HomeMy WebLinkAbout05-07-1990COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA MAY 7, 1990 The Common Council of the in regular session in Council Chambers, Jeffersonville, Indiana, on the 7th day P.M. The meeting was called Richard Spencer Jr. at the desk. Mayor Orem asked all allegiance to the flag. City of Jeffersonvilte, Indiana met in the City-County Building in of May, 1990, at 7:30 o'clock to order Carter, 1990 for Clapp, Grooms, Harrod, Absent: None. Mayor Orem presented consideration by the by Mayor Dale Orem and C. those present to stand and pledge The roll was called and those present were: Councilpersons Perkins, Williams, and Waiz. the minutes of the meeting of April 21, Council. Councilperson Carter made the by Council motion to approve the minutes as presented, seconded President Waiz and carried unanimously. Mayor Orem presented a thank you note from for the Vissing Park Dedication. Clerk and Treasurer Spencer presented the Mrs. Edna Vissing register of claims as well as several additional claims which were explained and discussed. Clerk and Treasurer Spencer informed the Council there is a balance of $83,424.14 in the Capital Projects Fund which is the fund the claim for Waldrip Construction is to be paid. There followed discussion regarding a claim for the police radio console and a loan to pay for the radio system. Mayor Orem told the Council that he procured a loan in the amount of $195,000 for the payment of the police radio system and the cousole from INB Banking Company. Clerk and Treasurer Spencer informed the Council, Mayor, and City Attorney that this has not as yet been deposited in the City treasurery. Ne stated his reasons as such; his opinion is that the Council must pass an Ordinance for the approval for borrowing money that specifies the interest rate and the specific repayment plan. Also, before money may be borrowed, legal advertising, stating the intention of borrowing a specific amount of money must be made, and an interest rate from the lowest bidder must be obtained. The PAGE 2 MAY 7, 1990 State Board of Tax Commissioners must also approve the borrowing of this money before the loan can be made. He told the Council that the rate of interest on the loan the Mayor procured was 8.11%. Ne informed the Council that he would inquire with the State Board of Accounts and the State Tax Commission, and try to derive from the statutes the proper procedure for borrowing money. At which time he would then, in writing, inform the Council of his findings. Councilperson Perkins made mention of a letter from Citizen's Fidelity Bank on a 5.75% loan rate. Councilperson Perkins made the motion to approve the claims as presented as well as the additional claims, claim to $83,424.14, seconded by unanimously. Councilperson Carter with the reduction of the Waldrip Councilperson Carter, and carried made the motion to pass Resolution No. the tax bills not to be looked at. this. 90-R-26, A Resolution Authorizing Advertisement For An Additional Appropriation, seconded by Councilperson Clapp, and carried unanimously. Mayor Orem introduced Ms. Becky Jo Schneider and Mr. Henry Faurest, Clark County Council For The Arts members. They explained the Art Train will be in Jeffersonville June 15, 16, and 17, 1990, and the Summer Arts and Crafts Show will be at Preservation Station at the same time. The Arts Council requests the City donate $5,000 to this event. Councilperson Perkins feels this is a worthwhile project, however with out yet the financial position of the City will have Councilperson Grooms would like to help find money for Mayor Orem introduced Mr. Bob Lanum, Attorney representing Jeffersonville Public Warehouse who explained Resolution No. 90-R-17, Resolution Of The Common Council Of The City Of Jeffersonville, Indiana, Economic Development Refunding Revenue Bonds (Jeffersonville Public Warehouse, Inc. Project), Series 1990, In The Principal Amount Of $4,370.000. Following all discussion, Councilperson Perkins made the motion to pass Resolution No. 90-R-17, seconded by Councilperson Grooms and carried unanimously. Councilperson Perkins complimented the beautification of Exit 0. Mayor Orem is pleased with the job done by volunteers on the Court Avenue median. The downtown street light replacement is currently out PAGE 3 MAY 7, 1990 of reach financially. Discussion of buying the poles and coordinating with the Hughes and DeMars group followed. Councilperson Harrod made the motion to approve Resolution No. 90-R-25, Councilperson Carter, passing on a vote of 6-0-1. Perkins abstained from the vote and the discussion of Councilperson Grooms asked the Council to review Ordinances No. 75-OR-32 and 75-OR-4, Ordinances fixing minimum standards of employment and employee relations. He called attention to the portion that states: "City management has the responsibility and the authority to manage and direct on behalf of the public the operations and activities of the City to the full extent authorized by law". He does not believe City management means the Council. He asks for no action on possibily in the near future or at budget time these this tonight, but may be updated. Council President Waiz suggests, sessions during the month of July, the July 2, that due to the budget 1990 meeting as scheduled by cancelled and held July 16. Ail were in agreement. He asks that each Council member begin budget discussions with the Department Heads and start setting up meetings possibly on Saturdays. Council President Waiz asked what the City could do to promote recycling. Mayor Orem wishes to start a recycling program by 1991. Much planning is needed as Louisville has experienced problems. The trash collection bids have been opened and he would like to work with the provider to work out details and hope to have information at budget time. Currently there is a compost area near the Animal Shelter. PAGE 4 MAY 7, 1990 Attorney Filer explained the Indiana Legislature H.B. recycling plans must be in place in 3 to 5 years. regarding recycling and trash collection was held. Councilperson Williams introduced Officer 1240 which states Other discussion Joe Grant who provided the Council with a description of the insurance policy and a copy of the incorporation with regard to the boxing program currently being held in Nachand Fieldhouse. Officer Grant and two other representatives of the USA Amateur Boxing Federation answered questions. All were in agreement the insurance did not seem adequate. Attorney Filer will research the policy and ask the City insurance adjustor look at the program. It is the opinion of the Council the City may be open for a liability suit. Councilperson Williams has observed the program and is supportive as he feels it is organized and supervised well, however there is concern for the liability. Councilperson Perkins would like an opinion in writing from the City insurance carrier. Councilperson Grooms asks the Council meet with Mr. Gary Cooper at the Department of Redevelopment, Thursday, May 10, 1990 at 7:30 P.M. regarding a comprehensive study. He informed the Council the Parks Department has put $10,000 into Vissing Park this year. He and Council President Waiz attended a Clarksville Town Board meeting where $5,000 was approved for the Convention Center study. Councilperson Grooms is concerned for the speeding on 1-65, particularly with the "18 wheelers" semis. He would like to ask for State Police help on 1-65. The traffic through Buttonwood was also the subject of discussion with regard to speeding. to close the road with a have patroled this area problem. There are rumors brick wall. and without Councilperson Perkins asked status was on the Allen property on of some residents that would like Mayor Orem explained the police an inner-city road there is a Commissioner Scales what the Meigs Avenue. He would like to see action taken on this. Councilperson Carter agrees with this. Commissioner Scales will send a notice. Councilperson Perkins gave a thank you to Street Commissioner Hemingway for his response in picking up limbs and commented the mem look professional in the uniforms. He asked if Market Street was still on the FA2. Mayor Orem explained this PAGE 5 MAY 7, 1990 will go in this summer with the inner city road and funding is being looked into through the Build Indiana Fund and/or bonding. Commissioner Scales said that within 30-60 days there will be a walk-through on-site inspection on Market Street. Councilperson Perkins asked if the Council letter regarding metal buildings was delivered to the Board of Zoning Appeals. Commisioner Scales explained it was read at the meeting and the letter was clear. Councilperson Perkins feels there is a real problem when an appointed body supersedes an elected body. Councilperson Harrod thanked Councilperson Perkins for the success of the City Steamboat Race Party. He has received many compliments from the employees. Attorney Filer refered to H.B. 1261 which provides for 6% loans through the IN Bond Bank if problems arise due to a late tax settlement. This is not a problem at this time. There being no further business to come before the Council Councilperson Perkins made the motion to adjourn at 9:30 o'clock P.M., seconded by Council President Waiz and carried unanimously. ATTEST: t
