HomeMy WebLinkAbout3012 Eastbrook Blvd BEFORE THE BOARD OF PUBLIC WORKS AND SAFETY CITY OF JEFFERSONIVLLE, INDIANA IN RE THE MATTER OF: 3012 EASTBROOK BLVD. JEFFERSONVILLE, INDIANA PARCEL#: 10-21-02-200-658.000-009 ORDER Comes now the City of Jeffersonville, by and through its Board of Public Works and Safety ("Board"), having reviewed the evidence and heard testimony in this matter on June 6, 2018, finds the following: 1. The property located at 3012 Eastbrook Blvd., Jeffersonville, Indiana ("Property") is in violation of I.C. 36-7-9, 2010-OR-30 and the Jeffersonville Zoning Ordinance. 2. The property owner, Beverly N. Gray ("Property Owner"), were cited by the Code Enforcement for violation of I.C. 36-7-9, 2010-OR-30 and the Jeffersonville Zoning Ordinance, which in part state the following: Vehicles or trailers of any type without current license plates or in an inoperable condition shall be prohibited in residential zone districts other than in completely enclosed buildings and prohibited in commercial zone districts unless fully screened, and shall not be parked or stored in any zone unless specifically authorized under the terms of the Zoning Ordinance. All exterior surfaces,including but not limited to doors,door and window frames,cornices, porches, trim, balconies, decks and fences shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. 3. The Board has determined that there is an inoperable motor vehicle on the property and the structure on the property has not been maintained in good condition. 4. The property owner has been repeatedly cited for violations. Despite these citations,the property owner has failed to abate the violations. 5. The property owners has refused service in this matter, either by certified mail or in person. IT IS HEREBY ORDERED by the Board as follows: 7. The Board has jurisdiction to adjudicate this matter as the Hearing Authority pursuant to 2010-OR-30 and I.C. 36-7-9. 8. The property owner is in violation of I.C.36-7-9,2010-OR-30 and the Jeffersonville Zoning Ordinance for failing to remove in an operable motor vehicle and maintaining property structures in a good condition. 9. The property owner shall,within ten(10)days of this Order,remove the inoperable motor vehicle. The City may remove the vehicle, at the owner's expense, in the event the property owner fails to comply. 10. The property owners shall,within ten(10)day of this Order, repair the structure to satisfy the minimum building code violations per the Jeffersonville Building Commissioner. The City may repair the structure, at the owner's expenses, in the event the property owners fails to comply. 11. The property owner is hereby fined $500.00 per day until compliance with this Order. 12. All fines, including expenses incurred by the City related to this matter, shall result in the placement of lien on the property. 13. The property owner has the right to appeal this decision to the Board of Public Works and Safety. Said appeal must be commenced within ten (10) days of this Order by contacting the City of Jeffersonville at the address below or the property owner may appear before the Board of Public Works and Safety on June 20, 2018 at 9:30 a.m. in the Mayor's Conference Room at City Hall located at 50 Quartermaster Ct.,Jeffersonville, Indiana. 14. Failure to either appeal this ORDER within ten (10) days or appear at the Board on the date set forth above will result in this becoming a final appealable order from the date of its issuance and is subject to judicial review pursuant to I.C. 36-7-9-8.
