OF JEFFERSONVILLE, INDIANA
SEPTEMBER 4, 2018
The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500
Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Tuesday, September 4, 2018.
Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Mr. Bobby
Campbell gave the Invocation and Council President Gill asked those in attendance to stand and recite
the Pledge of Allegiance.
ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson
Zastawny, Councilperson Jahn, Councilperson Maples, Councilperson Hawkins, Council President Gill,
Councilperson Owen, Councilperson Ellis, and Councilperson Samuel.
MINUTES TO BE APPROVED:
August 20, 2018 Regular Proceedings—Councilperson Zastawny made a motion to APPROVE the minutes
from the August 20, 2018 regular proceedings with Councilperson Samuel seconding, PASSING on a
vote, 9-0.
APPROVAL OF THE AGENDA:
Councilperson Owen made a motion to APPROVE the agenda with Councilperson Maples seconding,
PASSING on a vote, 9-0.
CLAIMS TO BE APPROVED:
Assistant Controller Yvonne Dowd presented the General Claims in the amount of$249,984.47. Council
President Gill asked if all claims were in order and Ms. Dowd responded they were. Council President
Gill asked that Ms. Dowd check on a claim on page 6 in the amount of$2898. She thought the last
payment was supposed to be the end of that. Ms. Dowd will check on that. Councilperson Zastawny
made a motion to APPROVE the claims with Councilperson Jahn seconding, PASSING on a vote, 9-0.
Assistant Controller Yvonne Dowd presented the Parks Claims in the amount of$82,819.46. Council
President Gill asked if all claims were in order and Ms. Dowd responded they were. Councilperson
Owen made a motion to APPROVE the parks claims with Councilperson Jahn seconding, PASSING on a
vote, 9-0.
REPORT OF THE CLERK:
None at this time.
UNFINISHED BUSINESS:
1. Lisa GiII/Vicki Conlin—2018-OR-51 An Ordinance Transferring Certain Funds within the Same
Department Police Merit Commission -Passed 1st and 2nd 8/20/18—There have been no
changes since the first reading. Councilperson Maples made a motion to APPROVE 2018-OR-51
on the third and final reading with Councilperson Hawkins seconding, PASSING on a vote, 9-0.
2. Lisa Gill/Nathan Samuel—2018-OR-52 An Ordinance Transferring Certain Funds within the
Same Department Public Arts Commission - Passed 1st and 2nd 8/20/18—Councilperson
Samuel presented 2018-OR-52. There have been no changes since the last reading.
Councilperson Samuel made a motion to APPROVE 2018-OR-52 on the third and final reading
with Councilperson Maples seconding, PASSING on a vote, 9-0.
3. Lisa Gill/Heather Metcalf- PUBLIC HEARING 2018-OR-53 An Ordinance of Additional
Appropriation -Passed 1st and 2nd 8/20/18—Assistant Controller Yvonne Down presented
2018-OR-53. There have been no changes since the last reading. Council President Gill opened
the Public Hearing at 7:05 PM and as no members of the community came forward to speak for
or against the matter the Public Hearing was closed. Councilperson White made a motion to
APPROVE 2018-OR-53 on the third and final reading with Councilperson Maples seconding. A
roll call was requested.

Final Vote, PASSED 7-2 with Councilperson Samuel and Councilperson Ellis voting against.
NEW BUSINESS:
1. Lisa Gill/ Les Merkley—Public Hearing 2018-OR-54 An Ordinance Changing the Zoning Map
Designation of a certain Tract of Property Located at Stacy Road & Hwy 62 From R3 to M2—
Council President Gill advised this will be presented with the next one however they will need
two separate votes. City Attorney Merkley presented 2018-OR-54. This comes from the
Planning Commission with a favorable recommendation. It will need to be rezoned twice for the
end result to be a PD. American Village Properties is the petitioner and Mike Speedy was
present to answer any questions. Council President Gill said at the Planning and Zoning Meeting
people spoke for this and it has a lot of nice amenitites and will be nicely done. Councilperson
Jahn advised this will be around 256 units. Council President Gill opened the Public Hearing at
7:09 PM and ad no members of the community came forward to speak for or against the matter
the Public Hearing was closed. Councilperson Zastawny said this is exactly what Jeffersonville
needs. Councilperson Hawkins made a motion to APPROVE 2018-OR-54 with Councilperson
Maples seconding, PASSING on a vote, 9-0.
2. Lisa Gill/ Les Merkley—Public Hearing 2018-OR-55 An Ordinance Changing the Zoning Map
Designation of a certain Tract of Property Located at Stacy Road & Highway 62 from M2 to
M2-PD—Council President Gill opened the Public Hearing at 7:11 PM and as no members of the
community came forward to speak for or against the matter the Public Hearing was closed.
Councilperson Owen made a motion to APPROVE 2018-OR-55 with Councilperson Hawkins
seconding, PASSING on a vote, 9-0.
3. Lisa Gill/ Heather Metcalf-2018-OR-56 An Ordinance Transferring Certain Funds within the
Same Department( Parks Activity Aquatic)—Assistant Controller Yvonne Dowd presented
2018-OR-56. This is for the Parks Department. Councilperson Samuel said he appreciates the
transfers as opposed to an additional appropriation. Councilperson Samuel made a motion to
APPROVE 2018-OR-56 on the first and second reading with Councilperson Ellis seconding,
PASSING on a vote, 9-0.
4. Lisa Gill/Larry Wilder—2018-OR-57 An Ordinance Rescinding Ordinance 2007-OR-50 And
Replacing with 2018-OR-_-Councilperson Jahn presented 2018-OR-57. She asked if there
were any comments. Councilperson Ellis asked if this could control those lanterns as well as the
fireworks, it will not. Councilperson White asked what would happen if people do not pay their
fines, they will be filed in Circuit court. Councilperson Jahn made a motion to APPROVE 2018-
OR-57 on the first and second reading with Councilperson Zastawny seconding, PASSING on a
vote, 9-0.
5. Lisa Gill Heather Metcalf—2018-OR-58 An Ordinance of Additional Appropriation (Public
Meeting September 17, 2018)—Council President Gill said she sent out an email regarding this.
It was sent out to bids but for legal reasons the lowest bid was not able to be accepted and the
next bid up requires and additional $20,000. Councilperson Ellis asked City Attorney Merkley if
there was any reason the legal issues could not be discussed with the Council and Mr. Merkley
said he would rather not discuss it publically since it is pending litigation.
Councilperson Samuel inquired about the need for additional fuel funding. Mr. Caldwell said
they recently upgraded to a better quality of fuel to prolong the life of the vehicles as well as the
increase in vehicles in the City. In regards to Overtime they had someone resign as well as
someone on FMLA. They may be able to go with a smaller amount now that they have those
issues resolved.
Councilperson Maples made a motion to AMEND 2018-OR-58 to reflect 5,000 for overtime with
Councilperson Owen seconding, PASSING on a vote, 8-1 with Councilperson Ellis voting against,
Councilperson Maples made a motion to APPROVE the amended 2018-OR-58 on the first and
second reading with Councilperson Hawkins seconding, PASSING on a vote, 7-2 with
Councilperson Samuel and Councilperson Ellis voting against.
DEPARTMENT HEAD REPORTS:
Nothing at this time.
REPORT OF THE COUNCIL ATTORNEY
Council Attorney Larry Wilder not present at the meeting.
PUBLIC COMMENTS:
Nothing at this time.
COUNCIL COMMENTS:
Councilperson White—Nothing at this time.
Councilperson Zastawny—He is glad that it's NFL time and the Browns are back and better than ever.
Councilperson Jahn—Nothing at this time.
Councilperson Maples—Nothing at this time.
Councilperson Hawkins—Steamboat nights was absolutely fantastic and very pleasant. He also did the
farmers market and it was great, took in the tree walk and it was great as well. All great contributions to
Jeffersonville and all very well done.
Councilperson Owen—Julie Moreman from Communities and Schools contacted him inquiring about a
sponsorship, he would like to continue to advocate for that program because they do a good job. It is a
nonprofit, mentoring for younger students, and she would love to come and present to the Council
again.
Also he would like to meet with the Council to discuss possible litigation and needs to schedule an
Executive session. Executive session will be Wednesday 9/12/18 at 4:30 with a Budget Workshop to
follow.
Councilperson Ellis—Nothing at this time.
Councilperson Samuel—He recently sent out an email with a large document from Dawn Spyker
showing where City of Jeff is applying for the Arts and Cultural district. This has been a lot of work from
the Administration. Would like to ask Dawn to come to the next meeting.
Council President Gill—There were lots of people who were disappointed with Friday, but everyone was
pleased with Saturday and Steam Boat Nights. Thanks to Parks and Police and Fire department for all of
the hard work. Additionally she received a Thank You note from Steve Webb from when the Council
sent the spirit ball in memorial of his father.

Councilperson Samuel made the motion to ADJOURN and the meeting adjourned at 7:37 P.M.
