The meeting was called to order Richard Spencer Jr. at the desk. Common Council of City of Jeffersonville~ Indiana met in the City-County Building in of June, 1991 at 7:30 o'clock by Mayor Dale Orem and C. Mayor Orem asked all those present to stand as Councilperson Bob Waiz gave the invocation. Mayor Orem then asked all those present to remain standing and join him in the pledge of allegiance to the flag. The roll was called and those present were: Councilpersons Jimmy Carter, Marie Clapp, Ron Grooms, Wais~ and Andrew Williams. Absent: None~ Mayor Orem presented the Tony Harrod, John Perkins, Robert minutes of the meeting of May 18, Perkins made the by Councilperson explained the amendments made. Clerk and Treasurer Spencer presented the claim register along with several additional claims for consideration by the Council. Following all discussion, Councilperson Harrod made the motion to approve the claims as presented along with the additional, seconded by Councilperson Williams and carried unanimously. Discussion of the Cumulative Capital Development Fund followed with Councilperson Grooms promising a full report of the fund for the next meeting. Councilperson Grooms introduced and made the motion to pass on the third reading, Ordinance No. 91-OR-29, An Ordinance Establishing The Jeffersonville Drainage Assistance Program, seconded by Councilperson Perkins and opened for discussion. Councilperson Grooms explained the funding for this program would come from the Cumulative Capital Improvement Fund, not to exceed $50,000 for 1991~ He also PAGE 2 JUNE 3~ 1991 Councilperson Williams introduced and made the motion to untable Ordinance No. 91-OR-30, An Ordinance Rezoning Certain Property From R-i~ Single Family Residence, To R-2~ Multi-Family Residence, seconded by Council President Carter and carried unanimously. Discussion followed regarding the number of readings necessary to pass zoning Ordinances, with Council President Carter making the motion to require three readings for zoning Ordinances, seconded by Councilperson Harrod and carried unanimously. Councilperson Perkins then made the motion to suspend the rules for Ordinance. No. 91-OR-30, seconded by Council President Carter and carried unanimously. Council President Carter made the motion to pass Ordinance No. 91-OR-30 on all three readings~ seconded by Councilperson Ctapp and opened for discussion. Mr. John Zurschmiede~ Developer~ distributed copies of a letter from the Army Corps of Engineers regarding the area. Council President Carter asked for input from the audience and rece%ved no response. Mayor Orem asked Mr. Zurschmiede if any of the area residents had contacted him since the last meeting and was informed he had received no objections. Councilperson Perkins stated he feels this is the best use for the land~ however he will refrain from the vote stat%ng he has some philosophical objections. Councilperson Waiz objects to a R-2 zoning in the middle of a subdivision. Building Commissioner Scales answered questions~ Following asking again for objections and receiving none the vote was called for. Ordinance 91-OR-30 passed with a vote of 5-0-2. Councilpersons Wais and Perkins abstained. Councilperson Perkins introduced~and made the motion to pass on the third reading. Ordinance No. 91-0R-S2~ An Ordinance Creating The Jeffersonvil!e Civic/Conference Center Authority~ seconded by Councilperson Harrod and opened made several comments concluding reservations about the site and for discussion. Councilperson Grooms with the statement that he has some the pric~ but does believe in the concept as this is not a funding Ordinance. Councilperson Clapp asked if the LaRose was the only choice. Councilperson Perkins answered no, however it is his personal first choice and the goal is to try to draw a crowd downtown, commending what is currently going on downtown. The only problem Councilperson Waiz has is to the financing and what cost it will be to the taxpayer, stating the concept is excellent. Ordinance No. 91-OR-34, An Councilpersons Waiz, Clapp, and Ordinance Transferring Certain Council Animal Funds Within Same Department was introduced and explained. President Carter presented three quotes for trucks for the Shelter, explaining the need. Fire Chief Collins explained and answered questions regarding the fire gear. Councilperson Perkins made the motion to suspend the rules for Ordinance~ No. 91-OR-34, seconded by Councilperson Williams, failing on a vote of 6-1, with Councilperson Grooms, stating his objection to funding the Animal Shelter truck in this manner. Council President Carter then made the motion to pass Ordinance No. 91-OR-34 on the first and ~econd readings, seconded by Councilperson Williams, passing unanimously. Mayor Orem presented Ordinance No. 91-OR-35, An Additional Appropriation Ordinance. Clerk and Treasurer Spencer explained this Ordinance and Fire Chief Collins answergd questions. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 91-OR-35 on all three readings, seconded by Councilperson Williams, passing with the following roll call vote: Ayes: Councilpersons Clapp~ Williams, Carter, Harrod, Grooms, Perkins, and Waiz. Nays: None. Mayor Orem introduced Mr. Dennis Frantz~ President of Jeffersonville Fire Fighters Association, Local ~558, calling attention to a letter from the Local requesting a minimum of 12 men per shift. Chief Collins asked the Council to be aware that funding is a factor, and that to comply with this he will need another approximately $21,000 in overtime in addition to what has already been requested. Chief Collins stated this year there are three firefighters with medical problems that have required an extended sick leave. Sick pay is PAGE 4 JUNE 3, 1991 unlimited for Police and Fire. The sick policy was explained. The paying of Workman's Compensation for Poli~e and Fire was discussed and will be looked into. Council President Carter asked if.Attorney Filer had found out the reason for the shortage in the Hughes Group lease payment. Mayor Orem will be meeting with them this week and this will be discussed. Council President Carter reviewed three recent incidents where City employee family members were refused service at Clark County Hospital due to problems with the insurance. Mayor Orem said this was the first he had heard of this and asked that he be called immedialty and he would do everything in his power to get these problems resolved. He feels this is a one on one hospital employee problem and he will do everything he can to get to the bottom of Council President Carter inquired if Jonquil was on the list of streets to be paved as it is in need. Council President Carter asked Building Commissioner Scales to review the sidewalk program for this year. Commissioner Scales told the Council he has eliminated those requests for Market Street due to the Market Street Project. He has received only one request from a commercial business, and he does have the money availble to grant the residential requests remaining from last year as well as all residential requests received this year. Councilperson Perkins suggests Commissioner Scales do those residential r~quests from last year first, residential from this year second, and then consider the commercial requests. Ail agreed with this. Council President Carter asks that Commissioner Scales look into making Graham Street wider at Champs. Commisioner Scales has received quote for concrete from Edwards Concrete of Greenville, IN, for $1.68 sq. ft., and Hunt of Jeffersonville, IN for $1.80 sq. ft. Councilperson Perkins asks that the quality of work be looked at. Council President Carter feels a local vendor should be considered first. Councilperson Clapp feels this way also. Council President Carter has received a request from the Police Department for the use of another room next to Council Chambers for use by the Drug Enforcement Officers for security reasons. It would not be possible to share this with the Council. Council President Carter will check with the Building Authority. Councilperson Perkins was informed the basement access problems have been worked out. Councilperson Grooms announced the Meadows Park Committee will meet June 6, 1991 at 7:30 P.M. The plan for this year is to have 4 pieces of equipment, possibily a shelter house, picnic tables, and a 6-week program. The pools will open this Saturday, June 8, 1991. The comprehensive plan committee will meet Wednesday, June 26, 1991. Me asks the Council to keep in mind the request to participate in a Boy Scout project in early August. Councilperson Grooms explained his position on the purchase of vehicles saying he feels all vehicles should come from the Cumulative Capital Development Fund. Council President Carter explained why he made the request for the Animal Shelter truck the way he did. PAGE 6 JUNE 3, 1991 Councilperson Williams would like ito continue to emphasize his efforts in the Greenwood and National Aven~e area. A positive meeting was held the previous week. There has been,a lot of success with Police enforcement. He feels some of the problems may be the lack of enforcement of Housing Authority policies and the lackness to require conforming to the letter of the law. He as~s Attorney Filer if the City Council has any "teeth" to encourage the Housing Authority to strickly enforce policies. Attorney Filer stated he is not the Housing Authority Attorney, so he is not familiar with the ru%es and regulations. He will however look into ways the City may assist. He is looking into the enforcement of public intoxication and open container laws. Councilperson Perkins commends Director Lakeman and the Street Department for seeing that the excess trash was picked up timely near St. Lukes Mayor Orem informed the Council the Senior Games are taking place this week and with 10th Street closed there have been some traffic problems on Court. Council President Carter asked the Council to go by the new Wastewater Treatment Plant as the concrete is taking shape.
