HomeMy WebLinkAbout03-04-1991i COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA MARCH 4, 1991 The Common Council of the City of Jeffersonville, Indiana met in regular session in Council Chambers, in the City-County Building in Jeffersonville, Indiana, on the 4th day of March, 1991 at 7:30 o'clock The meeting was called Richard Spencer Jr. at the desk. to order by Mayor Dale Orem and C. Mayor Orem asked all those present to stand as Paster Dave Owens of Springdale Methodist Church gave the invocation. He then asked those present to join in the pledge of allegiance to the flag. The roll was called and those present were: Councilpersons Jimmy Carter, Marie Clapp, Waiz, and Andrew Williams. Absent: None. 25, the Ron Grooms, Tony Harrod, John Perkins, Bob Mayor Orem presented the minutes 1991 for consideration by the Council. of the meeting of February Councilperson Perkins made motion to approve the minutes as presented, seconded by Councilperson Clapp and carried unanimously. Clerk and Treasurer Spencer prezented the claim register with two additional claims for consideratio~ by the Council. Council President Carter made the motion to approve along with the two additional, seconded by carried unanimously. Mayor Orem introduced Ordinance No. The City Of Jeffersonville, Indiana ("City") For The Issuance Of The Variable Revenue Refunding Bonds (Merchant's the claims as presented Counczlperso Grooms and 91-OR-16, An Ordinance Of Authorizing And Providing Rate Demand Economic Development Grain, Inc. Project), explaining the need for this Ordinance, and declaring this a public hearing. Speakers in oppossition to this Ordinance!were asked for. There being no oppossition, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 91-OR-16, seconded by Councilperson Grooms and carried unanimousll Councilperson Perkins then made the motion to pass Ordinance No. 91-OR-16 on all three readings, seconded by Councilperson Waiz, passing on the following roll call vote: PAGE 2 MARCH 4, 1991 Waiz, Ayes: Councilpersons Grooms, and Perkins. Nays: None. Mayor Orem explained the Harrod, Carter, Williams, Clapp, arrangements between I.D.E.M., and Mr. Robison of Robison Foundry for the removal of the sand are complete. He then introduced Mr. Robison, asking himlto inform the Council of his intentions. Mr. Robison explained he has approval from I.D.E.M. to take the sand to Clark-Floyd Landfill and thislwill go to the Clark County Commissioners for approval in the morning (March 5, 1991). He explained the delays have been out of his hands. Cogncil President Carter asked if all of the sand will be removed. Mr. R~bison stated he will remove all he can afford, saying it will cost approximate y $30~000. Councilperson Waiz inquired as to the timelframe~ to which Mr. Robison replied he will start as soon as he gets the O.K. Mayor Orem introduced ResolutionI No. 91-R-i5, A Resolution Designating Certain Areas With The City Of Jeffersonville, Indiana~ As "Economic Revitalization Areas". Councilperson Perkins has received correspondence that indicated wrong information was given regarding the timing of this request. He does believe th~s was an honest mistake. As there were no representatives in attendanc~ to speak in support of the Resolution, Council President Carter made the motion to table Resolution No. 91-R-15 until the next meeting~ seconded by Councilperson Clapp and carried unanimously. Following all discussion, Council President Carter made the motion to pass Ordinance No. 91-OR-18 on the first reading, seconded by Councilperson Waiz. passing unanimously. Mayor Orem introduced Ordinance No. 91-OR-19 An Ordinance Of Additional Appropriations. Clerk and Treasurer Spencer explained the Ordinance is for additional appropriations in the General Fund and the Motor Vehicle Fund. Following all discussion, Council President Carter made the motion to suspend the rules seconded by Councilperson Grooms and President Carter then made the motion to for Ordinance No. 91-0R-19, carried unanimously. Council pass Ordinance No. 91-OR-19 on all three readings, seconded by Councilperson Clapp, passing on the following roll call vote: Ayes: Councilpersons Perkins, Waiz, Clapp, Williams, Harrod, and Grooms. Nays: None. Mayor Orem introduced Ordinance No. Carter, 91-OR-20. An Ordinance Of Additional Appropriation. Nays: None. PAGE 4 MARCH 4, 1991 Mayor Orem presented Ordinance No., 91-OR-21, An Ordinance Transferring Funds Within Same Department.. Discussion followed on the use of the funds in the Cumulative !Capital Development Fund. Councilperson Grooms is against spending this for anything but vehicles. Judge Roger Lindsey answered questions regarding the computer purchase. Following all discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 91-OR-21,~ seconded by Councilperson Harrod and carried unanimously. Counczlperso Perkins then made the motion to pass Ordinance No. 91-OR-21 on ~11, three readings, seconded by Councilperson Harrod, passing with following roll call vote: Ayes: Councilpersons Grooms, Harrod, Carter, Williams, Clapp, Waiz, and Perkins. Nays: None~ Clerk and Treasurer Spencer asked: the Council to think about a mechanism to repay the Cumulative Capital Iimprovement fund for the money used for Duffy's Landing. This will be brqught up at another meeting. Mayor Orem introduced Ordinance ~ No. 91-OR-22, An Ordinance Approving Interlocal Cooperation Agreement For The Operation Of The Jeffersonvzlle-Clar County Animal Shelter· Councilperson Perkins questioned the "excess expenses" on page 3. Attorney Filter expalined what this means. Following all discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance nO. 91-OR-22, seconded by Councilperson Grooms, passing unanimously· Councilperson Perkins then made the motion to pass Ordinance No. 91£OR-22, on all three readings, seconded by Council President Carter, passing on a vote of 7-0. Councilperson Perkins asked Cosmissione~ Scales if Robison Foundry has been in violation of aonin~ laws for outside storage· Commissioner Scales informed him that isicorrect and that Mr. Robison ' Councilperson Perkins has had been served twice on this matter.I received complaint calls regarding cablevision not providing a program guide The cable contract negotiation time is approaching and he would like to have this looked into. He feels customers are paying higher rates for less service.
