A RESOLUTION TERMINATING TAX ABATEMENT
FOR
ENVIRONMENTAL EQUIPMENT SERVICE CORP,
WHEREAS, on August 4, 1997 the Common Council of the City of Jeffersonville
("the Council"), adopted a Resolution Finding Failure To Substantially Comply
With Statement Of Benefits determining that Environmental Equipment Service
Corp. has not substantially complied with its statement of benefits; and
WHEREAS, at its August 4th meeting, the Council determined that it would hold a
public hearing on September 2, 1997 for the purpose of further considering
Environmental Equipment Service Corp.'s compliance with its statement of
benefits; and
WHEREAS, a written notice was mailed by certified mail, return receipt
requested to Environmental Equipment Service Corp. explaining the reason for
the Council's determination that it had not complied with its statement of benefits
and giving notice of the date, time and place of the hearing to be conducted by
the Council for the purpose of further considering Environmental Equipment
Service Corp.'s compliance with their statement of benefits; and
WHEREAS, on September 2, 1997 the Council held the public hearing required
by Indiana Code 6-1.1-12.1-5.9(c); and
WHEREAS, Environmental Equipment Service Corp. failed to attend or present
any information to the Council concerning its reasonable efforts to substantially
comply with the statement of benefits.
NOW THEREFORE, BE IT HEREBY RESOLVED that the Council now finds that
Environmental Equipment Service Corp. has not made reasonable efforts to
comply with its statement of benefits; and
NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that Environmental
Equipment Service Corp.'s tax abatement is hereby terminated; and
NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Clerk
Treasurer of the City of Jeffersonville shall forward a copy of this Resolution by
certified mail to:
1) Environmental Equipment Service Corp.,
2) The Clark County Auditor, and
3) The State Board of Tax Commissioners
NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Clark
County Auditor shall remove Environmental Equipment Service Corp.'s tax
abatement deduction from the company's tax duplicate and shall notify the Clark
County Treasurer of this termination of the deduction.
