Mayor Orem asked all COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA DECEMBER 19, 1990 City of Jeffersonville, Indiana met Building in Jeffersonville, at 7:30 o'clock P.M. by Mayor Dale Orem and C. Absent: Councilperson Tony Harrod. Mayor Orem presented the minutes of the meeting of December 12, 1990 for consideration by the Council. Councilperson Carter made the motion to approve the minutes as presented, seconded by Councilperson Williams and carried unanimously. Mayor Orem introduced Ms. Susan Williams, Sellersburg Town Attorney~ and Mr. Roy Everett~ Sellersburg Town Council Member, who spoke regarding Resolution No. 90-R-48, A Resolution Granting Consent To The Town Of Sellersburg, Indiana~ To Annex Territory Within Three (3) Boundaries Of The City Of Jeffersonville, Sellersburg will not annex the airport. Councilperson Perkins made the motion to pass seconded by Councilperson Grooms and carried A Resolution Right-Of-Way to explain. Miles Of The Corporate Indiana. No. 90-R-49, In Purchasing Attorney Filer Mayor Orem introduced Resolution Designating The Common Council's Interest Rights Over Certain Real Property, asking Following all discussion, Councilperson Perkins made the motion to pass Resolution No. 90-R-49, seconded by Councilperson Carter, passing unanimously. PAGE 2 DECEMBER 19, 1990 Ordinance No. 90-0R-84, An Ordinance Transferring Certain Funds Within Same Department was presented for discussion. Clerk and Treasurer Spencer explained the Ordinance answering questions. Councilperson Perkins feels the sidewalk on Mechanic Street next to the Nachand Fieldhouse is a dangerous situation and definite liability and would like to see this taken care of. This will be considered when the weather is appropriate. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 90-0R-64, seconded by Councilperson Clapp and carried unanimously. Councilperson Perkins made the motion to pass Ordinance No. 90-OR-64 on all three readings and also to give Clerk and Treasurer Spencer the authority to add to this as he sees to end the year, seconded by Councilperson Clapp, passing on following roll call vote: Ayes: Councitpersons Perkins, Waiz, Clapp, Williams, Carter, and Grooms. Nays: fit the the note that is due January 1, 1991. Attorney Filer feels Redevelopment may make this payment if permitted to use the $44,000 balance. Councilperson Grooms will act as liaison on this matter. Following all discussion Councilperson Perkins made the motion to approve all the claims presented, as well as give Clerk and Treasurer Spencer authority to pay those claims necessary for the end of the year, seconded by Council President Waiz, and carried unanimously. Councilperson Grooms asked Vehicle Maintenance Director Wathen to explain a situation. Director Wathen explained he would like the authority to order a $3,500 computer this year, to be paid for from his 1991 budget through transfers as the price will increase in January. Following all questions, all on the Council agreed to this request. Councilperson Grooms then asked Director Wathen for a December 31, 1990 inventory of supplies. Councilperson Grooms feels this is important to have this information~especially for budgets next year. Director Wathen intends to submit a total report after the first of the year. Councilperson Williams inquired if any other department employees None. Clerk and Treasurer Spencer presented the claim register, and several additional claims for consideration by the Council. Councilperson Perkins would like to give Redevelopment the chance to pay PAGE 3 DECEMBER 19, 1990 could handle Director Wathen's job. Councilperson Perkins made many points including the point that Ms. Jan Wheatley has done a great job as she is running one of the finest animal shelters in the State of Indiana, concluding it is time to draw the line. Councilperson Carter made the motion to accept no County animals after midnight, December 317 1990, seconded by Councilperson Perkins. Many alternatives to this were discussed~ following which it was determined to call a meeting of all those involved for December 27~ 1990 at 5:00 o~clock P.M. in the Mayor's Conference Room to discuss the situation. After all discussion, Councilperson Carter's motion passed with a 5-1 vote. Councilperson Grooms voted against the motion. Councilperson Williams called attention to the calendar of Council meetings stating he will not be able to make the January ?~ 1991 meeting. He is unhappy with the situation surroundin~ the water slide contract and does not want to see this happen again. Mayor Orem explained the reason, agreeing it did not turn out well. The Parks Department as well as all department heads will be instructed to come to the Council before entering any contracts. Councilperson Grooms called attention to the good job done on the Parks Department brochure. He then informed the Council the Convention Center Study Committee will begin monthly meetings in January in conjunction with the Ramada Inn and the DeMars group. Mayor Orem explained the Wastewater Treatment Plant bonds were sold today at a rate of 6.87%. This rate is lower than anticipated with credit going to having a full-time attorney~ and using a local bonding attorney. The groundbreaking for the DeMars project will be held December 20, 1990 and all are invited to attend. The asbestos removal PAGE 4 DECEMBER 19, 1990 is proceeding at the location of the new Wastewater Treatment Plant and this area has been marked with yellow tape. Lab reports on the roof section showed less than 1% asbestos. This is not a health hazard to the public. Mayor 0rem asked the Council to speak with the State Legislators regarding a bill for Cities and Towns to receive a share of lottery proceeds. He followed with comments that the State will be requiring more financially from cities and towns. Councilperson Perkins suggests a reception in conjunction with Clarksville for Legislators. I.A.C.T. Legislative Day will be February 13, 1991. The Chamber breakfast will be January 19, 1991 and this will be another time to make known feelings on this. Councilperson Carter questioned Parks Superintendent Caldwell on the Nachand Fieldhouse boiler. Superintendent Caldwell replied nothing has been confirmed, however it appeares it would be O.K. and it is hoped to have it functioning by Friday, December 21, 1990. Councilperson Carter asks no activities be held in the fieldhouse until this time. Councilperson Perkins informed the Council the Jeff-Clark Preservation Group is ready to sign the papers to sell the Maschmeyer House so this will soon be on the tax roles. Mayor Orem said he had hired a City Santa Clause for five days and has never received so many positive phone calls. Councilperson Carter made the motion to continue with this until Christmas, seconded by Councilperson Grooms and carried unanimously. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 9:35 P.M., seconded by Councilperson Carter and carried unanimously. ATTEST:
