HomeMy WebLinkAboutJUNE 5, 2017 COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA June 5, 2017 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, 500 Quartermaster Court,Jeffersonville, Indiana at 7:00 pm, on Monday,June 5, 2017. Council President Gill along with City Clerk Conlin called the meeting to order at 7:00 pm. Councilperson Ellis gave the Invocation and Council President Gill asked those in attendance to recite the Pledge of Allegiance. ROLL CALL:The roll call was conducted and those present were: Councilperson White, Councilperson Zastawny, Councilperson Jahn, Councilperson Maples, Councilperson Hawkins, Council President Gill, Councilperson Owen, Councilperson Ellis, and Council Vice President Samuel. MINUTES TO BE APPROVED: Minutes from the Council Regular Proceedings May 1, 2017—Council President Gill stated on page 3 her name is spelled incorrectly. Councilperson Samuel made a motion to APPROVE the minutes with the noted change. Councilperson Jahn seconded, PASSING on a vote, 8-0-1 with Councilperson Maples abstaining as he was absent from the May 15, 2017 meeting. APPROVAL OF THE AGENDA: Council President Gill stated #15 would need to be removed. In the past this had to be renewed however it no longer does unless there is a change. Councilperson Jahn made a motion to APPROVE the agenda as amended with Councilperson Samuel seconding, PASSING on a vote, 9-0. CLAIMS TO BE APPROVED: Heather Metcalf, Controller presented the General Claims List. There is a hand carried claim in the amount of$100. Council President Gill stated there were small things when she was going through the claims that were all taken care of. New total is$8555,568.56. Councilperson Samuel made a motion to APPROVE the General Claims with Councilperson Jahn seconding, PASSING on a vote, 9-0. Heather Metcalf, Controller presented the Parks Claims List. Councilperson Samuel made a motion to APPROVE the Parks Claims with Councilperson Jahn seconding, PASSING on a vote, 9-0. REPORT OF THE CLERK: Clerk Conlin welcomed Councilperson Maples back. UNFINISHED BUSINESS: 1. LISA GILL-Sarah Green—2017-OR-23 An Ordinance Amending Ordinance 2016-OR-11 Which Amends Ordinance 2006-OR-14 The Ordinance Regulating the Treatment and Keeping of Domestic, Dangerous, and/or Vicious Animals within the City Limits of the City of Jeffersonville (Passed on 15L Reading 5/1/17, 2ND Reading 5/15/17—Sarah Green was not able to come this evening. City Attorney Les Merkley passed out the Ordinance that had been changed to reflect "peacock" as requested by the Council. Councilperson Zastawny made a motion to PASS 2017-OR-23 on the third and final reading with Councilperson Samuel seconding. Councilperson White asked if a change could be made. He would like to remove roosters and ducks from the Ordinance and change the limit of chickens from 5 to 10. Councilperson Zastawny rescinded his motion. Councilperson Jahn stated she would assume that Animal Shelter Director Green would approve the ordinance the way it was presented and not amended in any way. Councilperson Zastawny made the motion to AMEND 2017-OR-23 to remove ducks and roosters with Councilperson White seconding. A roll call was requested. Councilperson White—Yes Councilperson Zastawny—No Councilperson Jahn—No Councilperson Maples—Yes Councilperson Hawkins—No Councilperson Owen—Yes Councilperson Samuel—Yes Councilperson Ellis—Yes Council President Gill—No Ordinance was AMENDED on a vote, 5-4. Councilperson Zastawny made a motion to APPROVE 2017-OR-23 as amended with Councilperson White seconding, a roll call was requested. Councilperson White—Yes Councilperson Zastawny—No Councilperson Jahn—No Councilperson Maples—Yes Councilperson Hawkins—No Councilperson Owen—No Councilperson Samuel—No Councilperson Ellis—Yes Councilperson Gill—No Motion FAILED on a vote, 3-6. Council President Gill asked where this leaves the Ordinance. City Attorney Merkley will meet with Animal Shelter Director Green and discuss. 2. Lisa Gill -Heather Metcalf-2017-OR-25 An Ordinance Transferring Certain Funds Within the Same Department (Passed 1s'and 2nd 5/15/17)—City Controller Heather Metcalf presented 2017-OR-25. There have been no changes since the last meeting. Councilperson Owen made a motion to APPROVE 2017-OR-25 on the third and final reading with Councilperson Jahn seconding, PASSING on a vote, 9-0. 3. Lisa Gill -Heather Metcalf—PUBLIC HEARING -2017—OR-26 An Ordinance of Additional Appropriation (Passed 1St and 2nd 5/15/17—City Controller Heather Metcalf presented 2017- OR-26. This is for the safety improvements to the Animal Shelter. Council President Gill opened the Public Hearing at 7:27 PM and as no members of the community came forward to speak for or against the matter the Public Hearing was closed. Councilperson Ellis made a motion to APPROVE 2017-OR-26 on the third and final reading with Councilperson Samuel seconding, PASSING on a vote, 9-0. NEW BUSINESS: 1. Lisa Gill -2017-OR-27 An Ordinance of Additional Appropriations (Public Hearing 6/19/17)— City Controller Heather Metcalf presented 2017-OR-27. This is to cover a clerical error that was made. An additional appropriation was made a few weeks ago in the amount of$65000 and it should have been $68000. Councilperson Jahn made a motion to APPROVE 2017-OR-27 on the first and second reading with Councilperson Zastawny seconding, PASSING on a vote,9-0. 2. Lisa Gill—Vicki Conlin -2017-OR-28 An Ordinance Transferring Certain Funds within the Same Department(Police Merit Commission)—This money will be moved from testing where there is plenty of funds. Councilperson Samuel made a motion to APPROVE 2017-OR-28 on the first and second reading with Councilperson Jahn seconding, PASSING on a vote, 9-0. 3. Vicki Conlin—Council meetings in July—City Hall is closed on the first Monday and Tuesday of July. There are 5 Mondays in July. Move the meetings to the 10th of July and the 24th of July. Councilperson Owen made a motion to move the meetings with Councilperson Zastawny seconding, PASSING on a vote, 9-0. REPORT OF THE COUNCIL ATTORNEY Nothing at this time. DEPARTMENT HEAD REPORTS: None at this time PUBLIC COMMENTS: Michael Dees—2843 Brownsboro Rd. Suite 21—He is with AHS. He would like to thank the Council for approving the partnership. The County actually voted to join with the City and they are looking at another partnership as well. August 1" is the effective date for them to come on board. This should not affect scheduling time. Also there is a new NP at the location. She will start soon and until then it will be filled PRN. Council President Gill stated she would like to publically thank Connie Sellers for working with the County on this. (Issue was discussed on Video from 43:39-58:15. See video for full discussion) Lincoln Crum—813 Mechanic Street—There is a house close to him (819 Mechanic) where the landlord removed the tenant's belongings and it was a mess. It needs to be cleaned up properly. Additionally there is a house that has dogs that are in serious danger. They are chained up 24 hours a day. He has contacted the City in the past and nothing was ever done about it. It is his understanding that citations have been written. How can they ensure that these are enforced? City Attorney Merkley said this is the first the City has heard of this and it will be cleaned up by the end of the day tomorrow. There is a process that has to be followed. The City has not looked the other way. Mr. Crum stated he had emailed a complaint in August and it was never resolved. Robert Taylor—412 E. Maple Street Jeffersonville, IN - He did not evict anyone. The best that he could find out the tenant was deceased. He was not aware of the dogs, he just came down to clear up about the mess. He has already been in contact with the Street Department to come and remove the items. He felt the need to come and defend himself against being called a slumlord. Stacie Thompson—3120 Georgian Way Jeffersonville, IN -They have had an issue with drainage and she just wanted to come a publically thank the Council for resolving the matter, especially Councilperson Jahn for the work that she put in to get the issue resolved. Minutes to be Approved June 5, 2017 COUNCIL COMMENTS: Councilperson White—Abby Road on the River was a success this week. He did tell the individuals here tonight that a Council Meeting was a good place to have their concerns heard. He would like to see an Ordinance developed that sets guidelines for tenant/landlord relationships. Councilperson Zastawny—He is rooting for the Cavaliers. Councilperson Jahn—She commends the Parks Department for all of their work on Abby Road on the River. Also the Save the Fieldhouse Event was great, really successful. Councilperson Maples—Recognized the Police Department for their assistance to Clarksville PD. An issue that could have turned into a large problem was handled quickly and not escalated. Also he commends Bob Taylor for coming down to defend himself, sometimes things that are said are meritless. Councilperson Hawkins—Councilperson Hawkins congratulated the graduating class of Jeff High. This is a special class. If you've never been to Jeff High Graduation it is quite the event. Councilperson Owen—The event at Hoopsters was a huge success. The Authority is going to be doing a Breakfast event next on June 15th. Abby Road was very successful and a great event. He didn't get one complaint about the event. Councilperson Ellis—He is thankful for Councilperson Maples return. Council Vice President Samuel—Councilperson Samuel showed some of the Utility boxes that were painted this past weekend. They all look great, great job. Council President Gill—Sarah Green was tagged on Facebook regarding the dog issue that was previously spoke about during public comments. Animal Control Officers have been out there today. Also there was a report that was due to DLGF today and she wanted to make sure it was completed. City Controller Heather Metcalf stated it was.
