ORDINANCE ABOLISHING THE JEFFERSONVILLE CITY COURT
OF THE CITY OF JEFFERSONVILLE, INDIANA
I.C. 36-4-1-1 establishes the City of Jeffersonville, Indinana(the City) as a class
two city; and
1_C- 36-4-6-2 provides that the Common Council of the City of Jeffersonville,
Indiana(the Council) is the legislative and fiscal body of the City; and
I.C. 36-4-6-18 provides that the Council may pass ordinances, resolutions, and
motions for the government of the City, control of City property and finances, and
the appropriation of money; and
I.C. 33-35-1-1 grants the authority to establish or abolish a city court of a class
two city to the Council; and
The Jeffersonville City Court was established by City Ordinance as a municipal
court, prior to January 1, 1986; and the Judge of the city court is not a
constitutional office; and
I.C. 33-35-1-1(a) provides that during 2006 and every fourth year after that, a
second or third class city or a town may by ordinance establish or abolish a city
or town court; and
I.C. 33-35-1-1(d) provides that a city court in existance on January 1, 1986 may
continue in operation until it is abolished by ordinance; and
the Council desires to abolish the Jeffersonville City Court effective midnight on
December 31, 2015;
NOW THEREFORE, LET IT BE ORDAINED:
1. That pursuant to I.C. 33-35-1-1 the Jeffersonville City Court of the City of Jeffersonville,
Indiana, is abolished effective midnight December 31, 2015.
2- That all ordinances adopted establishing the Jeffersonville City Court of Jeffersonville,
Indiana are hereby recinded and repealed -
3. That the City will give notice of this action to the Division of State Court Administration of
the Office of Judicial Administration per I.C. 33-35-1-1(e).
