HomeMy WebLinkAbout08-03-1991 Emergency SessionEMERGENCY SESSION COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE~ INDIANA AUGUST S~ 1991 The Commo~ Council of the City of Jeffersonville met in emergency session in the Mayor's Conference Room, in the City-County Building~ oeffe~sonv~lle~ India-na~ at ~:00 o~clock P.M. on the 3rd day of August, 1991. The meeting was called to order by Mayor Dale Orem, with Clerk and Treasurer C. Richard Spencer Jr. at the desk. The roll was called and those present were Counc~tpersons Jimmy Carter, Marie Clapp~ Pon Grooms, John Perkins~ Bob Waiz~ and Andrew Williams. Absent: Councilperson Tony Harrod. Councilperson Perkins inquired if this meeting has been declared an emergency meeting, to which Mayor Orem replied it had. Councilperson Perkins then read the definition of an emergency as stated in Indiana Code 36124.5. Mayor Orem feels budgets are an emergency. Councilperson Perkins does not feel this meeting has been called pursuant to State statute. Mayor Orem then asked if it is Councilperson Perkins opinion that the meeting held at 9:00 o'clock P.M. August 1, 1991 was legal. Councilperson Perkins feels the same situation would also apply. Attorney Filer explained the proper notice~ had been given to the press for a special meeting. Councilperson Perkins then stated an opinion from the Court of Appeals. Coumcilperson Perkins then quoted from City Code Section B~ Subsection 4. Councilperson Perkins does feel this is an illegal meeting. Councilperson Grooms distributed and reviewed a list of his opinions for discussion as where the budgets could be reduced. He has contacted Director of Redevelopment Gowens and was informed that Department could pay the year if the bond could be this type of bond could interest only on the loan payment due next extended. Clerk and Treasurer Spencer said not be delayed. Councilperson Grooms would like to see this $65~000 payment eliminated from the !99~ Council budget. Councilperson Grooms then made a motion to advertise a 199~ tax rate of $4.95 with the funding of salaries at $500.00 seconded by PAGE 2 AUGUST 37 1991 Counc~lperson Williams. Following further discussion~ Councilperson Williams withdrew his second and Councilperson Grooms withdrew the motion. Councilperson Grooms then made the motion to advertise a 1992 tax rate of $4.75, seconded by Councilperson Williams. Councilperson Grooms then reviewed some suggestions as to how this rate could be arrived at with cuts in the Council budget. Following all discussion~ the motion to advertise a 1992 tax rate of $~.75 passed on a vote of 4-2, with Councilpersons Perkins and Carter voting against the motion. Much discussion ~as held regarding the fund~ng, disbursing and possible veto of the Salary Ordinance. Attorney Fifer's opinion is that the Salary Ordinance as passed on August 1~ 199t would have to 1992 budgets. If compensation is withheld for any then these funds could be transferred for other be funded in the reason in 1992~ purposes. Further discussion followed on all budgets. Councilperson Grooms made the motion to advertise the Fire Pension Fund at $.267~ Police Pension $.112~ Park & Recreation $.317~ Building Rental at $.143~ Cumulative Capital at $.115~ Sanitation at $.345~ and adjust the General Fund to make the rate of $4.75~ seconded by Councilperson Clapp. Many ideas and comments followed on the tax rate, insurance~ the financial status of the City. Councilperson Waiz feels the City has got to buckle down and make drastic changes in the following year or the City ~ill be bankrupt. Councilperson Perkins noted that this Council argues over pennies and the overall tax rate consists of other areas that are increasing~ such as the County and the Schools~ The raise in the tax rate was compared to the raise in the sewer rates. Councilperson Williams left the meeting at 3:15 o~clock P.M. Councilperson Grooms stated again the ideas he presented were only suggestions. The vote on the motion to make the adjustments in the General Fund was called for and failed on a vote of 2-3, with Councilpersons Waiz~ Perkins~ and Carter voting against the motion. Councilperson Perkins made the motion to reconsider the motion to advertise a tax rate of $4.75, seconded by Coumcil President Carter, failing on a vote of 2-3 with Councilpersons Waiz~ Clapp~ and Grooms~ voting against the m~tion. Fol].o~ing Councilperson Perkins made to advertise a tax rate passing on a vote of 4-1 motion. additional discussion~ and stating of opinions~ the motion again to reconsider the motion of $4.75~ seconded by Councilperson Waiz~ with Councilperson Waiz voting against the Councilperson Grooms made the motion to advertise a 1992 tax rate of $4.80~ seconded by Councitperson Clapp, passing on a vote of A-1 with Councilperson Waiz voting against the motion. Councilperson Grooms made the motion to give Clerk and Treasurer Spencer authority to prepare the proper advertisment with a rate of $4.80 seconded by Councilperson Perkins~ passing on a vote of ~-I ~ith Councilperson Waiz voting against the motion. There being no further business to come before the Council~ Councilperson Waiz moved to adjourn at 4:00 P.M. seconde'd by Councilperson Grooms~ and unanimously carried.
