HomeMy WebLinkAboutCC OCTOBER 15, 2018 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA October 15, 2018 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday, October 15, 2018. Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Mr. Bobby Campbell gave the Invocation and Council President Gill asked those in attendance to stand and recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson Zastawny, Councilperson Maples, Council Vice President Hawkins, Council President Gill, Councilperson Owen, Councilperson Ellis, and Councilperson Samuel. Councilperson Jahn was absent from the proceedings and Councilperson White arrived during the Report of the Clerk. MINUTES TO BE APPROVED: October 1, 2018 Regular Proceedings—Councilperson Samuel made a motion to APPROVE the minutes with Councilperson Ellis seconding, PASSING on a vote, 7-0. APPROVAL OF THE AGENDA: Councilperson Owen made a motion to APPROVE the agenda as presented, with Councilperson Zastawny seconding, PASSING on a vote, 7-0. CLAIMS TO BE APPROVED: City Controller Heather Metcalf presented the General Claims list in the amount of$3,075,167.96. Council President Gill reminded that 2 million of this is being transferred for the Health Insurance Fund. Council President Gill asked if all claims were in order. Controller Metcalf said they are. Council President Gill asked if the Credit Cards are getting better and Controller Metcalf stated yes. Councilperson Ellis made a motion to APPROVE the claims as presented with Councilperson Samuel seconding, PASSING on a vote, 7-0. City Controller Heather Metcalf presented the Parks Claims list in the amount of$99,625.35. Council President Gill asked if all claims were in order. Controller Metcalf said they are. Councilperson Zastawny made a motion to APPROVE the claims as presented with Councilperson Hawkins seconding, PASSING on a vote, 7-0. REPORT OF THE CLERK: Councilperson Hawkins said he is having difficulty pulling ordinances as it says they are out of licenses. Clerk Conlin said to notify her when that happens and she will remove someone. Sometimes people get on the website and never exit out of it. Councilperson White arrived to the proceedings at 7:05 pm. UNFINISHED BUSINESS: 1. Lisa Gill/Kim Calabro-2018-OR-64 An Ordinance Amending 2018-OR-23 An Ordinance Fixing the Salaries of Appointed Officers and Employees for All Departments of the City of Jeffersonville, Clark County, Indiana,for the Year 2019—Human Resources Director presented 2018-OR-64. The only changes were the ones requested last meeting. The ordinance now identifies how many positions as requested and the changes for the board meeting pay was added. Councilperson Owen made a motion to APPROVE 2018-OR-64 with Councilperson White seconding, PASSING on a vote, 8-0. 2. Lisa Gill/ Heather Metcalf—2018-OR-65 An Ordinance Transferring Certain Funds within the Same Department—Controller Metcalf presented 2018-OR-65. There have been no changes since the last meeting. Councilperson Zastawny made a motion to APPROVE 2018-OR-65 on the third and final reading with Councilperson Hawkins seconding, PASSING on a vote, 8-0. 3. Lisa Gill/Heather Metcalf—PUBLIC HEARTING 2018-OR-66 An Ordinance of Additional Appropriation—City Controller Heather Metcalf presented 2018-OR-66. There have been no changes since the last meeting. Council President Gill opened the Public Hearing at 7:08 PM. As no members of the community came forward to speak for or against the matter and the Public Hearing was closed. Councilperson Zastawny made a motion to APPROVE 2018-OR-66 on the third and final reading with Councilperson Maples seconding, PASSING on a vote, 7-1 with Councilperson Ellis voting against. NEW BUSINESS: 1. Lisa Gill/Sarah Green 2018-OR-67 An Ordinance Amending 2016-OR-11 Which Amends 2006- OR-14 Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous, and/or Vicious Animals Within the City Limits—Sarah Green presented 2018-OR-67. This was brought before the Council in June of 2017 and there was not the support needed for it. Now it is becoming an issue so she is bringing it back before the Council for reconsideration. This ordinance is proposing banning livestock and putting restrictions on chickens in the City. It will allow 5 chickens for every 1 acre lot. Those properties that already have them will be grandfathered in. Councilperson Maples expressed that he is not in support of limiting ducks and chickens. In his district there are properties that are appropriate for these animals and even though he is being told that those will not be the focus he is not in agreeance of passing an ordinance with the intention of it not being followed. Mrs. Green said this does not affect those properties zoned agricultural and for the remainder she would like to see them apply for a variance if needed. Councilperson Owen left prior to the discussion of 2018-OR-67 being finished (7:12PM). Mayor Moore came forward and said that he understands Councilperson Maples concerns however he would like to see some sort of compromise. There is an issue on Grandview that presented itself last week where there are pigs. If we continue to build the nice houses and develop the area, people moving to Jeffersonville are going to think they are protected from this sort of thing. Councilperson Maples said he would like to see ducks and pigeons and geese striked through. Councilperson Hawkins said that two of the three changes are agreed to and confirmed that pigs are considered livestock. It was recommended to pass the Ordinance with the understanding that there would be further discussion and changed. Councilperson Samuel made a motion to APPROVE 2018-OR-67 on the first and second reading with Councilperson Hawkins seconding, PASSING on a vote, 6-1 with Councilperson Maples voting against. 2. Lisa Gill/Heather Metcalf—2018-OR-68 An Ordinance Transferring Certain Items within the Same Budget—City Controller Heather Metcalf presented 2018-OR-68. This is a transfer for HR and the Mayor for supplies. Councilperson Samuel made a motion to APPROVE 2018-OR-68 on the first and second reading with Councilperson Ellis seconding, PASSING on a vote, 7-0. 3. Lisa Gill/ Heather Metcalf—2018-OR-69 An Ordinance of Additional Appropriation—City Controller Heather Metcalf presented 2018-OR-69. Councilperson Samuel gave a brief overview, this fund is specifically for situations like this and there was no way to prepare for it during budget time last year because it was an unknown needed expense. Councilperson Samuel made a motion to APPROVE 2018-OR-69 on the first and second reading with Councilperson Hawkins seconding, PASSING on a vote, 7-0. DEPARTMENT HEAD REPORTS: None at this time. REPORT OF THE COUNCIL ATTORNEY Council Attorney Larry Wilder recommended that an email be started with proposed changes for 2018- OR-67. PUBLIC COMMENTS: Nothing at this time. COUNCIL COMMENTS: Councilperson White—Nothing at this time. Councilperson Zastawny—The Council is invited to the Clark County Airport Ribbon Cutting on October 24, 2018. Councilperson Maples—The first annual Great Bowls of Chili Cookoff will be on October 26 from 6-10 PM. This will benefit Crusade for Children. Also regarding the Animal Ordinance, he doesn't want to be difficult but he feels it is necessary to develop ordinances that encompass the whole City. Councilperson Owen—Left proceedings during 2018-OR-67. Councilperson Hawkins—His thoughts go out to the Patel family for the tragic incident that recently occurred. Also he was forwarded info concerning a resident looking into where the young man was struck by a vehicle to see if there was a light faulty. Council President Gill said that all of the street lights were working. Councilperson Ellis—Nothing at this time. Councilperson Samuel—It is good to see Steve Webb present. Mr. Samuel recently welcomed his fourth grandchild this past Wednesday. Council President Gill—Her daughter got married this past weekend. Trick or treat downtown is Monday from 6-8 and trick or treat is recognized for the City on Wednesday 10/31 from 6-9 pm. Also just a reminder about the Special Meeting on October 24, 2018.
