HomeMy WebLinkAbout2018-01 STATE OF INDIANA BEFORE THE CITY OF JEFFERSONVILLE POLICE MERIT COMMISSION AMENDMENT NO. 2018-01 AN AMENDMENT TO THE CITY OF JEFFERSONVILLE POLICE DEPARTMENT MERIT COMMISSION RULES AND PROCEDURE, ADDING RULE AND PROCEDURE 8.5 WHEREAS,pursuant to Ind. Code § 36-4-6-2,the City of Jeffersonville Common Council (hereinafter the"Council"), is the legislative body of Jeffersonville City government; and, WHEREAS, pursuant to Ind. Code § 36-8-2-2, the City of Jeffersonville has established, maintains, and operates a police and law enforcement system to preserve public peace and order and provides facilities and equipment for that system (hereinafter, collectively referred to as the "Department"); and, WHEREAS,pursuant to Ind. Code§36-8-3.5-3,the Council adopted Resolution No.2008- R-30 (as amended by Resolution No. 2009-R-17, as amended Ordinance No. 2011-OR-44, An Ordinance Reaffirming the Authority of the City of Jeffersonville Police Merit Commission); and, WHEREAS,pursuant to Ind. Code § 36-8-3.5-10,the duly appointed City of Jeffersonville Police Merit Commission(hereinafter the"Commission")adopted the City of Jeffersonville Police Merit Commission Rules and Procedures (as amended from time-to-time by the Commission, pursuant to amendment procedures set forth in the City of Jeffersonville Police Merit Commission Rules and Procedures)(hereinafter, collectively referred to as the "Rules"); and, WHEREAS, pursuant to Ind. Code § 36-8-3.5 et seq. and the Rules the Commission is responsible for submitting a budget for approval by the City of Jeffersonville Common Council, as other department budgets are submitted and approved; and, WHEREAS, the Commission hereby desires to establish procedures for the recommendation for approval of any claims brought before or submitted to the Commission out of the Commission's approved budget; and NOW THEREFORE, THE CITY OF JEFFERSONIVLLE POLICE MERIT COMMISSION RULES AND PROCEDURES ARE HEREBY AMENDED TO INCLUDE ADDITIONAL LANGUAGE, in the following respects, to wit: RULE AND PROCEDURE,8.5,ENTITLED, "CLAIMS SUBMISSION AND REVIEW PROCEDURE" PURPOSE: To establish the manner in which claims shall be submitted to the Commission for recommendation of approval before the City of Jeffersonville Common Council. I. DEFINITIONS "Proper Claim"a claim is proper if it is in writing, and°,:+9rrectly identifies goods or services provided to the Commission,or on behalf of the Commission, for goods or services necessary for the operations and or functioning of the Commission. The term "proper claim,"would include the reimbursement of a Commission member(or a contractor providing service to the Commission pursuant to a contract for service), for any expenditures made on behalf of the Commission. II. CLAIMS SUBMISSION The Commission shall receive claims at its regularly scheduled public meeting, as such claims are provided to the Commission, either directly before the Commission during or at its Regularly Scheduled Meetings,and/or prior to the meeting by providing a copy of proposed claims to the minute- taker for the Commission, or the Commission's attorney of record. To the extent a proper claim for services or goods rendered to the Commission or on behalf of the Commission, is presented to the Commission before the conclusion of the regularly scheduled meeting,the Commission shall consider the recommendation of such claim(s) for approval. III. RECOMMENDATION FOR APPROVAL Recommendation for approval of any and all claims brought before the Commission shall be made upon a Commission member's motion to recommend payment of the claim(s). Once such motion is made, if a Commission member provides a second for such motion, upon completion of further discussion on said motion,the motion shall be put to a vote of the Commission.Claims shall be deemed recommended for approval to the extent a majority vote of those members of the Commission then present at the Commission meeting vote in favor of recommendation that the claim be paid. IV. PROCEDURE AFTER RECOMMENDATION The Commission attorney of record shall cause all claims submitted to vote and properly recommended for approval, in to folder which shall be delivered to the CITY OF JEFFERSONVILLE CLERK (the "Clerk"),within forty-eight(48)hours of the conclusion of the meeting, by the Commission President or his/her designee. The Claim Administrator shall cause the claim(s)to be properly entered in to the City of Jeffersonville accounting system, following any and all procedures for such entry. Upon completion of any claim list(s), the Claim Administrator shall contact the Commission president for signature of the Commission president upon any necessary documentation for submission to the City Council. No claim(s) that have been properly submitted and recommended for approval by the Commission shall be withheld from placement on the Common Council's agenda for approval for any reason.
