HomeMy WebLinkAboutJUNE 19, 2017 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA June 19, 2017 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday,June 19, 2017. Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Councilperson Ellis gave the Invocation and Council President Gill asked those in attendance to recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson Jahn, Councilperson Maples, Council President Gill, Councilperson Owen, Councilperson Ellis, and Council Vice President Samuel. Councilperson Zastawny and Councilperson Hawkins were absent from the proceedings. MINUTES TO BE APPROVED: Minutes from the Council Regular Proceedings May 15, 2017—Councilperson Owen made a motion to APPROVE with Councilperson Jahn seconding, PASSING on a vote, 7-0. APPROVAL OF THE AGENDA: Councilperson Owen made a motion to APPROVE the agenda as amended with Councilperson Jahn seconding, PASSING on a vote, 7-0. CLAIMS TO BE APPROVED: Heather Metcalf, Controller presented the General Claims List. There is a hand carried claim in the amount of$317,308 and is for Travelers quarterly balance. New total is$1,404,896.76. Councilperson Jahn made a motion to APPROVE the General Claims with Councilperson Owen seconding, PASSING on a vote, 7-0. Councilperson Samuel asked if the bicycle repair on page three was under the right line. It is. Heather Metcalf, Controller presented the Parks Claims List. Councilperson Owen made a motion to APPROVE the Parks Claims with Councilperson Jahn seconding. Councilperson Ellis asked about the continuing payment to Dave Simpson, as he is now a City Employee. Controller Metcalf explained that these payments are for contracts that he received prior to being an employee and she will get a list of those contracts and how much longer each of them last. With a motion and a second already made the Parks Claims PASSED on a vote, 7-0. REPORT OF THE CLERK: Clerk Conlin attended the State Annual Convention. There were lots of interesting classes and good information regarding Internal Controls and Public Records. A representative from the local FBI discussed computer and cyber issues and also said they were more than willing to come work with local municipalities if they were needed. There are lots of upcoming changes with a new Budget director. Council President Gill asked if they brought up the Audit Board that is needed. She said she would like to use the Finance Committee for this. UNFINISHED BUSINESS: 1. LISA GILL-Heather Metcalf—PUBLIC HEARING 2017-OR-27 An Ordinance of Additional Appropriations (PASSED ON 1ST AND 2ND 6/5/17)—City Controller Heather Metcalf presented 2017-OR-27. There have been no changes. Council President Gill opened the Public Hearing at 7:11 PM and seeing as no members came forward Public Hearing was closed. Councilperson Owen made a motion to APPROVE 2017-OR-27 on the third and final reading with Councilperson Jahn seconding, PASSING on a vote, 7-0. 2. Lisa Gill -Vicki Conlin—2017-OR-28 An Ordinance Transferring Certain Funds within the Same Department(Police Merit Commission)(PASSED ON 1ST AND 2ND 6/5/17)—City Clerk Conlin presented 2017-OR-28. This is to move the$5000 from testing into advertisement for the Police Merit Board. Councilperson Owen made a motion to APPROVE 2017-OR-28 on the third and final reading with Councilperson Jahn seconding, PASSING on a vote, 7-0. NEW BUSINESS: 1. Lisa Gill -Les Merkley—Public Hearing 2017-OR-29 Ordinance Amending Ordinance 2015-OR- 58 The Jeffersonville Comprehensive Plan—City Attorney Les Merkley presented 2017-OR-29. This comes with a favorable recommendation from the Planning Commission. Planning and Zoning Director Nathan Pruitt is here to present the information. Mr. Pruitt stated there were some concerns with from the Residents and he has been working with the homeowners in the area this effects. This change changes it from primarily commercial to a Mixed Use with Residential. Council President Gill opened the Public Hearing at 7:29 PM. Karen Ellmers—2304 St. Andrews Rd.—Ms. Ellmers asked for a little additional time as the majority of the people who signed up to speak came with the same concerns and she would like to address it all at once. Their request boils down to one line of the proposal being removed on page 2. These parcels can be downzoned the way they are classified now and that doesn't need to change. This area has been the discussion at both Planning Commission and Drainage. Ms. Ellmers submitted a copy of the Hydrology Report for the Council to see. As neighbors they can't understand why they would make any of these changes when the drainage issues still have not been resolved. The problems need to be addressed and until then the area needs to have a hold put on it. Please eliminate the changes on Worhle Road before passing this Ordinance. Susan Stewart—2609 St. Andrews Rd.—Ms. Stewart had no additional comments. These properties are directly behind where she lives. Marth Chalfant—2304 St. Andrews Rd.—Now is not the time for this. We don't have a solution in place for the current flooding and now that the problem has been defined it needs to have a solution in place Joan Smith—2601 St. Andrews Rd.—Her home was built 30+years ago and the drainage issues have increased every single year. The drainage is dangerous if a child were to get caught up in the currents. She is not looking to move, she loves the neighborhood, and they just want to be treated fairly. The growth of the City has caused these problems and now it is time to fix them. Glenn Glad —2601 St. Andrews Rd.—They have great views and do not want to see any high rises in this area. They would like the area to remain the same. Planning and Zoning Director Nathan Pruitt stated this is really just to align what is there today with future land uses. He understands there are drainage issues and he will do whatever he can to assist. He offered to remove the statement in question at the Planning Commission but they chose to vote on it as it stood and pointed out that this was a 20 year plan. Council President Gill CLOSED the Public Hearing at 7:47 PM. Councilperson Maples made a motion to AMEND 2017-OR-29 striking through on Page 2 under the Veterans Parkway Area the second bullet point stating "Woehrle Road—Com and R to Mixed Use" with a second from Councilperson Owen, PASSING on a vote, 7-0. Councilperson Owen made a motion to APPROVE 2017-OR-29 as amended with Councilperson Maples seconding, PASSING on a vote, 7-0. Councilperson Owen said he has received plenty of emails on this area. The Drainage Board is looking into all of this and it is an ongoing discussion. He does not want to send the message that this area will not be developed because eventually it will. 2. Lisa Gill—Les Merkley—Public Hearing 2017-OR-30 Ordinance Amending Ordinance 2000-OR-61 The City of Jeffersonville Zoning Ordinance to Create a New Overlay District Titled the Quartermaster Summit Overlay District—Planning and Zoning Director Nathan Pruitt presented 2017-OR-30. This will enhance the aesthetics of the views. We need to promote and encourage walkability. Council President Gill opened the Public Hearing at 8:19 PM. Vicki Conlin—110 Cherokee Dr.—Thinks this is really great, it has the potential to really turn this area of town around. Public Hearing was closed at 8:21 PM. Councilperson Samuel made a motion to APPROVE 2017- OR-30 with Councilperson White seconding, PASSING on a vote, 7-0. 3. Lisa Gill—Len Ashack—2017-OR-31 An Ordinance Replacing Ordinance 2010-OR-40, Sewer Use and Pretreatment Ordinance for the City of Jeffersonville—This will not cause an increase to current users (unless they use more often). Councilperson Samuel made a motion to APPROVE 2017-OR-31 on the first reading with Councilperson Jahn seconding, PASSING on a vote, 7-0. 4. Lisa Gill—Heather Metcalf—2017-OR-32 An Ordinance of Additional Appropriation - Councilperson Owen asked if there had been additional discussion about sidewalks. He is not in favor of an additional appropriation for a sidewalk as the Council discussed earlier in the year those would only be addressed during Budget time. Councilperson Samuel made a motion to APPROVE 2017-OR-31 on the first with the understanding that this will be discussed further when Councilperson Zastawny returns. Councilperson Samuel rescinded his motion. Councilperson Owen made a motion to AMEND the ordinance removing the $120,000 amount for sidewalks. Councilperson White seconded the motion, PASSING on a vote, 7-0. Councilperson Owen made a motion to APPROVE 2017-OR-32 as amended with Councilperson White seconding, PASSING on a vote, 7-0. REPORT OF THE COUNCIL ATTORNEY Again thank you for the opportunity to be here. DEPARTMENT HEAD REPORTS: None at this time PUBLIC COMMENTS: See under New Business#1. COUNCIL COMMENTS: Councilperson White—Apologies to Councilperson Ellis. There was already a very detailed discussion during a public meeting regarding the sidewalk prior to him taking his Council seat. There is going to need to be funding for that. Also Mr. Pruitt thank you for the Master Plan updates and the Overlay Districts. Councilperson Jahn—The next meeting will be July 10th. Happy 4th of July. Councilperson Maples—Thanks to Mr. Pruitt for accommodating the concerns of the citizens. This is a great example of how it does not have to be an "all or nothing" mentality. Councilperson Owen—He also thanked Mr. Pruitt for his work. Planning and Zoning has been turning out great projects this year. Councilperson Ellis—Thank you to Councilperson White for explaining the information he had missed. He feels that Councilperson Zastawny should have an opportunity to discuss as well. Also he will do whatever he can to keep the two downtown schools from closing. School Board meeting is tomorrow night and he encourages everyone to attend. Council Vice President Samuel—Asked City Attorney Merkley if 819 Mechanic Street had been cleaned up. It has and was done the very next day. He looks for further discussion regarding the side walk appropriation. One of Councilperson Zastawny's big thing is sidewalks. Council President Gill—Drainage Ordinances will be updated soon and add to Ordinance Violations. Also she is very proud of JPD for their recent episodes on television.
