING 2018-OR-69 An Ordinance of Additional Appropriation—City Controller Heather Metcalf presented 2018-OR-69. There have been no changes. Council President Gill opened the Public Hearing at 7:07 PM and seeing as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Zastawny made a motion to APPROVE 2018-OR-69 on the third and final with Councilperson Owen seconding, PASSING on a vote, 9-0. NEW BUSINESS: 1. Lisa Gill/ Lisa Gill -Discussion on Interlocal Agreement with Clark County Government— Council President Gill asked Council Attorney Wilder for an update. Mr. Wilder advised the Interlocal agreement was passed, however it was not signed. The County also passed their budgets and not everything that needed to be signed that night was signed. Their attorney has it and it will be signed. 2. Lisa Gill/Les Merkley-2018-OR-70 Correction to Ordinance 2014-OR-6—City Attorney Les Merkley presented 2018-OR-70. This amends 2014-OR-6 and gives us a little more flexibility regarding the flood control ordinance to reflect the structures on the National Registries and State Registry. Councilperson Owen made a motion to APPROVE 2018-OR-70 on the first and second reading with Councilperson Zastawny seconding, PASSING on a vote, 9-0. 3. Lisa Gill/Heather Metcalf—2018-OR-71 An Ordinance Transferring Certain Items within the Same Budget—City Controller Heather Metcalf presented 2018-OR-71. This is for end of the year transfers. Hopefully there will not be too many more. Councilperson Owen made a motion to APPROVE 2018-OR-71 with Councilperson Maples seconding, PASSING on a vote, 9-0. 4. Lisa Gill/ Heather Metcalf—2018-OR-72 An Ordinance of Additional Appropriation Public Hearing November 19, 2018-City Controller Heather Metcalf presented 2018-OR-72. There have been more unforeseen demolitions. Council President Gill said she spoke with the department who verified the need for this. Councilperson Owen made a motion to APPROVE 2018-OR-72 on the first and second reading with Councilperson Zastawny seconding, PASSING on a vote, 9-0. DEPARTMENT HEAD REPORTS: Deputy Chief Bruce DeArk for the Fire Department was present. They have 3 retiring in early January. They would like permission to go ahead and begin the hiring process. They have the money in their budget. This would help to prevent the overtime. Councilperson Maples made a motion to APPROVE with Councilperson Owen seconding, PASSING on a vote, 9-0 REPORT OF THE COUNCIL ATTORNEY Nothing at this time. PUBLIC COMMENTS: Deborah McMann—835 Spring Street—Concern just recently the City took 12 parking spaces for the new tree walk. Concerned about that because Parking is limited there. Also she would like a decent crosswalk for Spring and 8th street. It is very busy there. Les Merkley said that MFine didn't own that. Councilperson Owen said the City is planning on making improvements there. Councilperson Samuel asked if the City reach out the TARC to see if they can change the pick up to the other side of the road. Councilperson White said the Tree walk just goes to Maple street so it wasn't due to the Tree Walk. Carla Poe—835 Spring Street—Also concerned about parking. Also about the flooding. It has flooded twice. Her car was totaled in the parking lot. The drainage there is awful. It was like a river. Would like to know if there is any plans to rectify it. Council President Gill asked if she had talked to City Engineer Andy Crouch about these concerns and she has not. COUNCIL COMMENTS: Councilperson White—He has spoken with Chief Hedrick and Joe Hurt regarding the Council Fire Merit Commission appointment and he would like to remove their current appointment and appoint Sam Smith, replacing Jeff Frye. Councilperson White makes a motion to remove Jeff Fry and appoint Sam Smith with Councilperson Maples seconding. Councilperson Hawkins advised he will vote no, he has a lot of questions and at this time he doesn't even know what they are. Councilperson Zastawny agrees, he would like to see it on the agenda so some research can be done on it. Councilperson Ellis would like to know who he is before he votes on the issue. Joe Hurt came forward to speak on the matter. There has been some concern from a lot of the Firefighters. He is a great prospect. When he expressed interest in the past they we needed minority representation on the board. Now would be a good time to bring in a breath of fresh air. A roll call was requested. Councilperson White -Yes Councilperson Zastawny- No Councilperson Jahn -Yes Councilperson Maples-Yes Councilperson Hawkins- No Councilperson Owen --Ne- Yes Councilperson Samuel- No Councilperson Ellis- No Council President Gill—Yes Final Vote, 5-4. Councilperson Zastawny—Make sure to get out and vote. Councilperson Jahn—Echoes that, make sure to vote. Councilperson Maples—Just wanted to acknowledge Officer Moreland, for the month of November Law Enforcement Officers can pay to have facial hair, proceeds go to Shop with a Cop. Councilperson Hawkins—Go vote. Councilperson Owen—Just wanted to call attention to the spreadsheet that Heather gave us the master bank list. $496,293.61-that number represents the interest-what we have earned based on the finance department and how they have invested the funds. Councilperson Ellis—He would like to echo Bobby Campbell. He served with Andrew and was good friends with him for a long time. He is a great loss to the community. Keep his family in your prayers. Good luck to Councilperson Owen. Councilperson Samuel—Next meeting City Engineer Andy Crouch will be on the Agenda. Council President Gill—Make sure to get out and vote, there will be no trash pickup tomorrow. ADJOURNMENT: Councilperson Owen made the motion to ADJOURN and the meeting adjourned at 7:36 P.M.
