HomeMy WebLinkAbout2018-OR-55 STACY ROAD AND HWY 62 STATE OF INDIANA BEFORE THE JEFFERSONVILLE COMMON COUNCIL ORDINANCE 2018-OR- a AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION OF A CERTAIN TRACT OF PROPERTY LOCATED AT STACY ROAD AND HIGHWAY 62 AND FULLY DESCRIBED IN ATTACHED EXHIBIT A FROM M2 TO M2-PD Whereas, American Village Properties filed a petition before the Jeffersonville Plan Commission to change the zoning map designation of the real property located at Stacy Road and Highway 62 and fully described in the attached Exhibit A from M2- Medium Density Multi- Family to M2-PD-River Ridge Flats Multi-Family Planned Development and, Whereas, on August 28, 2018 the Jeffersonville Plan Commission has certified its favorable recommendation of the enactment of this proposed zoning map designation change by ordinance of this Common Council; and, Whereas, this matter is now before the Common Council at its regular meeting after certification of the proposed change of zoning map designation pursuant to the provisions of I.C. 36-7-4-608(f)(1); and, Whereas, this Common Council has timely posted notice of its intent to consider the proposed change of zoning map designation at the regular meeting scheduled for September 4, 2018; and, Whereas, all interested persons having been given an opportunity to appear before this Common Council and be heard regarding this matter as required by law. Now,THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that the zoning designation of the real property located at Stacy Road and Highway 62 and fully described in the attached Exhibit A is hereby changed from M2- Medium Density Multi-Family to M2-PD-River Ridge Flats Multi-Family Planned Development. IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville shall be amended to include such change. This ordinance shall be in full force and effect upon its adoption. The current zoning is R3 (Old City Residential). The applicant has also filed an application for a rezoning to a PD-M2 (Multi-Family Planned Development). Properties zoned R3 (Old City Residential) cannot be rezoned directly to a Planned Development. The property must have a base zoning of M2 in order to be rezoned to PD-M2. Figure 1 shows the location of the subject property. t' �'" Subject Property ...,;:f 0 a River Ridge • / Figure 1: Site Location Page 1 of 4 PC-18-51 River Ridge Flats Base Rezoning Zoning Change Procedure The Jeffersonville Zoning Ordinance and Indiana State Statute IC 36-7-4-603 outlines that the following should be considered when the Plan Commission is reviewing a Rezoning Request: • The Comprehensive Plan; • Current conditions and character of structures and uses in each district; • The most desirable use for which the land in each district is adapted; • The conservation of property values throughout the jurisdiction; and • Responsible development and growth. It can be one building, an urban, suburban, or village development. The blend should be physically integrated and functionally related to create a center or community. This use typically creates a greater variety in housing, reduced distances between housing, workplaces and amenities, more compact development, stronger neighborhood character, and should be pedestrian and bicycle friendly. Downtown Historic District Figure 3: Planning Districts Map Traditional Neighborhoods This form is characterized by predominately residential uses, by a grid pattern of streets with sidewalks and often including an alley. Residential lots are predominately narrow and often deep, but the neighborhood may contain sections of larger estate lots, and also sections of lots on which appropriately integrated higher density residential uses may be located. The higher density uses are encouraged to be located in centers or near parks and open spaces having sufficient carrying capacity. Traditional Workplace A Traditional Workplace is a form characterized by predominately small to medium scaled industrial and employment uses. The streets are typically narrow, in a grid pattern and often have alleys. Buildings have little or no setback from the street. Traditional workplaces are often closely integrated with residential areas and allow for a mixture of industrial, commercial and office uses.
