HomeMy WebLinkAboutJULY 16, 2018 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA July 16, 2018 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday,July 16, 2018. Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Mr. Bobby Campbell gave the Invocation and Council President Gill asked those in attendance to stand and recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson Jahn, Councilperson Maples, Councilperson Hawkins, Council President Gill, Councilperson Owen, Councilperson Ellis, and Councilperson Samuel. Councilperson Zastawny was absent from the proceedings. MINUTES TO BE APPROVED: July 2, 2018—Council President Gill noted that there is an change on #7 where Ms. Calabro was presenting that there was the removal of the caps for employees. Councilperson Ellis made a motion to APPROVE with the changes with Councilperson Samuel seconding, PASSING on a vote, 8-0. APPROVAL OF THE AGENDA: Council President Gill advised that#12 under New Business will need to be tabled, it was put on this Council Meeting as opposed to the July 16, 2018 Council Meeting as it should have been and will need to be advertised again. Councilperson Owen made the motion to APPROVE the agenda with the noted change with Councilperson Zastawny seconding, PASSING on a vote, 8-0. CLAIMS TO BE APPROVED: Heather Metcalf City Controller presented the General Claims List in the amount of$704,628.14. Council President Gill said on Page 1 for the Social Media Boot Camp for Police we need an Agenda. Also there is a claim for$1700 that we need a signature on the PO, Controller Metcalf said that was already obtained. On page 2 for the Chase Credit card in the amount of$360 it needs to be pulled. On page 6 for the hotel in the amount of$179 there was no receipt. On page 7 for the $138,000 is there a receipt, Controller Metcalf stated there is. The new total is$704,089.14. Councilperson Jahn made a motion to APPROVE the general claims with the noted changes with Councilperson Hawkins seconding, PASSING on a vote, 8-0. Heather Metcalf City Controller presented the Parks Claims List. Council President Gill advised we need to make sure we have a signed contract for the claim for$500 on page 4 (it will be signed Monday at the Parks meeting). Also need a detailed receipt for the House of Boom for$21.The amount is$119,021.21 Councilperson Jahn made a motion to APPROVE the parks claims with Councilperson White seconding, PASSING on a vote, 8-0. REPORT OF THE CLERK: First thing, thanks to the employees in sanitation and drainage, as a person that pays taxes she appreciates them and all that they do. Last Wednesday the proposal was signed for the system updates. On July 3 she sent an email to IT and has yet to hear a response back. Still waiting to proceed forward with that. UNFINISHED BUSINESS: 1. Lisa Gill/ Kim Calabro—2018-OR-39 An Ordinance Establishing Non-Collective Bargaining Salary/Wage Administration Police and Repealing Prior Policy—Councilperson Owen made a motion to APPROVE 2018-OR-39 on the third and final reading with Councilperson Jahn seconding, PASSING on a vote, 8-0. 2. Lisa Gill/ Heather Metcalf—2018-OR-40 An Ordinance Transferring Certain Funds within the Same Department—City Controller Heather Metcalf presented 2018-OR-40. There have been no changes since the last reading. Councilperson Jahn made a motion to APPROVE 2018-OR-40 with Councilperson Owen seconding, PASSING on a vote, 8-0. 3. Lisa Gill/Heather Metcalf—PUBLIC HEARING 2018-OR-41 An Ordinance for Additional Appropriations-City Controller Heather Metcalf presented 2018-OR-41. There have been no changes since the last meeting. Council President Gill opened the Public Hearing at 7:12 PM and as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Jahn made a motion to APPROVE 2018-OR-41 on the third and final reading with Councilperson Owen seconding, PASSING on a vote, 8-0. NEW BUSINESS: 1. Lisa Gill/ Les Merkley—PUBLIC HEARING—2018-OR- An Ordinance Changing the Zoning Map Designation of a Certain Tract of Property Located at 1417 Old Salem Road and Fully Described in Attached Exhibit A from R1 to C2 -TABLED during approval of agenda. 2. Lisa Gill/ Les Merkley—Les Merkley—2018-OR-42 An Ordinance Amending 2010-OR-30 An Ordinance Regulating the Maintenance of Existing Buildings and Property in the City of Jeffersonville to address planting, containment and removal of Bamboo—City Attorney Les Merkley presented 2018-OR-42. The City currently has some issues with planting and growing bamboo. This spreads quickly. We have a current ordinance in place that they thought would adequately address the issue but after further review the Administration believes it needs to be tightened up. This will allow the City to seek reimbursement for the work done to rid the bamboo as well and comes at the request of the Code Enforcement. He would like to request that the rules be suspended in anticipation of passing on all three readings. Councilperson Owen made a motion to SUSPEND the rules in anticipation of 2018-OR-42 passing on all three readings with Councilperson Maples seconding, PASSING on a vote, 8-0. City Attorney Merkley stated they will not be out looking for bamboo but it will be for the instances where people call in because it is not being contained properly. It is very difficult to get rid of. Councilperson Maples made a motion to APPROVE 2018-OR-42 on all three readings with Councilperson White seconding, PASSING on a vote, 6-2 with Councilperson Jahn and Councilperson Samuel voting against. Councilperson Jahn stated she would not support this because she would like to see it still be able to be planted as long as long as it is responsibly contained. 3. Lisa Gill/Lisa Gill—Discussion on 2007-OR-50—Council President Gill reported that she would like to have a conversation concerning the current Ordinance regarding fireworks. She is getting a lot of complaints from people on fireworks that they are going until all hours of the night. When she spoke with the Police they said they would like to see a time in this ordinance as opposed to a time frame after sunset. Gale Parrish was present to speak on the matter- 1233 Ridgeway Dr—She listed facts on fireworks injuries and stated she would like peace and quiet in her own home. These go off all hours of the day and night and last for weeks, it's like a warzone atmosphere. This is a widespread problem in the area. Clerk Conlin stated her office was also bombarded with phone calls asking about the ordinance and what it outlined. The Council discussed the dates that the ordinance outlined and that they would like to see both a weekend included and the week days surrounding the holidays. Council President Gill said she would like to see it say a specific time as well as limit the days so they are not leaving it broad and wide open. Councilperson Samuel said it seems like they could say that they would need to end by 11 PM. Council Attorney Wilder will prepare this for the next meeting and send to Clerk Conlin for the packet. 4. Lisa Gill/Heather Metcalf—2018-OR-43 An Ordinance Transferring Certain Funds within the Same Department Prior Policy-City Controller Heather Metcalf presented 2018-OF-43. This will take care of the unwanted trees and next year's money will be used to purchase new trees. Councilperson Samuel made a motion to APPROVE 2018-OR-43 on the first and second reading with Councilperson Maples seconding, PASSING on a vote, 8-0. 5. Lisa Gill/Heather Metcalf-2018-OR-44 An Ordinance of Additional Appropriation (Public Hearing(Public Hearing August 6, 2018)—City Controller Heather Metcalf presented 2018-OR- 44. Clerk Conlin said for Workers comp is from the Audit and every time we add new employees our amount increases. Council President Gill asked if this couldn't be found elsewhere since the money is going to be saved. Controller Metcalf stated the company requires that they be paid upfront and she does not have that full amount in her budget. Councilperson Ellis said everyone knows his stance on Additional Appropriations but he does understand the need for some things. Councilperson Jahn made a motion to APPROVE 2018-OR-44 on the first and second reading with Councilperson Hawkins seconding, PASSING on a vote, 7-1 with Councilperson Samuel voting against. REPORT OF THE COUNCIL ATTORNEY Nothing at this time. DEPARTMENT HEAD REPORTS: Paul Northam—In regards to the fireworks—they leave a mess in the parks as well and he would like for them not to be allowed in the public parks. PUBLIC COMMENTS: Nothing at this time. COUNCIL COMMENTS: Councilperson White—Nothing at this time. Councilperson Jahn—The Homeless Coalition of Southern Indiana would like to come next meeting to give their annual update. Also she will be doing the second workshop on July 25th on Stress Management Techniques from 1-3 pm. Councilperson Maples—Nothing at this time. Councilperson Hawkins—Nothing at this time. Councilperson Owen—Nothing at this time. Councilperson Ellis—Nothing at this time. Councilperson Samuel—The Animal Shelter would like to revisit their Ordinance, he will be looking at that and seeing if there is support, if so he will be bringing that back if not he will not. Council President Gill—The Council and Clerk have not received their budget worksheet yet. Controller Metcalf advised they have not been sent out. We will be needing a workshop in August but will hold of on scheduling that. ADJOURNMENT: Councilperson Samuel made the motion to ADJOURN and the meeting adjourned at 7:57 P.M.
