HomeMy WebLinkAbout06-04-1990COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JUNE 4, 1990 The Common Council of the in regular session in Council Chambers, in the Jeffersonville, Indiana, on the 4th day of June, P.M. The meeting was called Richard Spencer Jr. at the desk. Mayor Orem asked all allegiance to the flag. City of Jeffersonville, Indiana met City-County Building in 1990, at 7:30 o'clock to order by Mayor Dale Orem and C. those present to stand and pledge The roll was called and those present were: Councilpersons Jimmy Carter, Marie Clapp, Ron Grooms, Tony Harrod, John Perkins Jr., Andrew Williams, and Robert Waiz. Absent: None. Mayor Orem presented the minutes of the meeting of May 19, Council. Councilperson Narrod made the as presented, seconded by Councilperson 1990 for consideration by the motion to approve the minutes Carter and carried unanimously. Discussion followed regarding claims that will be presented for payment at a following meeting for appraisal work done by Chapman and Company. One for $3,800 for the proposed golf course land, and one for land in front of French Quarter Apartments that may be donated to the City. Attorney Filer indicated the intention is to recover the fees for the golf course Approving Abatement Mullins of Ashley equipment which has Waiz feels there appraisal. Following all discussion, Councilperson Harrod made the motion to pass Resolution No. 90-R-29, seconded by Councilperson Williams and carried unanimously. Mayor Orem presented Ordinance No. Appropriation Ordinance. Clerk and Treasurer 90-0R-22, An Additional Spencer explained each line item, indicating it would not be necessary to include the Cumulative Capital Improvement Fund appropriation for Firehouse III as this has been taken care of. This is declared a public hearing and input was called for from any taxpayer. There being none, Councilperson Carter made the motion to suspend the rules for Ordinance No. 90-OR-22, seconded by Council President Waiz and carried unanimously. Councilperson Carter then made the motion to pass Ordinance No. 90-OR-22 on all three readings with the exception of the $30,000 from the Cumulative Capital Improvement Fund, seconded by Council President Waiz, passing on the following roll call vote: Ayes: Councilperson Grooms, Williams, and Clapp. Nays: None. Mayor Orem presented Ordinance Perkins, Waiz, Harrod, Carter, No. 90-0R-23, An Additional Appropriation Ordinance. Clerk and Treasurer Spencer explained this Ordinance also. Attorney Filer will ask the Parks Department to pass a Resolution stating the Duffy's Landing Project Grant money, when received, will be returned to the appropriate fund. This also is declared a public hearing and input was called for from any tapayer. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 90-OR-23, seconded by Councilperson Harrod and carried unanimously. Councilperson Perkins made the motion to pass Ordinance No. 90-OR-23 on all three readings, seconded by Council President Waiz, passing with the following roll call vote: Ayes: Councilpersons Clapp, Perkins, and Waiz. Nays: None. Reserving Williams, Carter, Harrod, Grooms, Mayor Orem introduced Ordinance No. 90-OR-24, An Ordinance And Specifying The Use Of Signal 19 Monies Within The PAGE 3 JUNE 4, ~990 Jeffersonville Police Department. Following all discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 90-OR-24, seconded by Councilperson Harrod and carried unanimously. Councilperson Perkins made the motion to pass Ordinance No. 90-OR-24 on all three readings, seconded by Councilperson Harrod, passing with the following roll call vote: Ayes: Councilpersons Waiz, Perkins, Clapp, Williams, Carter, Harrod and Grooms. Nays: None. Building Commissioner Scales informed the Council the Developer of a subdivision that asked for 30 foot streets has agreed to 32 foot streets. Mayor Orem introduced Ordinance No. 90-OR-25, An Ordinance Amending 1990 Salary Ordinance, for discussion by the Council. Councilperson Narrod made the motion to suspend the rules for Ordinance No. 90-OR-25, seconded by Councilperson Grooms and carried unanimously. Councilperson Barrod then made the motion to pass Ordinance No. 90-OR-25 on all three readings, seconded by Councilperson Grooms, passing with the following roll call vote: Ayes: Councilpersons Williams, Carter, Harrod, Grooms, Waiz, Perkins, and Clapp. Nays: None. Councilpersom Perkins asked questions on the fencing distance in the flood levy and the property on Meigs. Mr. Allan has refused the certified mail sent by the Building Commissioner. Attorney Filer will keep moving on this and perhaps have an Officer deliver the notice. Councilperson Perkins referred to property on Meigs Avenue inquiring as to what zoning applies. It was explained one half of the house is B1, and one half is R2. Councilperson Perkins has received complaints regarding a set-back variance given to build a 3 bedroom home on Pearl, stating he "has had it with the Board of Zoning Appeals". Mayor Orem stated there was no direct opposition at the Board of Zoning Appeals meeting, and he feels if there had been the variance request would have been denied. Councilperson Perkins would like to see the Board of Zoning Appeals act in an advisory position only. Be would also like to PAGE 4 JUNE 4, 1990 see the appeals fee raised. Councilperson Carter would like to have the Council receive the BZA agenda packet. Commissioner Scales will see this is done. Council President Waiz called attention to the Budget Meeting to be held in Anderson on June ?. Mayor Orem will be attending this. Council President Waiz will set up the budget meetings with the Department Heads. The first one will be following the regular Council meeting on June 16 with Jan Wheatley-Dobler, Mike Wathen, and Lee Hemingway. Councilperson Williams thanked Personnel and Safety Director Lakeman and Street Commissioner Hemingway for the Slow Children Playing signs he requested. He feels there are times when appointed boards do work well, calling attention to the problems the Huntington Group is having. Councilperson Carter noticed during the recent rains the gutters in the area of the Foundry were running black and he does not believe this is safe. He wants to see this cleaned up. Mayor Orem has recently been informed by IDEM this is a Class 2 sand and there is basically nothing in it. Therefore there are no restrictions at the landfill. Mayor Orem will suggest that cleanup begin and he feels this problem will be resolved. Councilperson Perkins will be meeting with IDEM this week. Councilperson Grooms called attention to the drainage problems in Suburban Acres and wants the Council to be aware the City will have to spend some money to solve these problems. He also called attention to the need to renew the Cumulative Convention Center grant application in forwarded to the Build Indiana Fund. Capital Development Fund. A the amount of $60,000 has been of doing taken. Council President Waiz asked if the Council would be in favor away with election signs. This was discussed with no action Mayor Orem informed the Council the sewer construction plans were forwarded to Indianapolis on June 1. There will be a meeting June 13, 1990 at 7:30 P.M. with Proctor, Davis, Ray, and Umbaugh and Associates to bring the Council up to date. Mayor Orem estimated there will be 4,000 applications for 1,000,000,000 dollars of Build Indiana PAGE 5 JUNE 4, 1990 Funds. It will be next April or May before anything will be known. Jeffersonville has applied to this fund for Market Street, the Inercity roadway, and Jeff-Charlestown Road. Mayor Orem then reviewed the problems in Suburban Acres stating this has been an ongoing problem since 1978. Engineers are working on solutions for this. The drainage problems in other areas were also discussed and the cost of correcting these. The street drainage in Buttonwood is a problem, however these streets have not been completed or accepted. Councilperson Perkins called attention to information distributed by Attorney Filer on the City-County Building space. He requests Mayor Orem not sign any agreement with the County until an agreement is reached with the Council. Mayor Orem agrees with this.
