HomeMy WebLinkAbout10-17-1990COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA OCTOBER 17, 1990 The Common Council of the City of Jeffersonville, Indiana met Council Chambers, in the City-County Building in Jeffersonville, in Indiana, on the 17th day of October, 1990, at 7:30 o'clock P.M. The meeting was called to order by Mayor Da~e Orem. The invocation was given by Reverend Joyce Seeman. Mayor Orem asked all those present to stand and pledge allegiance to the flag. The Jimmy Carter, Robert Waiz. Absent: Councilperson Andrew Williams. Mayor Orem presented the minutes of the meeting of October 1, roll was called and those present were: Councilpersons Marie Clapp, Ron Grooms, Tony Harrod, John Perkins, and Councilperson Harrod made the motion to approve the minutes as presented, seconded by Councilperson Grooms and carried unanimously. The claim register and several additional claims were presented for consideration by the Council. Following all discussion Councilperson Perkins made the motion to approve the claims as presented as well as the additonal, seconded by Councilperson Clapp and carried unanimously. Councilperson Grooms presented a United States Flag, as well as a certificate stating the flag had flown over the Capital Building in Washington D.C. on August 24, 1990 on the request of Senator Dan Coates, to Council President Waiz and the Council. Councilperson Grooms will have the certificate framed for hanging in Council Chambers. Mayor Orem informed the Council the bond council was unable to complete Project, the Ordinance for financing the Wastewater Treatment therefore this will have to be taken up at another time. PAGE 2 OCTOBER 17, 1990 In order to open the Ordinance for discussion, Councilperson Perkins made the motion to pass, on the first reading, Ordinance No. 90-OR-48, An Ordinance Vacating A Portion Of Nole Drive, seconded by Councilperson Barrod, and opened for discussion. At this point Attorney for the Petitioners, David Lewis, asked that the petition vacating a portion of Nole Drive be withdrawn. Councilperson Perkins called for the question for the Ordinance on the floor. There followed a discussion as to whether the Ordinance could be voted on with the petition withdrawn. Councilperson Perkins wants the vote taken and the matter closed urging the Council not to accept another petition or have it on the agenda. Following all discussion, the question was called for on Ordinance No. 90-OR-48. The Ordinance failed on a vote of 0-7. This drew applause from the crowd in attendance. A recess was called for and granted at 7:45 o'clock P.M. The meeting was called back to order at 8:10 o'clock P.M. Mayor Orem presented Ordinance No. 90-OR-49, An Ordinance Creating Revolving Economic Development Fund For The City Of Jeffersonville, Indiana. Councilperson Perkins inquired, and Mayor Orem explained the committee selection method. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 90-OR-49, seconded by Councilperson Grooms, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 90-OR-49 on all three readings, seconded by Council President Waiz, passing on the following roll call vote: Ayes: Councilpersons Perkins, Waiz, Clapp, Williams, Carter, Harrod, and Grooms. Nays: None. Councilperson Grooms introduced Ordinance No. 90-OR-50, An Ordinance Amending Chapter 75 Of The Jeffersonville City Code In Establishing A "No Parking Zone" Within The City Of Jeffersonville, for PAGE 3 OCTOBER 17, 1990 consideration by the Council. Councilpersons Perkins and Clapp expressed concerns for the residents on the North side of 8th Street. Following all discussion, Councilperson Carter made the motion to table Ordinance No. 90-0R-50 until the next regular Council meeting, seconded by Councilperson Grooms, volunteered to go door to area. Mayor Orem introduced Ordinance No. passing unanimously. Councilperson Clapp door to obtain the opinion of those in the 90-OR-51, An Ordinance of Additional Appropriation. Councilperson Perkins questioned the need for the additional overtime in the Fire Department. Fire Chief Collins explained this has been caused by the opening of the third firehouse, an unusual amount of sickness, a broken bone, and surgery. Councilperson Perkins feels there is a need to look at the overtime situation in the future. Chief Collins assurred Councilperson Perkins no time off is given for extra chores performed during duty hours. Following all discussion Councilperson Perkins made the motion to pass Ordinance No. 90-0R-51 on the first and second reading, seconded by Councilperson Grooms. Following further discussion, Councilperson Grooms withrew his second and Councilperson Perkins withdrew his motion. Councitperson Perkins then made the motion to suspend the rules for Ordinance No. 90-OR-51, seconded by Councilperson Clapp, passing with a unanimous vote. Councilperson Perkins then made the motion to pass Ordinance No. 90-OR-51 on all three readings, seconded by Councilperson Clapp, passing with the following roll call vote: Ayes: Councilpersons Grooms, Harrod, Carter, Williams, Clapp, Waiz, and Perkins. Nays: None. Mayor Orem introduced Ordinance No. 90-OR-52, An Ordinance Transferring Certain Funds Within Same Department, for consideration by the Council. Questions were raised and answers given for several of the transfers. Mayor Orem stated the City is "running lean", and the increase in gas prices has been hard on the budgets. Councilperson Perkins remains upset with the unaccounted for gasoline. Councilperson Carter made the motion tO suspend the rules for Ordinance No. 90-0R-52, seconded by Councilperson Clapp and carried unanimously. Councilperson Grooms asks that the Mayor, through the Board of Works, set up a specific task force to address traffic problems, specifically speeding, stop sign violations, etc., particularly on Sportsman and Tall Oaks. Councilperson Grooms reported on a meeting held with representatives of the medical staff, hospital staff, and Mr. Cooper, regarding self'funded insurance. He has been told this meeting went extremely well and it appears the bidders for the administration of this will be Humana, Blue Cross, and numerous others. Councilperson Grooms strongly objects to an Evening News article that referred to an "illegal council meeting". The media was notified of this meeting. The meeting started at 7:00 o'clock P.M. and Councilperson Grooms did not arrive until 7:20 o'clock P.M. and the door was not locked. ~e also justified the location. Mayor Orem told Mr. Coffey of a plant in Tennessee that has $200,000 home built around it. He also stated he feels the new plant will be an enhancement to the area over what is there now. Council President Waiz stated he personally has sold $100,000 homes over and over again within 20 feet of the Oak Park treatment plant. Attorney Filer feels there may be a probetem during the construction period, however compensation would be considered when and if there is a problem after the plant is complete. Commissioner Scales suggests having apprailsals done now. Mr. Coffey stated is having one done. Councilperson Perkins referred to the sidewalk program saying there were more requests than money this year and he would like to ask the Council for an additional $5,000 this year either through additional appropriation or transfer. This will be considered. The meeting advertised for October 18, 1990 will not be held, however there will be meetings advertised for October 24 and October 25, 1990 at 7:30 o'ctock P.M. Councilperson Perkins made the comment heads he has been dealing with are "working their that the department tails off", and have been real responsive. It the Council. Mayor Orem then announced he had signed an agreement with the County regarding the court room situation. City Court Judge Lindsey will be moving into Council Chambers and the County wilt pay the moving expenses. Mayor Orem stated he has discussed this with some of the PAGE 6 OCTOBER 17, 1990 Council, and it became a position that nobody could solve anything, especially on the animal shelter. This is a two-department goal of saving money for the taxpayer.
