COMMON COUNCIL OF THE CITY OF
JEFFERSONVILLE, INDIANA
DECEMBER 16, 2002
The Common Council of the City of Seffersonville met in regular session in the Multi-
Purpose Meeting Room in the City County Building, Jeffersonville, Indiana at 7:30
p.m. on the 16t~ day of December 2002.
Council President Denny Frantz called the meeting to order, with Deputy Clerk Lynne
Mayfield and Clerk Treasurer Peggy Wilder at the desk.
Council President Frantz asked all those present to stand as Councilman Ellis gave the
invocation. Council President Frantz asked all those present to join him in the pledge of
allegiance to the flag.
The roll was called and those present were Councilpersons Les Merkley, Vickie Conlin,
Denny Frantz, Rob Waiz,' Barbara Wilson, and Ron Grooms.
Councilperson Wilson made the motion to approve the minutes of 11-14-02, seconded by
Councilperson Grooms and carried unanimously.
Councilperson Wilson made the motion to approve the minutes of 11-18-02, seconded by
Councilperson Merkley and carded unanimously.
Clerk Treasurer Wilder presented two transfer ordinances 24A and 24B as requested by
Councilperson Waiz that were not included in the packets. They are to transfer monies
into hospitalization from the Common Council, ADA, and Safety budgets for a total
amount of $62,000.00. CoUncilperson Merkley made the motion to approve the amended
agenda, seconded by Councilperson Waiz and carried unanimously.
Clerk Treasurer Wilder had one additional claim for the Treasurer of Clark County for
the switchboard operator in the amount of $11,187.75.
Councilperson Ellil said there was a claim on page 14 from CumCap Development on a
1992 Van for $4,500.00. He said he was under the impression that no more Vehicles
would be purchased. Clerk Treasurer Wilder said it's a Fire Dept. van and the Fire
Department ran short in overtime and pension so to make balances in their budget we
needed to pay this claim from Cum Cap Development. Councilperson Ellis said he
doesn't think the van is worth $2,500.00. Councilperson Conlin said she specifically
remembers the Council telling the fire department and police department that until
fiscally ok there would be no dive team. Clerk Treasurer Wilder said the claim was
passed previously within the Fire Department and we're trying to repost it.
Councilperson Grooms asked if we are in possession of the van and Clerk Treasurer
Wilder said yes. She said that the Fire Department budget will still close out in the red.
Wilder said the overtime is in the red $12,769.64 and Pension is in the red $17,909.20
and they must be paid. The Fire Dept is transferring from other line items.
Councilperson Grooms asked Engineer Miller about a $6,000.00 claim to the Culpepper
Group. Engineer Miller said it's for a policy procedure manual for the City of Jeff.
Engineer Miller said he had the money in his budget to pay for it. Culpepper Cooper said
he did a proposal for the administration to do a personnel policy manual because it hadn't
been updated for about six years. Councilperson Merkley said this was never brought up
in the Board of Public Works. Councilperson Grooms made the motion to approve the
claims with the additions, and seconded by Councilperson Merkley. Ayes:
Councilpersons Wilson, Conlin, Waiz, Frantz.
Nays: Councilperson Ellis.
INSURANCE:
Culpepper Cooper said quotes were gotten from Sagamore, Anthem, and Humana.
Humana gave the best quote overall and a fully insured one. He said he will take the
Humana quote and the Anthem quote and build on it and have the two give a new quote
for April 1, 2003. He said the Board of Public Works has taken no action yet. Cooper
presented to the Council what he thinks is the most current retiree rates. He thinks the
four tier rate is the most fair to retirees. Councilperson Conlin asked if it's possible to go
from January to January versus April to April and Cooper said yes.
Councilperson Grooms said that while reviewing the current insurance booklet it states
that an employee is eligible for full insurance at date of hire which he thinks is unusual.
Cooper said it is and not all insurance carriers would do that but since the city is self
insured it can be done. Grooms asked if it would make sense to delay eligibility to 90
days after employment that you could possibly cut some cost. Cooper said you could cut
cost and control some bad risk. Cooper said that not many cities and towns have a
waiting period and he doesn't know why. Grooms asked if Cooper would recommend a
waiting period. Cooper said he would have no problem recommending it. Grooms asked
what is considered by insurance as a seasonal employee. Cooper said 32 hours or less is
considered seasonal or a seasonal employee could be someone who works as many hours
as they want but will not be eligible for benefits at anytime. Grooms said our manual
states that they are eligible for benefits. Cooper said that is a mistake in the manual.
Councilperson Waiz presented a Resolution 2002R37 requesting the Mayor to remove
the current agent of record from the City's health insurance. He said we haven't gotten
the best quality and cost effective insurance available. Councilperson Waiz made the
motion to approve Resolution 2002R37, seconded by Councilperson Merkley and carried
unanimously. Councilperson Conlin said the whole council agreed in August to continue
the quest for better insurance but it may no happen.
Culpepper Cooper asked to speak. He said that since this is directed at his ability to be
the agent of record for the city that he has done everything he's been asked to do and he
did not tell the City Council what to budget for the last 5 years. He's only been working
with the Council for 18 months. He said his proposals were all guaranteed. He said he
does not think that removing him as agent of record is anything other than a problem with
disagreements on whether you want to believe an insurance contract or the marketing
manual. Cooper asked that this resolution not be supported and doesn't think it's
appropriate at this time.
Resolution No.2002-R-38- A resolution approving statement of benefits for purposes of
property tax abatement. Councilperson Conlin made the motion to pass Resolution 2002-
R-38m seconded by Councilperson Grooms and carried unanimously.
Resolution 2002-R-39- A resolution of Common Council of City of Jeffersonville, Ind.
Providing preliminary approval of issuance of Bonds for purpose of providing financing
of certain economic development facilities to be owned and operated by Amatrol Inc.
Councilperson Merkley made the motion to pass, seconded by Councilperson Conlin and
carded unanimously.
Resolution No. 2002-R-40- A resolution allowing tax abatement and approving statement
of benefits for purposes of property tax abatement. Councilperson C onlin made the
motion to pass, seconded by Councilperson Merkley. Councilperson Grooms made the
motion to amend for a five year tax abatement for qualifying new equipment, seconded
by Councilperson Merkley and carded unanimously.
Ordinance No. 2002-OR-37- An ordinance transferring certain funds within same dept.
Councilperson Merkley made the motion pass Ordinance No. 2002-37 on the second and
third readings. Ayes: Conlin, Wilson, Grooms, Waiz, Frantz Nays: Ellis.
Ordinance 2002-OR-38- An ordinance of additional appropriations. Councilperson
Merkley made the pass on all three readings, seconded by Conlin and carried
unanimously. Councilperson Ellis said he doesn't approve of but will pass.
Ordinance 2002-OR-39- An ordinance changing the zoning map designation.
Councilperson Merkley made the motion to pass, seconded by Councilperson Waiz and
carried unanimously.
Ordinance 2002-OR-40- An ordinance transferring certain funds within same department.
(Fire Dept.) Councilperson Conlin made the motion to suspend the rules and pass on all
three readings, seconded by Councilperson Grooms. Councilperson Conlin made the
motion to approve ordinance 2002-OR-40, and seconded by Councilperson Grooms.
Ayes: Merkley, Wilson, Waiz, Frantz. Nays: Ellis
Ordinance 2002OR-41- An ordinance transferring certain funds within same department
(General fund Clerk Treasurer budget: Councilperson Merkley made the motion to
suspend the rules and pass on all three readings, seconded by Councilperson Grooms.
Councilperson Merkley made the motion to pass Ordinance 2002-OR-41, seconded by
Councilperson Grooms. Ayes: Wilson, Conlin, Frantz, Waiz. Nays: Ellis
Ordinance 2002-OR-42- An ordinance transferring certain funds within same department
General fund Clerk Treasurer. Councilperson Grooms made the motion to pass on all
three readings, seconded by Councilperson Merkley. Ayes: Frantz, Wilson, Conlin,
Waiz. Nays: Ellis
Ordinance 2002-OR-43- An ordinance transferring certain funds within same department
(Motor Vehicle). Councilperson Conlin made the motion to suspend the rules and pass
on all three readings, seconded by Councilperson Grooms. Councilperson Conlin made
the motion to pass ordinance 2002-OR-43, seconded by Councilperson Grooms. Ayes:
Waiz, Wilson, Merkley, Frantz. Nays: Ellis
Ordinance 2002-OR-44- An ordinance transferring certain funds within same dept.
(Probation User) Councilperson Conlin made the motion to suspend the rules and pass
on all three readings, seconded by Councilperson Grooms. Councilperson Conlin made
the motion to pass ordinance 2002-OR-44, seconded by Councilperson Grooms. Ayes:
Waiz, Grooms, Merkley, Wilson, Frantz. Nays: Ellis
Ordinance 2002-OR-45- An ordinance transferring certain funds within same department
(Cum Cap Improvemt.) Councilperson Grooms made the motion to suspend the rules
and pass on all three readings, seconded by Councilperson Conlin. Councilperson
Grooms made the motion to pass ordinance 2002-OR-45, seconded by Councilperson
Conlin. Ayes: Merkley, Frantz, Wilson, Waiz. Nays: Ellis
Ordinance 2002-OR-46- An ordinance transferring certain funds within same department
(Sanitation) Councilperson Conlin made the motion to suspend the roles and pass on all
three readings, seconded by Councilperson Grooms. Councilperson Conlin made the
motion to pass ordinance 2002-OR-46, seconded by Councilperson Grooms. Ayes:
Merkley, Waiz, Wilson, Frantz. Nays: Ellis
Ordinance 2002-OR-47- An ordinance transferring certain funds within same department.
(ADA Safety Budget: Councilperson Waiz made the motion to suspend the rules and
pass on three readings, seconded by Councilperson Conlin. Councilperson Waiz made
the motion to pass ordinance 2002-OR-47, seconded by Councilperson'Conlin. Ayes:
Grooms, Wilson, Merkley, Frantz. Nays: Ellis
Ordinance 2002-OR-48- An ordinance transferring certain funds within same department.
(Common Council) Councilperson Waiz made the motion to suspend the mles and pass
on three readings, seconded by Councilperson Conlin. Councilperson Waiz made the
motion to pass ordinance 2002-48, seconded by Councilperson Conlin and carried
unanimously.
Ordinance 2002-OR-49- An ordinance fixing police and fire salaries for the year 2003.
Councilperson Grooms made the motion to suspend the rules in anticipation of passing
ordinance 2002-OR-49 on three readings to include police and fire only with a 3 1/2
percent raise, seconded by Councilperson Conlin. Councilperson Grooms made the
motion to pass ordinance 2002-OR-49, seconded by Councilperson Conlin and carried
unanimously.
Ordinance 2002-OR-50- An ordinance amending ordinance 2001-OR-25, fixing basic
salaries of appointed officers and employees of the city of Jeffersonville other than police
and fire. Councilperson Grooms made the motion to suspend the rules and pass on all
three readings, seconded by Councilperson Conlin and carded unanimously.
Councilperson Grooms made the motion to pass ordinance 2002-OR-50 on 3 readings
for $700.00 maximum raise per employee and to delete Mechanic//2, one CDL driver
MV, two heavy equipment operators from sewage, and one labor utility worker from
sewage and to eliminate birthday pay, seconded by Councilperson Ellis. Ayes: Grooms,
Wilson, Ellis. Nays: Conlin, Waiz, Merkley, Frantz. Failed.
Ordinance 2002-OR-51- An ordinance giving all employees other than police and fire a 3
lA percent raise to be capped at $1200.00 maximum. Councilperson Merkley made the
motion to suspend the rules and pass on three readings, seconded by Councilperson
Coniin. Ayes: Grooms, Merkley, Walz, Frantz, Wilson, Nays: Ellis.
Councilperson Merkley made the motion to pass ordinance 2002~OR-51 on the first and
second readings, seconded by Conlin. Ayes: Merkley, Grooms, Conlin, Frantz. Nays:
Ellis, Walz, Wilson. Motion passed 4-3
Comments: The Council wished Happy Holidays to all.
Councilperson Grooms announced a meeting to be held at 6:30 p.m. on December
17,2002 at Liter's Quarry.
Councilperson Grooms said his honesty and integrity were attacked by Councilperson
Ellis two weeks previously. The dispute was in regard to prescription drug cards that Mr.
Ellis used and the pricing by Mr. Grooms. Mr. Grooms said many untruths were told.
Mr. Groom's said he never overcharged Mr. Ellis and doesn't care how many cards he
has. Ellis said Mr. Grooms is a liar.
Councilperson Conlin announced a I. rEA meeting to be held at 5:00 p.m. on December
17, 2002. She said that at the last meeting she was asked by the UEG President if the
Council could help fund a trip. She said she told them that any extra money would
probably go towards health insurance but would report back if there were any extra
money. Conlin said she did not vote on this issue of paying for a trip and stated for the
record that she is not a racist.
Councilperson Frantz commended Councilperson Waiz for his work on the health
insurance.
Councilperson Frantz said the last Council meeting for the year would be set for
Thursday, December 19, 2002 at 12:00 noon. Clerk Treasurer Wilder said she would
advertise it.

the motion to adjourn at 10:30 p.m., seconded by Councilperson Merkley, passing
unanimously.
