PERFORMANCE AGREEMENT
THIS AGREEMENT is entered into this 25th day of_July 2018,by and between_Appalatin_("Performance Group")and the City of Jeffersonville
("Buyer").
1. PERFORMANCE GROUP'S SERVICES:Performance Group shall provide the Buyer a Performance to the best of their ability under the
following terms:
a. Place of Performance: Big Four Station,Jeffersonville,IN
b. Date of performances: October 27`h,2018
CHECK IN- TBD
ARRIVE AT STAGE -TBD
TIME OF PERFORMANCE- TBD
Performers(please list all performers): Steve Sizemore,Yani Vozos,Marlon Obando,Luis De Leon,Jose Greta,Fernando Moya
Z. PERFORMANCE FEE:Buyer shall pay Performance Group a fee of$1500 paid as follows:
a. Deposit of NA upon execution of this Agreement.
b. The balance of$1500 immediately following the Performance.
c. Payments in cash or check made out to"Appalatin"
d. Deposit payment to be mailed to(ADDRESS): NA
3. PERFORMANCE REQUIREMENTS:Buyer must provide Performance Group with the following:
a. A secure stage/performance area with minimum dimensions of 16'x20'at Big Four Pavilion.
b. An adequate sound system.
c. Bottled waters for the performers.
d. Changing location at Big Four Pavilion.
4. PROMOTION:Buyer and Performance Group shall assist with promotion of the Performances.
a. Performance Group is asked provide website,photos,videos and materials to use for promoting events no later than September 1,
2018 for Buyer to promote events.
b. Performance Group agrees to announce Sugar Skull Shake Shake on its web page,and through its social media where applicable.
5. INSURANCE:Buyer warrants and represents that it has,or shall obtain,sufficient personal injury and property damage liability insurance with
respect to the activities of the Performance Group at the Place of Performance.
6. CANCELLATION:If Buyer cancels the Performance less than 7 days before the Date of Performance,Buyer shall forfeit the provision of vending
space for the Performance Group.If Performance Group fails to present at the specified time or cancels less than 24 hours before Time of
Performance,Buyer is authorized to make other performance agreements as desired and the Performance Group agrees to compensate the
Buyer in the amount of$200 for promotional costs.The obligation of the Performance Group to perform shall be excused by detention of
personnel by sickness,accidents,riots,strikes,epidemics,Acts of God,Force Majeure or any other legitimate condition beyond the control of
the Performance Group.
7. MERCHANDISE:Performance Group shall,at its option,sell promotional material at the Performance,retaining all proceeds associated
therewith.
8. ENTIRE AGREEMENT:This Agreement shall be construed in accordance with the laws of the Commonwealth of Kentucky and its validity,
construction,interpretation and legal effect shall be governed by the laws of the Commonwealth of Kentucky.This Agreement sets forth the
entire agreement between the parties with respect to the subject matter hereof. No modification,amendment,waiver,termination or
discharge of this Agreement,shall be binding upon either party unless confirmed by a written instrument signed by either party or their agent.
