Carter~ Jimmy Andrew COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA SEPTEMBER 81~ 1991 of the City of Jeffersonville met in Chambers, in the City-County Building, at 9:30 A.M. on the 81st day of September, The meeting was called to order by Council President Jimmy with Clerk and Treasurer C. Richard Spencer Jr. at the desk. The roll was called and those present were Councilpersons Perkins, Carter~ Marie Clapp~ Ron Grooms~ Tony Harrod~ John Williams, and Robert Waiz. Absent: None. Councilperson Perkins made the motion to approve the minutes of the meeting of September 3~ 1991~ as presented, seconded by Councilperson Waiz and carried unanimously. Clerk and Treasurer Spencer presented the claim along with additional claims for consideration by the register Counc i t. Following discussion on many of the claims, Councilperson Perkins mad? the motion to hold the claim to Vissing's Dodge~ the Steamboat Committee claim, the claim for Cecil Jones, and the claim to pay for the Police cars, to approve the balance of the claims on the list, and the additional claims, seconded by Councilperson Grooms and carried unanimously. Councilperson Ctapp would like to see the Department Heads get authorization from the Council before making purchases to be paid from the Cumulative Capital Development Fund. Councilperson Perkins agrees with this. Councilperson Waiz asked to be excused at 10:00 o'clock A.M. Councilperson Williams introduced A Petition To Vacate A Public Way from Richard and Kathy VanGilder, asking for public imput. Mr. George Bere, 684 East ?th Street addressed the Council stating he is very much oppossed. He would lose access to his garage and he does does not feel that after 100 years an alley can be closed. Many options were discussed by Mr. VanGilder~ Ms. Evelyn Fulkerson, 626 East Seventh emergency vehicles and trash collection. work out a Compromise as he wishes the Council and Mr. Bere. Councilperson Harrod asked to be excused at 11:05 o'clock A.M. Attorney Filer introduced Mr. Jorge Lanz of Jacobi, Toombs, and Lanz who presented a Status Report Ten (10) Year Street and Road Improvement Program On Street And Road Reconstruction Projects, Jeffersonville~ Indiana. Mr. Lanz gave a general review of the contents of the report and answered questions. He stated that if the City could show a means of providing 25% of the financing, the chances for receiving money from the State would be better as these funds are very competitive. $3.3 million~ and willing to meet The City share of the funding will be approximtely it is very important to have a plan. Mr. Lanz is with any of the Council for further information. Following ali discussion Councilperson Grooms made the motion to accept and adopt the ten year program until modified or changed by future Councils. Councilperson Perkins would like to have time to review the 45 pages included in the report as it was only received this morning. With this Councilperson Grooms withdrew his motion until the next meeting. PAGE 3 SEPTEMBER 21, 1991 Councilperson Perkins made reference to plans by S.K. Wilson regarding the 1-65 corridor study as some of the road projects by this study. Mr. Lanz stated he will stay on top of the proposed options on this study were discussed. Councilperson Perkins introduced Ordinance No. 91-0R-50, An Ordinance Amending Ordinance No. 90-OR~O, Commonly Known As The Jeffersonville Sewer Rate Ordinance, explaining some of the contents. Attorney Filer feels two additional paragraphs having to do with the billing computer software and a provision regarding the amount required to retire the bond indebtedness need to be included. Sewer Office Manager Goldman would like to see some provision for those who have already received credit. Attorney Filer will make sure there are no double adjustments. Councilperson Perkins made a motion to pass Ordinance No. 91-0R-50 on the first and second readings, seconded by Councilperson Clapp and carried unanimously. 91-0R-51, An Ordinance Transferring Certain Department was introduced for discussion. explained the need for this transfer. Councilperson Perkins made the motion to for Ordinance No. 91-0R-51, seconded by and carried unanimously. Ayes: Councilpersons Grooms, Carter, Williams, Clapp~ and Nays: None. Council President Carter introduced Resolution No. A Resolution Authorizing The Application For Letter Of 91-R-87~ Credit. Attorney Filer explained why this is necessary. Councilperson Williams made the motion to pass Resolution No. 91-R-R?, seconded by Councilperson Ciapp and carried unanimously. PAGE 4 SEPTEMBER 81, 1991 Councilperson Grooms presented and explained a rough draft of an Ordinance regulating the sale of privately owned vehicles on private property in R-1 and R-2 zones in the City of Jeffersonville~ and the storage of race cars (stock) and the repair and maintenance thereof. He asks the Council to look at this and be ready to act on, or modify the Ordinance at the October meeting. Councilperson Grooms called attention to an 85 page working draft of the the comprehensive plan that was distributed to the Council. He stated he finds the report "awesome"~ as the work that has been done is phenominal. Council President Carter mentioned the two public meetinge that were held regarding this plan. Councilperson Perkins would like i~ understood by all that this is a plan and does not change anything~ Councilperson Grooms said this has been the hardest point to getiacross. CouncilperSon Grooms is waiting for additional information on the tax abatement resolution. Council President Carter made reference to Mayor Orem's plan to have the Wastewater Treatment Plant make a $100,000 payment in lieu of taxes in t992. ~e would like to ask the Plant make a payment in lieu of taxes in thelamount of $14,080 this year to offset the cost of the chipper. Following further discussion Council President Carter made the motion to h~ve Attorney Filer and Clerk and Treasurer Spencer work on a way to handle this, seconded by Councilperson Grooms and carried unanimously.! Council P~esident Carter has been informed the Clerk Treasurer's Office h~s not received the $400.00 the Ambulance Service agreed to pay the City for use of the facilities. He does not feel the City should s~bsidize a private business. Attorney Filer understood the check had been paid. It has not been receipted into the Clerk Treasure'~ Office. Councilperson Perkins made the motion that if the $400 ~s!not received in the Clerk and Treasurer s Office by 4100 o'clock P.M.i Monday~ September 23, i991 they be asked to move out immediately. Council President Carter understands this is life-giving businessi~ however there are other life-giving businesses in Jeffersonville t~at own property and pay taxes. Councilperson Clapp feels the safelty of the people of Jeffersonville should be taken into consideration. This will be taken up at the Special meeting that has been called for Monday~ September 23, 1991. Councilperson Williams feels the City needs to be more involved in the War On Drugs. There is need for a method of dealing with those affected by this War. Resources need to be expanded beyond weapons~ to include manpower and education. Councilperson Perkins agrees with Councilperson Williams and would like to look into Federal funds for this purpose. There needs to be zero tolerence for drugs in Jeffersonville. Councilperson Perkins will offer a Resolution to advertise for these funds at the Special Council Meeting on Monday, September 23, 1991. Councilpersoo Perkins feels the blocking of the Council Chambers back stairway with a concrete block wall is an unacceptable situation for safety. This has been done without consulting the Building Authority~ or the City, by the Jail people. Council President Carter feels the need for a committee to work with the Sheriff, the Building Authority, and the County Commissioners regarding this as well as the cleaning of the new juvenile detention center. Councilperson Grooms would like the public to be aware of the fact that each Police car carries oxygen in case of an emergency or lose of electricity. Council President Carter stated the fire trucks also carry oxygen. PAGE 6 SEPTEMBER B1, 1991 Councilperson Grooms would also like the public to know the Indiana Board of Pharmacies Rules state that when a Pharmacy closes, the prescriptions be made available for publc accesibilty.
