HomeMy WebLinkAbout05-18-1991COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA MAY 18, 1991 The Common Council of the City of Jeffersonville, Indiana met in regular session in Council Chambers, in the City-County Building in Jeffersonville, Indiana, on the 18th day of A.M. The meeting was called to order Richard Spencer Jr. at the desk. Mayor Orem asked all those Stuart, Secretary, Clark County May, 1991 at 9:30 o'clock by Mayor Dale Orem and C. present to stand as Reverend Irene Ministerial Association gave the invocation. Mayor Orem then asked all present to join him in the pledge of allegiance to the flag. The roll was called and those present were: Councilpersons Jimmy Carter, Marie Clapp, Ron GroOms, John Andrew Williams. Absent: Councilperson Tony Harrod. Perkins, Robert Waiz, and Mayor Orem presented the minutes of the meeting of May 6, 1991 for consideration by the Council. Councilperson Clapp made the motion to approve the minutes as presented, seconded by Councilperson Grooms and carried unanimously. Clerk and Treasurer Spencer presented the claim register along with several additional claims for consideration by the Council. Following all discussion, Councilperson Perkins made the motion to approve the claims as presented along with the additional, seconded by Council President Carter and carried unanimously. Councilperson Ordinance Establishing explaining the changes. Grooms introduced Ordinance No. 91-OR-29, An The Jeffersonville Drainage Assistance Program, Following all discussion, Councilperson Grooms made the motion to pass Ordinance No. 91-OR-29 on the second reading, seconded by Councilperson Perkins, and carrying unanimously. Councilperson Williams introduced Ordinance No. 91-OR-30, An Ordinance Rezoning Certain Property From R-I, Single Family Residence, To R-2, Multi-Family Residence, explaining the Ordinance comes to the Council with no recommendation from the Zoning Perkins made the motion to disallow Ordinance No'. Counczlperso Waiz, and opened for discussion. Board. Counczlperso 91-OR-30, seconded by Mr. Doug Fowler, a PAGE 2 MAY 18, 1991 resident of Chippewa, acted as spokesperson for a group of residents of the area, making reference to the lack of a comprehensive plan, the nursing home residents~ the congestion on 8th Street, and the wetland area. Mr. Zurschmiede, developer of the area, explained the need for rezoning is to have a parking lot for the nursing home~ which cannot be done with a R-1 zoning. Attorney Filer explained a rezoning cannot be made conditional, however it would be possible to apply for a variance for the parking lot. He did give some options, explaining the Council has 90 days to act, or the issue dies. Council President Carter asked how much wetland is involved. Mr. Zurschmi~de feels it is less than one acre, and the Corps of Engineers feels it may not be that much. A report from the Corps Of Engineers is due Tuesday, May 28, 1991. Council President Carter asked how many in attendance disagree with the rezoning. Many in the audience did stand up. Mr. Russell Kruer, who will be doing the marketing for the proposed development of homes, explained the homes will be of equal or more value, saying Jeffersonville needs young people, and new families and it is right for Jeffersonville to grow correctly. Councilperson Perkins said the Council has taken a hard look at rezoning and made few changes due to the lack of a comprehensive plan. Mr. Bill Gibson, Engineer explained the area that is in question is 64 feet by 117 feet. Mayor Orem explained that following a public meeting the developer did make changes in the plans, and all it boils down to is whether this is good or bad. There are concerns for more than value, but for schools, drainage, etc. Attorney Filer explained before the project is approved, drainage will have to be addressed. Discussion followed to table the Ordinance. Councilperson Grooms explained the master plan will be ready soon. PAGE 3 MAY 18, 1991 A recess was called for and granted at 10:30 o'clock A.M. The meeting was called back to order at 10:40 o'clock A.M. Mayor Orem introduced Ordinance No. 91-OR-31, An Ordinance Granting A Loan From The Revolving Economic Development Fund Of The City Of Jeffersonville, explaining this has been approved by the Revolving Loan Committee. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 91-OR-31, seconded by Councilperson Grooms and carried unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 91-OR-31 on all three readings, seconded by Council President Carter, passing with the following roll call vote: Perkins. Councilpersons: Nays: None. Councilperson that Chili Grooms, Carter, Williams, Clapp, Waiz, and Perkins asked and was informed by Time Restaurant would be movin~ to the former Dick's Place. Councilperson Perkins commends Mr. Mayor Orem location of Coomer for his work on Ann's Place. Councilperson Grooms introduced Resolution No. Resolution Of The Common Council Of Jeffer~onville, The Transfer Of Certain Easements By The City To Redevelopment Authority, asking Attorney Filer to Councilperson Perkins made the motion to Grooms, and 91-R-18, A Indiana Authorizing The Jeffersonville explain the need. CoUncitperson Perkins made the seconded by Councilperson Clapp, Council President Carter explained a letter to the Editor published in the Evening News has put the blame for the trouble with the Sheriff on the City Council. It is his opinion the Evening News should go over these letters for false statement~. Council President Carter feels Sheriff Becher is doing a good job and the problems are with the County Council. He asks the Evening News put a correction in the paper, and he asks that screening be done. Councilperson Perkins requests Attorney Fifer write a letter on behalf of the City Council. Councilperson Williams called attention to a memorandum from Animal Shelter Manager Wheatley regarding the purchase of a computer system. Council President Carter feels the needed improvements to the incinerator and the building need to be brought to the attention of the other entities involved. Assistant Police Chief Elliott told what he knows of the plans. Councilperson Perkins said this needs to be dealt with. Attorney Fifer will set up a meeting with the Building Authority. Council President Carter said the Building Authority has been asked to fund the jail janitors. This also needs to be discussed. Councilperson Perkins .introduced Ordinance No. 91-0R-32, An Ordinance Creating The Jeffersonville Civic/Conference Center Authority, explaining the Ordinance and asking for input before the next meeting. Councilperson Clapp would like to wait for any action as this is the first the Council has seen of the Ordingnce and it was not on the agenda. Councilperson Perkins made the motion to pass Ordinance No. 91-OR-32 on the first and second readings, seconded by Council President Carter. Councitperson Williams has concerns for Sections 8 and 7. He feels the intend is good~ however he agrees with Councilperson Clapp to wait. Councilperson Grooms explained the Convention Center Committee has addressed all but Sections 8 and 7. He does have concerns for Section 2. Following all discussion the vote on the first and second reading of Ordinance No. 91-OR-32 was called for, passing on a vote of 4-1-1. Councilperson Clapp voted in oppossition, and Councilperson Waiz abstained. PAGE 5 MAY 18 1991 Councilperson Williams asks the mulch be advertised or done away with. Mayor Orem explained an I.D.E.M. approved program of P.F.R.P. for combing compost with sludge and sold for landfill cover was being looked into. There is no site availab.l~ at this time, however the pile will be eliminated and other areas will be looked at. A plan will be implemented at the new Wastewater Treatment Facility to also take sludge from other areas. This will mean few,er costs to the facility. Councilperson Williams called attention to the area where a City employee was killed recently~ expressing concern for the violence in this area. There is a new subdivision planned for this area and now would be the: time to take care of this. He would like to see directional signs that the Parks Department makes put up in this area. Councilperson Grooms has been asked to do something to have the launch ramp and road cleaned up. The Fire Department will be asked to assist in this for a $150 contribution t0 the Crusade for Children in the name of the Jeffersonville Fire Department. There are several men willing to work on this if a contribution is made to the Crusade. Mayor Orem called attention to the replacement tracks at Walnut and 10th, and reminding the Council the first week in June the tracks under the 10th Street underpass will be improved Council President Carter introduced Ordinance No. 91-OR-33, An Ordinance Transferring Funds Within Same Department. Following discussion, Council President Carter made the motion to suspend the rules, seconded by Councilperson Grooms, passing unanimously. Council President Carter then made the motion to pass Ordinance No. 91-OR-33 on all three readings, seconded by following roll call vote: Ayes: Councilpersons Grooms. Councitperson Perkins, passing on the Perkins, Waiz, Williams, Carter, and Nays: None Council President Carter explained the County Commissioners no longer have a contract with Med Aid for a~mbulance service. A company from Columbus, Indiana is now providing service. The Commissioners are considering raising their contribution from $90,000 to $100,000 for the provider. Council President Carter feels the City should take a look at providing this service. He will work on mo, re information. There being no further business to come before the Council, Councilperson Perkins made the motion to adjourn at 11:45 o'clock P.M., seconded by Councllperso GrOoms and carried unanimously.
