BOARD OF ZONING APPEALS
March 27, 2018
Call to Order
A meeting of the Jeffersonville Board of Zoning Appeals was held on March 27, 2018 at
7:18 p.m. in the Council Chambers,First Floor,Jeffersonville, City Hall 500 Quartermaster Court,
Jeffersonville, Indiana. Chairperson, Mike McCutcheon called the meeting to order.
Roll Call
The roll was requested by the Mike McCutcheon, those Members present were: Rita
Fleming,Christopher Fox,Mike McCutcheon,David Stinson and Rodger Clarke. Those Members
not present were: none. Also present were Shawn Dade, Planning&Zoning Coordinator,Nathan
Pruitt, Planning& Zoning Director, and Les Merkley, Planning &Zoning Attorney.
Approval of Minutes
No minutes available to approve at this time.
Approval of Findings of Fact
None
Oath
Les Merkley, City Attorney for the City of Jeffersonville administered the oath to all those
intending to provide testimony before the Board of Zoning Appeals.
(SECETARY'S NOTE: ALL PLAT MAPS, PHOTOS, ETC. PRESENTED BEFORE THE
BOARD OF ZONING APPEALS ON THIS DATE CAN BE FOUND IN THE OFFICE OF
PLANNING AND DEVELOPMENT.
Old Business
1. BZA-18-06
Request to table; Board approved tabling item.
New Business
2. BZA-18-10
Millennial Builders filed application for variances from the development standards for
property at 838/840 Watt Street. The request is to have two structures on the parcel. The property
is zoned M1 which is residential.

• Zoning ordinance intent in one district is to allow for multi-family
residencies including duplex, tri-plexes and quad-plexes
• Ordinance allow for up to two structures per lot
• In line with comprehensive plan
• Allow Millennial Builders to exceed maxium density
• Not the largest lot in community
• Could not use the lot if you do not allow building this
• Isn't going to be injurious to the moral safety health welfare of the general
public, not cause injury to adjacent parcel
• Similar properties exist adjacent to parcel
Mr. Pruitt added—looking at Google street image there is only about 5 cars—allowing for
tons of street parking.
Dr Fleming—compatible with residences in the area.
Mr Clarke - definite upgrade and I did go down on the weekend for parking and it will
easily be absorbed.
Dr Fleming- Maybe church on Sunday.
Mr. Clarke- or a funeral around the corner.
Public Comment: against? none; support? none. Letters or comments? none. Board
comments? none.
What is on the property now? It is vacant. It used to be hair salon.
Mr. Clarke - What does this open up us to down the road with two primary structures on a
residential lot?
Mr. Pruitt— I do not see any issues. If you look at lots to the north, and opposing corner
someone came in and subdivided into two lots. We decided that there was no reason to subdivide
the lot because it is under the same ownership and you might as well not have two tax bills. I don't
think we are setting any precedent here per say.
Therefore, the Board made the following Findings of Fact:
1. The variance of the development standards would not be injurious to public health,
safety, moral and general welfare of the community;
2. The use and value of the area adjacent to the property included in the variance would
not be affected in a substantially adverse manner; and
3. The strict application of the terms of the Ordinance would result in a practical difficulty.
The situation shall not be self-imposed, nor be based on a perceived reduction of or
restriction of economic gain.
Based on the findings described above, the Board approved this application on a vote
of 5-0.
3. BZA-18-11
Chris Brown filed an application a use variance for property at 1415 East Tenth Street. The
proposed use is a vapor shop. The property is zoned C2 which is commercial.

• Ninth location — recently open one in New Albany — remodeled an old Taco
Bell. Presented pictures.

• Clean stories, not ones with flashy lights
Board Questions: none. Public Comment: against? none; support: none. Any letters? none.
Board comments: none.
Therefore, the Board made the following Findings of Fact:
1. The variance of the development standards would not be injurious to public health,
safety, moral and general welfare of the community;
2. The use and value of the area adjacent to the property included in the variance would
not be affected in a substantially adverse manner;
3. The need for the use variance does result from conditions unusual or peculiar to subject
property itself;
4. The strict application of the terms of the Ordinance would result in an unnecessary
hardship in the use of the property; and
5. The approval of the variance will not contradict the goals and objectives of the
comprehensive plan.
Based on the findings described above, the Board approved this application on a vote 5-0.
Reports from Officers, Committees and Staff
Nathan Pruitt stated the following:
• New signs for public notification which are much more descriptive
• Shawn Dade is leaving—last meeting
Adjournment
There being no further business to come before the Board, the meeting was adjourned.
