HomeMy WebLinkAbout11-01-1993COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 1, 1993 The Common Council of the City of Jeffersonville meg in regular session in Council Chambers in the City-County Building, Jeffersonville~ Indiana, at 9:30 P.M. on the let day of November~ 1993. The meeting was called to order by Mayor Raymond J. Parker Jr.~ with Clerk and Treasurer C. Richard Spencer Jr~ at the desk. Mayor Parker welcomed ali in attendance, asking all those present to stand as asked all flag. Councilperson Steven Stemler gave the invocation. Frantz, Peggy Knight Witder~ Barbara Wilson, Robert L. Potter, and Steven R. Stemler. Absent: None. Mayor Parker preeented the minutes of the meetings of August 5~ September 27~ September 30, and October 47 1993 for consideration by the Council. Council President Potter- made the motion to approve the minutes as presented, seconded by Councilperson Williams, and carried unanimously. Clerk and Treasurer Spencer presented the claim list for consideration by the Council explaining one change. Following all discussion, Council President Potter made the motion to approve the claims as corrected~ seconded by Councilperson Wolpert and carried unanimously. Councilperson Wilder explained ehe had asked Attorney Gillenwater to obtain a copy of the Clarksville "Open Container" Ordinance and the same day she was contacted by a gentleman advocating this type of Ordinance. She then asked those that wished to speak regarding thie Ordinance to come forward. Pastor David Williams of Walnut Ridge Baptist Church in Jeffereonville encouraged the Council to pass the Ordinance and see it enforced. He has found that Indiana is one of only ? states in the country that does not have an open container law. Pastor Williams has counseled a man who called the PAGE ~ NOVEMBER 1, 199B Free Indiana. Ms. Trina Carter told the Council her friend's 19 year old brother was killed. She urges passages as Jeffersonville needs to set an example as driving is not the place to be drinking. The grandmother of a child killed by a drunk driver thinks the law should be changed. Drinking should be done at home~ not on the high~ay~ Councilperson Wilder read parts of a letter from the Indiana State Police in support of passage. Councilperson Wilder has distributed information regarding some problems in South Bend. It is Attorney Gillenwater's opinion that this should not disable the Jeffersonville Ordinance. Mr. Walter Schultz from Floyd County explained that New Albany has passed a similar Ordinance on two readings. Councilperson Wilder thanked all who came out in support of this Ordinance. She realizes this is painful and supports their courage. Councilperson Wilder then made the motion to suspend the rules for Ordinance No. 9B-OR-61: seconded by Councilperson Frantz and carried unanimously. Council President Potter asked if this would include charter bus transportation. Councilperson Wilder explained this Ordinance would of situation. PAGE 3 NOVEMBER 1~ 1993 Ms. Sharon Smith of the Downtown Merchants Association gave the Council a printed summary of what hes been done to support to vote for the boat~ thanking the Council for their support. Councilperson Frantz will not ask for a final reading on Ordinance No. 93-0R-58~ City of Jeffersonville Take Home Vehicle Policy at this time. She does ask that Attorney Gillenwater and Mayor Parker file a petition in Court to determine if this is the call of the Council or not. If they do not wish to file for a declatory judgement on the matter Councilperson Frantz will do so. C6uncil President Potter explained he will be in Indianapolis on Wednesday and volunteered to drop a letter off at the Attorney General's Office. Councilperson Frantz would like to have it filed in Court for a Judge to decide. There is a difference of opinion here and it does need to be cleared up. As the Council approprates the money~ Councilperson Frantz feels the Council has the power to say how the property is used. This is a good Ordinance and she has worked almost 6 months on it. Councilperson Frantz will not put vote on something that the Mayor says and that he will not have to enforce. the Council in a position to is not the call of the Council Attorney Gillenwater referred to Indiana statute 36-8-3-2 which gives exclusive control to the safety board. It is Attorney Gillenwater's opinion that it is clear the Board of Public Works has exclusive control. Attorney Gillenwater has contacted Indiana Association of Cities and Towns and found they do concur with his opinion. He also asked them if there were any local Ordinances and was told there were only administrative policies. Councilperson Frantz read a quote from 36-4-6-18 which gives the control of City property to the Council. There is a difference of opinion that needs to be settled. Counoilperson Frantz stated she has supported the take home car program but she could never vote to replace another vehicle as tong as there is room for abuse of vehicles and no monitoring. Mayor Parker would like Councilperson Frantz to elaborate on where there has been abuse and when she has notified his office of abuse. Councilperson Frantz asked if Mayor Parker wished her to name names. Mayor Parker replied~ yes. Coun~ilperson Frantz will not do that in a public meeting as she does not believe she can discuss personnel in an open meeting. He cannot know without being told. Mayor Parker challenged anyone in the room to say that he has not investigated any complaint of abuse of City property. There was no response to this challenge. None. Council PPesident Potter explained there will be something in written form regarding insurance at the next meeting. Council President Potter explained he had been in the Vehiclse Maintenance Building and the temperature inside was 3~ degrees. Three bids have been received to install eiding on the building. This would cost $19,900 and he asks if the Council would give approval to go ahead with the pro~ect with proper transfer made at a later date. Councilperson Williams would like to have electrical corrections made in the building at the same time. He believes this would cost from $10~000 to $18,00©. It is the pleasure of the Council to proceed. Ms. Vicky Conlin, Ethics Commission Chairperson, appeared before the Council recommending the Council consider proposed amendments to the Ethics Ordinance to make it more workable and underetandable to all involved. This is the feeling of all five PAGE 5 NOVEMBER I7 1993 members. The Commission has elected officers and developed a complaint form. The stale mate is in the workability and understanding of the Ordinance as it is written. The main objective is to have an ethics handout for employees, City officials and all appointees. Director of Redevelopment Carroll Gowens spoke to the Council on the Community Focus Grant. The Governor signed the Grant agreement on July 89~ 1993. Since that time a number of steps have been undertaken. The environmental review process ended yesterday. State Agencies then have 15 days to make comment. It is anticapated there will be a release of funds sometime between November 167 1993 and the first of 1994. No contracts will be entered into until a notice to release funds is received. An R.F.P. for engineering has been made and the Corradino Group has been selected. No contract has been entered into nor has a notice to proceed been given. It is anticapted construction will start in the Spring of 1994 and by this time next year the project should be complete. This money ($490~000) does not come to the City but is administered by the State. Mr. Biii Saegeeser of the Corradino Group explained the Group is ready to proceed as soon as the notice is received. He also anticipates completion by October 1994. Clerk and Treasurer Spencer presented and explained Ordinance No. 93-0R-6~ An Ordinance Establishing A Non-Reverting Fund For The Purposes Of Repair And Replacement Of City Property. Following all discussions Frantz made the motion to suspend the rules for 93-OR-6B~ seconded by Councilperson Wolpert and carried Councilperson Frantz then made the motion to pass 93-OR-6B on all three readings: seconded by Councilperson Williams: passing on the following roll call vote: Ayes: Councilpersons Stemler: Potter, Wolpert~ Williams: Frantz~ Wilder~ and Wilson. Nays: None. Mayor Parker related that since June 28 there has been a lot of talk regarding Riverboat Gaming. The vobe will be tomorrow and Mayor Parker asked all to please vote to express an opinion. He will personally be voting yes as he wants the jobs~ economic development~ tourism, less taxes for the community, and all the benefits it can bring. Council President Potter asks the Council to check calendars~ suggesting the Council meet only once around December 15 or 16, 1993. He has received a letter requesting a donation from the Historic Tour Group as the Council donated $1~000 last year. He asks the Council to think about this also. Council President Potter thanked the F.O.P. for the support and for going on record in supporting a yes vote on Riverboat Gaming. Council President Potter welcomes Councilperson Wolpert back~ Councilperson Wolpert said it was good to be back and thanked all for the cards and flowers he received. Councilperson Williams will follow up at the Board Of Works on the sewer request from Mr. Ralph Conn. Councilperson Williams has received a document regarding the Indiana Port Commission. This may be an opportunity for the Revolving Loan Fund. His concern is there is an opportunity here for a business to utilize this fund. He does caution this fund be used accordingly. Mr. Mike Maschmeyer, Att~orney for the Ogden Corporation asked for the opportunity to respond to the consultant study prior to the Council ranking the Riverboat Gaming proposals. A copy of the breakdown of the funds received from the sale of the old Wastewater Treatment Plant has been distributed to the Council. Mayor Parker explained he has been working for a bridge in the Eastern corridor. Councilperson Stemler gave a heart-felt thanks to all those involved in the Halloween in the Park. Special thanks go to Ms. Betty Moore and Park Superintendent Caldwell. Council President Potter is pleased with what the Parks Frantz does intend to collect toys and distribute them as she did last year. She has been contacted by several organizaitons that will help. Councilperson Wilson said the most important part is to have a place to store the toys. Fire Chief Dooley explained the Fire Department will be more than happy to help in this area. Councilperson Wilson thinks this is a good thing and all should support this effort. Wilson inquired if Councilperson Frantz had in the Empty Stocking Fund? She only hears the City is broke however money is transfered here and there. The taxpayer has to give and the employee has to give. It has been stated if a family is in a car they would not get involved in a high speed chase or a shoot out. She states she has a tape on misconduct of an employee. Administrative Assistant Donna Baird asked Ms. Nolan who she calls with complaints. Ms. Notan stated she called the Mayor last week and he was not available. Assistant Baird explained she does have the authority to call department heads regarding complaints and she requests Ms. Nolan make complaints through the Mayor's Office so they may be taken care of.
