AN ORDINANCE ALLOCATING ANNUAL EDIT FUNDS TO THE
JEFFERSONVILLE PUBLIC ARTS NON -REVERTING FUND
WHEREAS, the Common Council for the City of Jeffersonville, Clark
County Indiana (hereinafter the "Council"), is the City's statutory Legislative and
Fiscal Body pursuant to Indiana Code 36-4-6 et seq.;
WHEREAS, the Council has previously established the Jeffersonville
Public Arts Committee and the Public Arts Non -Reverting Fund for the purpose of
the consideration, promotion and development of public art on city property.
"Public Art" includes, but is not limited to, sculptures, statutes, paintings and
murals.
WHEREAS, the Council previously designated the Jeffersonville Public
Arts Committee as the body to review, consider and determine the creation and
placement of public art on city -owned property;
WHEREAS, The Indiana Secretary of Commerce, Victor Smith, stated on
July 20, 2015 in a meeting in Jeffersonville that "one of Indiana's key focus areas
is on population stagnation" and encouraged municipalities to "focus on this as
well by making our Region attractive for talented people." Public Art promotes
these goals, and is a positive factor for Economic Development and for Quality of
Life;
WHEREAS, the Council desires to support the activities of the Pubic Arts
Committee by establishing a policy that the Council shall allocate funding to the
Public Arts Committee each calendar budget year in the amount of Four Percent
(4%) of the annual collection of the City's EDIT (Economic Development Income
Tax) funds to be deposited into the Public Arts Non -Reverting Fund.
NOW, THEREFORE, BE IT RESOLVED by the Common Council as
fol lows:
1. That the Council hereby establishes a policy that the Council shall
allocate funding to the Public Arts Committee each calendar budget
year in the amount of Four Per Cent (4%) of the annual collection of
the City's previous years' certified EDIT (Economic Development
Income Tax) funds to be deposited into the Public Arts Non -Reverting
Fund.
2. These funds shall be used for maintaining current Public Art; grant
match for future projects; Contracted Services; new projects; or other
expenses related to the advancement of Public Art in Jeffersonville,
and said expenditure of funds shall be authorized and approved by the
Common Council in its discretion as the City's Fiscal Body per Indiana

law upon the advice and recommendation of the City's Public Arts
Committee.
