HomeMy WebLinkAbout08-01-1990COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA AUGUST 1, 1990 The Common Council of the City of Jeffersonville, Indiana met in regular session in Council Chambers, in the City-County Building in Jeffersonville, Indiana, on the 1st day of August, 1990, at 7:30 o'clock P.M. The meeting was called to order by Mayor Dale Orem and C. Richard Spencer Jr. at the desk. Mayor Orem asked all those present to stand and pledge allegiance to the flag. The roll was called and those present were: Councilpersons Jimmy Carter, Marie Clapp, Ron Grooms, Tony Harrod, John Perkins, Andrew Williams, and Robert Waiz. Absent: None. Mayor Orem presented the minutes of the meetings of July 10, and July 16, 1990 for consideration by the Council. Councilperson Harrod made the motion to approve the minutes as presented, seconded by Councilperson Carter and carried unanimously. Clerk and Treasurer Spencer presented the claim register, and several additional claims for consideration by the Council. Attorney Filer also presented a claim from Wolf Glass explaining this was for repairs to damage done by the SWAT Team in an incident some time ago. The incident and surrounding circumstances in the collection of this bill were discussed. Councilperson Grooms made the motion to pay $400 of this claim. Motion died due to no second. Councilperson Perkins made the motion to table this claim until the next meeting in order to gain further information, seconded by Councilperson Harrod and carried on a vote of 6-1, with Councilperson Grooms voting no. Following all discussion Councilperson Perkins made the motion to approve all the claims presented by Clerk and Treasurer Spencer, seconded by Councilperson Harrod and carried unanimously. Councilperson Perkins asked Attorney Filer to prepare a Resolution, or an Ordinance, directing Redevelopment to repay the City for loan funds beginning with the first payments from DeMars. He wishes the City be paid back entirely before any of the DeMars money is used in any other manner. This was discussed and Attorney Fifer will work to see what can be done. PAGE 2 AUGUST 1, 1990 Mayor Orem introduced Ordinance No. 90-OR-34, An Ordinance Regarding Financing Of Police Radio, asking Assistant Chief Johnson if the system is 100% installed and working. Assistant Chief Johnson explained the system is working, however not at 100%. Certain parts should be in by the end of August and 100% is expected at that time. Some officers are experiencing problems with keeping the batteries charged. Following discussion of this, Councilperson Perkins suggested purchasing additional batteries. This will be considered. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 90-OR-84, seconded by Councilperson Carter and carried unanimously. Councilperson Perkins made the motion to pass Ordinance No. 90-OR-34 on all three readings, seconded by Councilperson Waiz, passing on the following roll call vote: Ayes: Councilpersons Grooms, Harrod, Carter, Williams, Clapp, Waiz, and Perkins. Nays: None. Councilperson Perkins asked that no payments be made to General Electric until there is 100% safisfaction as agreed upon in the contract. Mayor Orem presented Ordinance No. 90-OR-35, An Ordinance Establishing A Nonreverting Fund For The Purposes Of Receiving Donations On Behalf Of The Jeffersonville-Clark County Animal Shelter. Following discussion, Councilperson Harrod made the motion to suspend the rules for Ordinance No. 90-OR-35, seconded by Councilperson Clapp and carried unanimously. Councilperson Harrod made the motion to pass Ordinance No. 90-OR-35 on all three readings, seconded by Councilperson Williams, passing on the roll call vote as follows: Ayes: Councilperson Carter, Harrod, Grooms, Perkins, Waiz, Clapp, and Williams. Nays: None. Mayor Orem introduced Ordinance No. 90-OR-37, An Ordinance Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 1991. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 90-OR-37, seconded by Councilperson Harrod and carried unanimously. Councilperson Perkins PAGE S AUGUST 1, 1990 made the motion to pass Ordinance No. 90-OR-37 on all three readings, seconded by Council President Waiz, passing with the following roll call vote: Ayes: Councilpersons Waiz, Perkins, Harrod, Carter, Williams, and Clapp. Nays: Councilperson Grooms. Mayor Orem introduced Ordinance No. 90-OR-36, An Ordinance Transferring Certain Funds Within Same Department. Council President Waiz made the motion to suspend the rules for Ordinance No. 90-OR-36, seconded by Councilperson Clapp and carried unanimously. Council President Waiz made the motion to pass Ordinance No. 90-OR-36 on all three readings, seconded by Councilperson Clapp, passing on the following roll call vote: Ayes: Councilpersons Clapp, Williams, Carter, Harrod, Grooms, Perkins, and Waiz. Nays: None. Mayor Orem presented Ordinance No. 90-OR-32, An Ordinance Reducing Budgets Per State Of Indiana Tax Commission Order. Clerk and Treasurer Spencer explained this Ordinance, following which Councilperson Carter made the motion to suspend the rules, seconded by Councilperson Harrod and carried unanimously. Councilperson Carter made the motion to pass Ordinance No. 90-OR-32 on all three readings, seconded by Councilperson Grooms, passing on a unanimous vote. Council President Waiz introduced Ms. Ruth Fredericks who asked the agenda and copies of Ordinances and Resolutions be made available to the public in advance of the meetings and that a portion of the meeting be open for public input. She complimented the Council for the last meeting. She is also concerned about the rescheduling of meetings and the newspaper publishing this. She will be calling the newspapers. Discussion was held and suggestions were made. Ms. Fredericks was thanked for her interest in the City and the Council. Councilperson Harrod asked to be excused at 8:35 P.M. Councilperson Perkins has discussed the possibility of hospitalization self-insurance for the City with Mr. Cooper, the Agent of Record. This is being researched and there is an interest from PAGE 4 AUGUST 1, 1990 Clarksville and Salem to join in this group. Attorney Fifer reminded the Council the City is mandated to offer a Federally approved PLMO program. Mr. Cooper would like to address the Council. Attorney Filer will get proposals from 2 or 3 third party administrators. Due to the fact that budget hearings must be held at directed times, the regularly scheduled meeting for August 18, will be held August 20, 1990, and the September 3, meeting will be held August 27, 1990. As the result of the budget worksessions, Councilperson Grooms made the motion to advertise the 1991 tax rate of $5.437 with public hearings to be held August 20 and August 27, 1990, seconded by Councilperson Clapp, passing unanimously. Councilperson Perkins informed the Council it looks like there may be some Federal rate regulations in the future for Cable Television. He will be calling Congressman Hamilton, and Senators Coats and Lugar to encourage this and asks other Council to do the same. Councilperson Perkins asks that Attorney Filer look into the current cable franchise regarding the length of the contract so that other bids may be accepted. Councilperson Clapp has been working with Building Commissioner Scales on the purchase of a vehicle. A significat savings can be obtained by purchasing now rather than after the first of the year. Clerk and Treasurer Spencer said there is approximately $10,000 available in the Cumulative Commissioner Scales will get arrangements may be made. Councilperson Grooms Capital Development Fund at this time. with the dealer to see what type of announced a Convention Center Committee meeting for August 16, 1990 at ?:30 P.M. at the Ramada. The concept of a MuseUm/Meeting Room building and alternate sites will be discussed. The committee has until April of 1991 to go ahead with plans or the land will go back to DeMars to develop. Councilperson Grooms brought up the subject of redistricting. Due to annexation, growth, and changes in precincts he recommends the drawing of new districts. Councilperson Perkins has been researching this also. Councilperson Grooms mentioned he had suggested last January there be a public comment period at ~he end of each meeting. He would PAGE 5 AUGUST 1, 1990 like to see the Ordinances and Resolutions available through the Clerk and Treasurer's Office or the Library several days prior to the meetings. Ms. Jean Burke inquired if the Mayor or Council had information regarding a newspaper article that outlined plans for a tram over the river. The gentleman that is proposing this project will be in to see the Mayor in the next two week. Councilperson Carter feels the Corps of Engineers will not allow this. Attorney Filer explained newspaper reporters have told him they cannot find information as to where the funding for this project will come from. Building Commissioner Scales presented copies of the revised City of Jeffersonville Zoning Code manual asking they look this over in the next 30 days. Mayor Orem complimented Building Commissioner Scales on being asked by the Chairman of the Board of the International Council of Building Officials to run for a position to represent Indiana. The Council will support his election by letter. Councilperson Clapp congratulated Commissioner Scales on this honor. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 9:35 PoM., seconded by Council President Waiz and carried unanimously. ATTEST: C.
