HomeMy WebLinkAbout06-17-1989COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JUNE 17, 1989 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Mayor's Conference Room, in the City-County Building in Jeffersonville, Indiana, on the 17th day of June 1989, at 9:30 o'clock A.M. The meeting was called Richard Spencer Jr. at the desk. Mayor Orem asked all allegiance to the flag. Carter, to order by Mayor Dale Orem and C. those present to stand and pledge The roll was called and those present were: Councilmen Caldwell, Grooms, Harrod, Perkins, Waiz, and Williams. Mayor Orem presented the minutes of the meeting of June 5, 1989 for consideration motion to approve the President Harrod and carried unanimously. Councilman Williams introduced Ordinance No. Ordinance Rezoning Certain Property From R-2 Residential, by the Council. Councilman Perkins made the minutes as presented, seconded by Council 89-OR-20, An to ~-2 Service Business for the third and final reading. Councilman Perkins stated he had talked with some of the residents in the area as well as Mr. Wells who has agreed to a wood screen fence and lighting that will not shine into the homes of the residents. Councilman Perkins found the residents feel good about Mr. Wells as a neighbor and this is a compromise all can live with. Council President Harrod made the motion to pass Ordinance No. 89-OR-20 on the third reading, seconded'by Councilman Carter and on a vote of 6-1. Councilman Williams cast the negative carried vote. Councilman Williams introduced Ordinance No. Ordinance Rezoning Certain Property From R-2, Residential, Business. rezoning. Ordinance 89-OR-30, An to B-i, Local Attorney Michael Maschmeyer explained the need for this Councilman Perkins made the motion to suspend the rules on No. 89-OR-30, seconded by Councilman Grooms, and carried unanimously. Councilman Perkins then made the motion to pass Ordinance No. 89-0R-30 on all three readings, seconded by Councilman Carter and carried with a unanimous vote. PAGE 2 JUNE 17, 1989 Councilman Caldwell introduced Ordinance No. 89-OR-31, an Ordinance Vacating A Portion Of An Alley, City Of Jeffersonville. Attorney Allen Morris informed the Council regarding the need for this Ordinance. Councilman Perkins made the motion to suspend the rules on Ordinance No. 89-OR-31, seconded by Council President Harrod and unanimously carried. Councilman Perkins made the motion to pass Ordinance No. 89-OR-31 on all three readings, seconded by Council President Harrod and carried unanimously. Mayor Orem introduced Resolution No. 89-R-12, A Resolution Regarding The Purchase of Real Property For The Use And Benefit Of The Jeffersonvi!le Fire Department. Mayor Orem explained the property is approximately 3/4 acre at the corner of Hamburg Pike and Truckers Boulevard. The road will be built to State specifications. The two appraisals were done using differing comparables, one was for $19,000 and the other $75,000. Following all discussion, Council President Harrod made the motion to pass Resolution No. 89-~R-12, seconded by Councilman Carter and carried unanimously. City Attorney Filer brought the Council up to date on the progress of the negotiations for a lease with the Hughes Group. Due to the many individuals involved it appears a final draft will be available July 1 and will be on the agenda for Council consideration July 5. Councilman Perkins made the motion to allow an additional 30-day continuance, seconded by Council President Harrod and carried unanimously. The Council and Mayor agreed to adjourn to Executive Session to discuss salaries and personnel at 9:55 A.M. Mayor Orem callled the meeting back to order at 11:40 A.M. at which time committment. Ordinance No. Portions Of Section 1 Of Councilman Grooms asked to be 89-OR-33, An Ordinance No. excused to honor a previous Ordinance Amending Certain 88-OR-34 was introduced and discussed. Councilman Perkins made the motion to suspend the rules on Ordinance No. 89-OR-33, seconded by Councilman Carter and carried unanimously. Councilman Perkins then made the motion to pass Ordinance No. 89-OR-3~ on all three readings, seconded by Councilman Waiz with the following roll call vote being recorded: PAGE 3 JUNE 17, 1989 Williams. Ayes: Councilman Perkins, Carter, Waiz, Harrod, Caldwell, and Nays: None. Ordinance No. 89-OR-34, An Ordinance Transferring Certain Funds Within Same Department (Vehicle Maintenance) was introduced and explained. Following all discussion, Councilman Perkins made the motion to suspend the rules on Ordinance No. 89-OR-34, seconded by Council President Harrod and carried unanimously. Councilman Perkins made the motion to pass Ordinance No. 89-OR-34 on all three readings, and carried with the following roll call vote: Ayes: Councilman Harrod, Caldwell, Williams, Waiz, Carter, and Perkins. Nays: None. Council President Harrod introduced Ordinance No, 89-OR-32, An Ordinance For An Additional Appropriation from the General Fund and the Cumulative Capital Improvement Fund. Councilman Carter made the motion to suspend the rules for Ordinance No. 89-OR-32, seconded by Council President Harrod and carried unanimously. Councilman Carter then made the motion to pass Ordinance No. 89-OR-32 on all three readings, recorded: seconded by Councilman Waiz, with the following roll call vote Ayes: Councilmen Carter, Waiz, Perkins, Caldwell, Williams, and Harrod. Nayes: None. Mayor Orem introduced Ordinance Transferring Certain No. 89-OR-25, Funds Within The Same Department Councilman Williams made the motion An Ordinance (Sanitation). to amend this Ordinance to $27,000, by Councilman Waiz and carried unanimously. PAGE 4 JUNE 17, 1989 Clerk and Treasurer Spencer presented the register of claims as well as several additional claims that were explained and discussed. Councilman Perkins made the motion to approve the claims as presented as well as the additional claims excluding the claim for B.F.I., seconded by Councilman Harrod and carried by a vote of 5-1. Councilman Waiz voted in oppossition stating he felt all claim should be paid. Councilman Caldwell regarding a letter he received This letter has to do with the claims including the B.F.I. requests a meeting with the Mayor from Designs By Cook, 1105 East 10th. a concept for the development of Jeffersonville. Councilman Caldwell has been asked by Bob Hedge, 500 Mockingbird to have the catch basin behind his house looked at as he is concerned for the safety of the children in the neighborhood. Building Commissioner Scales will look at this. Councilman Williams informed the Council he will be unable to attend the July 18 and July 19 budget meetings as he will be out of town. Councilman Williams has received complaints on a pallet company on Mitchell. Commissioner Scales and Attorney Filer are working on this. Councilman Williams also questioned an import car business on Mitchell not being in compliance with regard to paving. There was general discussion on the enforcement of paving. Commissioner Scales will call this particular company. Councilman Caldwell asked to be excused to honor a previous committment at this point. Councilman Perkins complimented Councilman Waiz with regard to the wedding of Rob Waiz. Councilman Perkins asked if something'was being done about the Allen house on Meigs Avenue as he feels it is a health and safety hazard and would like to see it down. Attorney Filer will start the proper legal work and Commissioner Scales will get quotes on the demolition of the house. Councilman Perkins complimented Street Commissioner Hemingway on the great job he is doing. He has had occassion to call on the street department and appreciates the response. The alleys are clean and the crews are out quickly when asked. Councilman Waiz stated although he did vote to pay the claim he would still like to see all figures involved. Attorney Filer has been asked by the County if the City would be interested in a joint purchase of the property across from the Watt Street entrance to the City-County Building to increase parking. The property has been appraised would not exceed $30,000. into. Councilman Perkins and the City portion, on a 2/3 - 1/3 basis Councilman Carter feels it should be looked agreed asking for a stipulation for some reserved parking Building Commissioner and the Fire Marshall. Clerk and Spencer recommends that other lots in the area be looked at Councilman Perkins, with Clerk and Treasurer Spencer's help, to the County. Visslng Memorial Park and have a dedication ceremony inviting the Visslng family as honored guests. Mrs. Fredericks asked to have answers to some questions. Her first question referred to an article in the Courier Journal of June 15 regaring the boat ramp at the end of Spring Street. Mayor Orem informed her the Spring Street ramp will remain for commercial use and Duffy's Landing is being constructed for pleasure craft where there will be adequate parking. This decision was made by the Mayor of Jeffersonville on December 31, 1984. Mrs. Fredericks asked if the Water Park Grant has been received. Mayor Orem informed her it is being applied for. Information is available through the Army Corps of Engineers and is public record.
