SANITARY SEWER BOARD
MINUTES OF MAY 18, 2017
The Sanitary Sewer Board of the City of Jeffersonville, Indiana met in regular
session on Thursday, May 18, 2017 at 3:00 P.M in the City Hall Mayor's Conference
Room. Mayor Moore called the meeting to order at 3:02 P.M. Board Members present
are Mike Moore, Bill Saegesser and Dale Orem. Also present are Utility Director Len
Ashack, Board Attorney Mike Gillenwater, Utility Billing Office Manager Elisha Dale,
Controller Heather Metcalf, Councilperson Lisa Gill, Jorge Lanz representing Jacobi,
Toombs, and Lanz, and Secretary Barbara Hollis.
Board Member Orem made the motion to approve the agenda as presented,
second by Board Member Saegesser, passing on a vote of 3-0.
The minutes of the May 4, 2017 meeting were presented for approval. Board
Member Saegesser, made the motion to approve the minutes as presented, second by
Board Member Orem passing on a vote of 3-0.
CONTROLLER'S REPORT
Controller Metcalf presented the claim list dated May 18, 2017 requesting the
addition of a claim to Watson Water in the amount of $2,500 and three claims to Mike
Gillenwater totaling $8,701 for an amended total of $1,928,538.21. Board Member
Saegesser, stating the majority of the total represents transfers and insurance, made the
motion to approve the claim list as amended, second by Board Member Orem, passing
on a vote of 3-0.
Manager Dale presented the Adjustment Certificate dated May 16, 2017 in the
amount of $-37,777.80 Sewage, $-989.03 Drainage. Board Member Saegesser, made
the motion to approve the Certificate as presented, second by Board Member Orem,
passing on a vote of 3-0. Director Ashack next said he received an email from City Clerk
Vicky Conlin that as of May 15, 2017 she would no longer sign the liens. Director Ashack
has researched the statute and Office Manager Dale checked with the State Board of
Accounts, and found that Manager Dale may sign liens.
OLD BUSINESS - No Old Business
NEW BUSINESS
Director Ashack has received a capacity request from Brandon Denton of Denton
Floyd Real Estate Group for the Villas of Jeffersonville on Peach Blossom Drive. The
total capacity fee for the request is $751,222.58 which can be paid building by building.

He noted the sewers can handle the amount requested. Mayor Moore asked if the
capacity fees are competitive. He was informed they are in line for the area. Board
Member Saegesser then made the motion to authorize Director Ashack to sign the
allocation request for the Villas of Jeffersonville, second by Board Member Orem, passing
on a vote of 3-0.
Director Ashack informed the Board the easement that the Liters Lift Station is in
needs to be widened. He is looking into the option of buying the whole parcel. Following
discussion, Director Ashack said he will research options and bring this back to the Board.
Director Ashack has met with the owner of the property at 350 Eastern Blvd.
regarding an outstanding due amount of $13,875. Director Ashack offered to accept half
the amount ($6,937.50). The Owner offered to pay $5,000. The hotel was closed in
2014. Director Ashack said the water was shut off in 2014. He also noted that a credit
of$9,414 was previously given. A lien was placed on the property last year. Following
discussion, Board Member Saegesser said he feels the offer of one half is more than fair
and that when the property sells the full amount will be received. The Board agrees.
ENGINEERING REPORTS - No Reports
DEPARTMENT REPORT
The response letter to EPA RE-FCA has been provided to the Board. Director
Ashack provided a map saying there will be 2,034 linear feet of 12-inch sewer (from Jeff
Boat to Kewanna Drive) on Utica Pike replaced. The curbs will have to be replaced. The
City does not have the ability to do curb replacement. He will get quotes and bring to the
next meeting. The April 2017 Monthly Operating Report is provided on CD. The 2017
Budget/Expense report is in the packet. The Sewer Use Ordinance Changes status
remains the same.
ATTORNEY COMMENTS
Board Attorney Gillenwater received a request for mediation from a T&C
Contracting representative. A trial is scheduled for July. The situation was discussed.
The estimate to repair the leaking at the manholes is $8,685. Jorge Lanz does not believe
a final bill for the project was ever submitted. The televised inspection shows that the 36-
in sewer line is in very good condition with no leaking joints, however every connection at
the manhole was leaking and needed to be repaired. Board Attorney Gillenwater stated
it is generally cheaper to go to mediation. Jorge Lanz feels the City owes nothing.
Board Attorney Gillenwater said the owner of Big Ben's BBQ was given 30 days
on May 20, 2017 to install a grease trap at the business. He has been informed Stemler
Plumbing is scheduled to do the work on May 24, 2017.

There being no further business to come before the Board, Board Member Orem
made the motion to adjourn at 3:32 P.M., second by Board Member Saegesser, passing
on a vote of 3-0. The next meeting is scheduled for June 1, 2017. Mayor Moore said he
will not be able to attend the next meeting.
