HomeMy WebLinkAbout1992-OR-15ORDINANCE NO. 92-OR-~.~ AN ORDINANCE ESTABLISHING LIMITED TIME PARKING ZONES WHEREAS, the business community of the City of Jeffersonville has requested that actions be taken to alleviate parking problems in Jeffersonville; and WHEREAS, the business community feels that the parking meters located in and around downtown Jeffersonville pose a hinderance to commerce; and WHEREAS, it would be in the best interest of the safety and welfare of the community that some limitations be placed on parking in certain locations in the City of Jeffersonville; NOW, THEREFORE, LET IT BE ORDAINED BY THE COMMON COUNCIL BY THE CITY OF JEFFERSONVILLE that the following described parts of streets are established as limited time parking zones: SECTION I A. 2 Hour Zones Chestnut Pearl St. and Wall St. Both Court Ave. Kentucky St. and Michigan North Court Ave. Mulberry St. and Mechanic St. South Court Ave. Mechanic St. and 6th St. North Kentucky St. 6th St. and Wall St. East Maple St. Pearl St. and Wall St. Both Market St. Pearl St. and Wall St. Both Meigs Ave. 7th St. and Franklin St. East Meigs Ave. 7th St. and Court Ave. Both Missouri St. Sparks Ave. and 7th St. West Pearl St. Chestnut Stl and Court Ave. Both Riverside Dr. Mulberry St. and Wall St. Both Sparks Ave. South Spring St. Riverside Dr. and 8th St. Both Wall St. Court Ave. and Federal St. West Wall St. Chestnut St. and Court Ave. Both Watt St. 7th St. and Court Ave. Both 6th St. Court Ave. and Michigan St. North 13th St. Missouri To Spring St. North STREET BETWEEN SIDE B. 1 Hour Zones STREET BETWEEN SIDE Court Ave. Meigs Ave. and Watt St. Both SECTION II (a) The Board of Public Works and Safety is hereby authorized to issue permits to individuals who live in the areas in which two hour parking only zones are enforced entitling them to park, without limit as to time, on either side of the street within the block in which they reside. (b) The Board of Public Works and Safety is hereby authorized, in its discretion, to suspend the operation of the two hour only parking zones in order to further a general, planned business promotion or other special activity. SECTION HI (a) It shall be unlawful for any person to cause, allow, permit or suffer any vehicle of which he is the operator or the registered owner to be parked for more than the designated maximum period in one of the aforementioned parking zones. A vehicle shall be considered to be parked overtime when it has remained in the zone for longer than the maximum permissible time during the following periods: (i) Monday through Friday from 9:00 a.m. until 5:00 p.m.; provided, however, that unlimited parking shall be permitted on all legal holidays. (b) A person who violates this ordinance shall pay a fine in the amount of $5.00. However, if the fine is not paid within forty-eight hours of the violation then the fine shall be $15.00. Each consecutive designated period of time that a vehicle is not moved shall constiute a separate offense. (c) It shall be the duty of each traffic patrolman and all of other employees of the City that are so directed by the Mayor to take the number of each vehicle which is parked in violation of this ordinance and report them to the police department. (d) Any violator who has found to have received five violations which are unpaid shall have his vehicle towed~in and shall pay the towing charge and fines for violations prior to redemption of his vehicle. SECTION IV The fines under this ordinance may be collected by the Jeffersonville Police Department and the City Clerk-Treasurer. All fines Collected shall he deposited in a separate account which shall be used first for the enforcement of this ordinance. SECTION V The Board of Public Works and Safety is, by majority vote, empowered to designate other streets, or parts of streets, as limited time parking areas or change the designations made by this ordinance which from time to time may be necessary. SECTION VI All other ordinances which contradict this ordinance or sections of ordinances or which provide for the erection, maintenance, or enforcement of parking meter zones are hereby repealed. SECTION VH This Ordinance shall become effective two months after its passage by the Common Council, timely approval by the Mayor and upon being published.
