HomeMy WebLinkAbout2017-R-9 RESOLUTION NO. 2017-R- q A RESOLUTION APPROVING AND RATIFYING INTERLOCAL AGREEMENT BETWEEN THE CITY OF JEFFERSONVILLE, INDIANA AND THE GREATER CLARK COUNTY SCHOOL CORPORATION WHEREAS, the Common Council of the City of Jeffersonville, Indiana(hereinafter"the City")by and through its Board of Public Works and Safety and the Greater Clark School Corporation (hereinafter referred to as "the School Corporation"), through its Board of School Trustees, entered into an Interlocal Agreement; and WHEREAS,this Agreement shall remain in full force and effect from the time it is executed by both parties on a continuing basis unless terminated in accordance with Section 4 of the Interlocal Agreement; and WHEREAS,the purpose of this Agreement is to assign a Jeffersonville Police Officer at Corden Porter School to serve as a school resource officer to provide security and for assistance with traffic control at Corden Porter School beginning with the first student day for the 2017-2018 school year and thereafter during each school year with a maximum number of days worked per year of 180 student days. WHEREAS, the Common Council believes that it is in the best interest of the City to enter into this Interlocal Agreement; NOW THEREFORE, IT IS HEREBY RESOLVED that the Common Council of the City of Jeffersonville does hereby approve and ratify the Interlocal Agreement to assign a Jeffersonville Police Officer at Corden Porter School to serve as a school resource officer to provide security and for assistance with traffic control at Corden Porter School beginning with the first student day for the 2017-2018 school year and thereafter during each school year with a maximum number of days worked per year of 180 student days. Vicki Conlin, Clerk This Resolution approved and signed by me this o43 day August, 2 7. ike Moore, Ma or ATTACHMENT A INTERLOCAL AGREEMENT BETWEEN THE CITY OF JEFFERSONVILLE, INDIANA AND THE GREATER CLARK COUNTY SCHOOL CORPORATION THIS AGREEMENT is entered into by and between the City of Jeffersonville, Indiana, (hereinafter referred to as "the City"), through its Board of Public Works and Police Department, and the Greater Clark County School Corporation (hereinafter referred to as "the School Corporation"), through its Board of School Trustees. 1. DURATION: This Agreement shall remain in full force and effect from the time it is executed by all parties on a continuing basis unless terminated in accordance with Section 4 below. 2. PURPOSE OF AGREEMENT: The purpose of this Agreement is to assign a Jeffersonville Police Officer at Corden Porter School to serve as a school resource officer to provide security and for assistance with traffic control at Corden Porter School beginning with the first student day for the 2017-18 school year and thereafter during each school year with a maximum number of days worked per year of 180 student days. This purpose has been established for the benefit of the School Corporation's students, employees, faculty, administrators, general public and citizens of the City and surrounding communities. 3. MANNER OF FINANCING, STAFFING AND SUPPLYING THE JOINT UNDERTAKING AND OF ESTABLSHING AND MAINTAINING A BUDGET THEREFORE. a. Manner of Financing. The School Corporation shall pay to the City of Jeffersonville the amounts below for one officer during the term of this agreement: i. Year 2017 - Fifty-One Thousand, Sixty Dollars and Fifty-One Cents ($51,060.51) (to be pro-rated to reflect the actual start date during 2017) ii. Year 2018—Fifty-Two Thousand, Five Hundred Ninety-Two Dollars and Thirty-Two Cents ($52,592.32) iii. Year 2019—Fifty-Four Thousand, One Hundred Seventy Dollars and Eight Cents ($54,170.08) iv. Year 2020—Fifty-Five Thousand, Seven Hundred Ninety-Five Dollars and Eighteen Cents ($55,795.18) b. Staffing. The Jeffersonville Police Department upon approval by the Board of Public Works will supply one police officer at Corden Porter School for a maximum of 180 days during each school year beginning with the 2017-18 school year which shall be identified as student days. i. The police officer shall not be an employee of the School Corporation or be entitled to any School Corporation benefits; but will remain an employee of the City of Jeffersonville. ii. The School Corporation shall reserve the right to participate and approve the selection of the police officer that will serve in this position and shall develop the job description/areas of responsibility for this position. iii. If the School Corporation determines that the services of the police officer selected are no longer acceptable, the School Corporation shall give notice to the City and a new officer shall be selected. iv. The officer selected for this position will remain in the position during the term of the agreement. In the event that the officer is sick, on vacation, or unavailable to work during the designated time period, an alternate officer will serve in the officer's absence. v. While on duty at Greater Clark,the officer's supervisor for performance of the job description or areas of responsibility will be the school's principal, or approved designees. vi. Time records for the days worked will be maintained by the City and the School Corporation to avoid reporting errors. b. Maintenance of Budget. The School Corporation shall maintain records of the budgeted funds for this undertaking. c. Supplying the Joint Undertaking. By the City providing a police/school resource officer to assist with security and traffic control and the School Corporation providing funding assistance in the manner set out above, the joint understanding will be accomplished. 4. METHODS THAT MAY BE EMPLOYED IN ACCOMPLISHING THE PARTIAL OR COMPLETE TERMINATION OF THIS AGREEMENT. This Agreement may be terminated at any time by either party upon thirty (30) days written notice by either party unless the termination is for cause, which shall cause the Agreement to immediately terminate. 5. ADMINISTRATION. This Agreement shall be administered jointly by the Chief of Police of the City of Jeffersonville and the School Corporation's Superintendent of Schools, or his designee. These individuals shall be authorized to perform all duties and carry out all functions as are necessary to effectuate the purpose of this Agreement. 6. ACQUIRING, HOLDING AND DISPOSING OF PROPERTY. This Agreement does not involve the acquiring, holding or disposing of property. 7. PAYMENT SCHEDULE. Payments as outlined in item 3.a. above shall be made on a quarterly basis. 8. APPROVALS. This Agreement has been approved by Resolution of the School Corporation at a public meeting of the Board of School Trustees on the 25th day of July, 2017, and has bee approved by the Common Council of the City of Jeffersonville on the 1 day of , 2017. With the approval by the City, efforts necess to begin this project shall be immediately commenced. 9. FILING. The parties agree that upon approval by the Board of Public Works and Jeffersonville Police Department, the City will record the Inter-Local Agreement with the County Recorder at the City's expense and will provide a recorded copy of the Agreement to the School Corporation. Within sixty(60) days of the date the Agreement takes effect, both parties shall file a recorded copy with the state board of accounts for audit purposes pursuant to IC 36-1- 7-6. IN WITNESS WHEREOF the parties have affixed their signatures hereto on the dates shown above in Paragraph 8 indicating their respective approvals of this Inter-Local Agreement in order to provide a school resource officer to assist with security at Corden Porter School and for traffic control as needed for the benefit of the School Corporation's students, employees, faculty and administrators along with the general public and citizens of Jeffersonville and surrounding communities. BOARD OF SCHOOL TRUSTEES FOR THE GREATER CLARK COUNTY SCHOOL CORPORATION r, I Christ na Gilkey, Presid nt Mark Pavey, Secretary COMMON COUNCIL OF THE CITY OF JEFFERSOVNILLE ouncil resident Clerk BOARD OF IC WORAS AND SAFETY CITY OF J F E SONVI E Mike Moore, ayor President Attt: —ix�- Clerk I affirm, under the penalties for perjury, that I have taken reasonable care to redact each Social Security number in this document, unless required by law: Prepared by: April Geltmaker Staff Attorney Greater Clark County Schools 2112 Utica-Sellersburg Road Jeffersonville, Indiana 47130 (812) 288-4802 RESOLUTION OF THE BOARD OF SCHOOL TRUSTEES FOR THE GREATER CLARK COUNTY SCHOOL CORPORATION APPROVING THE INTER-LOCAL AGREEMENT FOR JEFFERSONVILLE POLICE SERVICES AT CORDEN PORTER SCHOOL WHEREAS, IC 36-1-7 et al allows political subdivisions in the state of Indiana to enter into Inter-Local Agreements; and WHEREAS, the School Corporation desires to have a uniformed Jeffersonville Police Officer in and on the grounds of Corden Porter School to serve as a school resource officer and to provide additional security for the students, employees, faculty, and administrators along with the general public and citizens of Jeffersonville and surrounding communities; and WHEREAS, additionally, the School Corporation desires to have the assistance of a uniformed Jeffersonville Police Officer to assist with traffic control at this school or other school locations in the city of Jeffersonville, as needed, to ensure that traffic is adequately controlled before and after the school day; and WHEREAS, the City believes the use of police officer services by the Jeffersonville Police Department at Corden Porter School as additional security and for traffic control would be beneficial to the citizens of Jeffersonville and surrounding communities; and WHEREAS, the City has advised the School Corporation that there is not sufficient budgetary funding to fully fund the costs to place a police officer at Corden Porter School or other locations at the City's expense; and WHEREAS, the City reserves the right to perform an annual review of the cost factor; and WHEREAS, the School Corporation is willing to provide a portion of the financial assistance needed by the City to have a police officer available at Corden Porter School and for traffic control; and WHEREAS, the parties have expressed a desire to combine their resources to see that a Jeffersonville Police Officer is employed by the City to serve as a school resource officer and patrol the building and grounds of Corden Porter School to enhance security at said facility and to assist with the Greater Clark educational objectives, as needed, at this school or other school locations in the city of Jeffersonville; and WHEREAS, that said action would be done for the benefit of the school children, employees, faculty, and administrators of the School Corporation along with the general public and citizens of the City and surrounding communities. IT IS, THEREFORE, RESOLVED that the Inter-Local Agreement that is attached to and made a part of this Resolution as if set out herein in full (H.I. —Attachment A) is approved in accordance with its terms and conditions subject to approval by the appropriate City officials. SO RESOLVED AND DULY ADOPTED this 25th day of July, 2017, by the following vote of the members of said Board of School Trustees.
